Box 549 Wanchese N.C. 27981 Dear Mr. Perry: You have our approval, in accordance with the attached conditions, to dredge 1000 square feet waters for the purpose of excavating a basin and constructing a bulkheaded at lot 16 of the NC Seafood Industrial Park, as you described in your application dated 16 April, 1999. After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 3112. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply Watershed regulations. Also this approval will expire when the accompanying 404 or CAMA permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and send us a new application. If the property is sold, the new owner must be given a copy of this Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h). For this approval to be valid, you must follow the conditions listed in the attached certification. This approval shall expire when the corresponding Nationwide Permit expires or as otherwise provided in the General Certification. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 276 1 1-7447. This certification and its conditions are final and binding unless you ask for a hearing. PROJECT SUMMARY: The applicant proposes to excavate a 32 ft. x 40 ft. basin and construct 120 ft. of bulkhead within the basin on Lot 16 of the Park. North Carolina Industrial Seafood Park (NCDMF) Bio Report Page Two The North Carolina Seafood Industrial Park is located on 54 acres adjacent to a man- made basin adjoining Mill (Landing) Creek off Roanoke Sound and at 928 Harbor Road (SR 1140) in Wanchese, Dare County. The Park is proposing farther development of Lot 6 which has an area of f 40,050t*q. ft. and a basin shoreline of 280 ft. Existing development on the tract is a 24 ft. wide concrete dock paralleling the shoreline for approximately 180 ft. The USACOE dredge Seveitzer moors at this dock. Little or no vegetation exists on the lot which is surfaced in most areas with marl. Lot elevation varies from 4-8 feet above normal water level (NWL). The waters of Mill Creek are classified as SC by the Division of Environmental Management. The water depth in the basin immediately adjacent to this property ranges from -2 ft. to -10 ft. The applicant, on behalf of the North Carolina Division of Marine Fisheries (DMF), proposes to excavate an upland basin to create a docking and loading facility for the DMF resource enhancement research vessel. The proposed upland basin dimensions are roughly 32 ft. x 40 ft. with a proposed final water depth of -41/2 ft. The basin will have a 40 ft. wide mouth on Mill Creek and the upland shoreline will be protected by an approximately 120 ft. long treated wooden bulkhead. The location of the basin will be adjacent to and south of the existing concrete dock. To reach a connecting water depth of -41/2 ft. will require the excavation of an area approximately 20 ft. wide and 50 ft. long waterward of the proposed basin. All excavated material is to be placed in an undesignated area on the park for future use. The excavation of the upland basin will result in approximately 1300 sq. ft. of estuarine shoreline (ES) area of environmental concern (AEC) being converted to public trust area (PTA) and estuarine waters (EW) AECs. Approximately 215 cu yds of material will be excavated above NWL and 215 cu yds of material will be excavated below NWL for the basin creation. The waterward excavation to reach comparable connecting water depth will result in approximately 75 cu yds of material removed from 1000 sq. ft. of the existing man-made basin (PTA, EW). Temporary water turbidity will occur during construction. The construction of the bulkhead will result in approximately 2400 sq. ft. of ES being backfilled and graded. PROJECT SUMMARY: The applicant proposes to excavate a 32 ft. x 40 ft. basin and construct 120 ft. of bulkhead within the basin on Lot 16 of the Park. North Carolina Industrial Seafood Park (NCDMF) Bio Report Page Two The North Carolina Seafood Industrial Park is located on 54 acres adjacent to a man- made basin adjoining Mill (Landing) Creek off Roanoke Sound and at 928 Harbor Road (SR 1140) in Wanchese, Dare County. The Park is proposing farther development of Lot 6 which has an area of ±40,050 sq. ft. and a basin shoreline of 280 ft. Existing development on the tract is a 24 ft. wide concrete dock paralleling the shoreline for approximately 180 ft. The USACOE dredge Seveitzer moors at this dock. Little or no vegetation exists on the lot which is surfaced in most areas with marl. Lot elevation varies from 4-8 feet above normal water level (N)VL). The waters of Mill Creek are classified as SC by the Division of Environmental Management. The water depth in the basin immediately adjacent to this property ranges from -2 ft. to -10 ft. The applicant, on behalf of the North Carolina Division of Marine Fisheries (DMF), proposes to excavate an upland basin to create a docking and loading facility for the DMF resource enhancement research vessel. The proposed upland basin dimensions are roughly 32 ft. x 40 ft. with a proposed final water depth of -41/2 ft. The basin will have a 40 ft. wide mouth on Mill Creek and the upland shoreline will be protected by an approximately 120 ft. long treated wooden bulkhead. The location of the basin will be adjacent to and south of the existing concrete dock. To reach a connecting water depth of -41/2 ft. will require the excavation of an area approximately 20 ft. wide and 50 ft. long waterward of the proposed basin. All excavated material is to be placed in an undesignated area on the park for future use. The excavation of the upland basin will result in approximately 1300 sq. ft. of estuarine shoreline (ES) area of environmental concern (AEC) being converted to public trust area (PTA) and estuarine waters (EW) AECs. Approximately 215 cu yds of material will be excavated above NWL and 215 cu yds of material will be excavated below NWL for the basin creation. The waterward excavation to reach comparable connecting water depth will result in approximately 75 cu yds of material removed from 1000 sq. ft. of the existing man-made basin (PTA, EW). Temporary water turbidity will occur during construction. The construction of the bulkhead will result in approximately 2400 sq. ft. of ES being backfilled and graded.
