Asheville N.C. 28806 Dear Mr.Young: You have our approval, in accordance with the attached conditions and those listed below, to place fill material in250 linear feet of streams for the purpose of constructing a damn and pond at Hickory Nut Gap area, as you described in your application dated 29 March 1999. After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 3108. This certification allows you to use Nationwide Permit Number 26 when the Corps of Engineers issues it. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal Stotmwater, Non-Discharge and Water Supply Water shed regulations. This approval will expire when the accompanying 404 or CAMA permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application except as modified below. If you change your project, you must notify us and you may be required to send us a new application.. If the property is sold, the new owner must be given a copy of this Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h) (6) and (7). For this approval to be valid, you must follow the conditions listed in the attached certification and any additional conditions listed below. 1. Deed notifications or similar mechanisms shall be placed on all lots with remaining jurisdictional wetlands and waters or areas within 50 feet of all streams and ponds to notify the state in order to assure compliance for future wetland and/or water impact. These mechanisms shall be put in place within 30 days of the date of this letter or the issuance of the 404 Permit (whichever is later). 2. Mitigation shall be done as describe in the final mitigation plan after submittal to DWQ's Asheville Regional office to Mr. Mike Parker. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition, which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 276 1 1-7447. This certification and its conditions are final and binding unless you ask for a hearing. Proposed Mitigation Plan for Dam Construction on South Prong Little Pine Creek Madison County, North Carolina The following mitigation plan is submitted for the proposed dam construction on the South Prong Little Pine Creek, Madison County, North Carolina. The plan includes description of the proposed mitigation, location map, and schedule for completion. An application for a Nationwide #26 Permit was concurrently submitted for construction of a dam that will cover (pipe) 250 linear feet of stream. Mitigation for the loss of stream habitats at the rate of 2:1 is required by US Army Corps of Engineers and NC Division of Water Quality. The proposed mitigation includes exclusion of livestock by fencing and revegetation of a riparian buffer along 500 linear feet of an unnamed tributary of the South Prong Little Pine Creek on Mr. Hyman Young's property (Figure 1). The fencing will be installed parallel to the stream with a 25 foot buffer between the fence and stream channel. The fencing will installed in such a manner to exclude livestock from both banks of the stream. The fencing exclusion will be held in perpetuity by the landowner and will be amended to existing deed if the property is transferred, leased, or sold. The proposed site currently has no riparian buffer zone. A riparian buffer will be planted along the 500 foot reach with native vegetation (willow, red maple, etc.) representative of the riparian community along Little Pine Creek. Vegetation type and placement will be determined in consultation with the NC Wildlife Resources Commission, Corps of Engineers, and National Resources Conservation Service.
