On February 23,
1999 I met with you at the subject property. At your request, an evaluation of the stream
feature was performed to determine if the site would require compliance with the Neuse Buffer Rule. As
a result, it was determined that the feature present on this tract of land is a stream and therefore subject to
protection under The Neuse River Basin: Nutrient Sensitive Waters Management Strategy; Protection and
Maintenance of Existing Riparian Areas, Administrative Code T15A:02B.0233 (NCAC 0233).
This project is referenced by the Raleigh Regional Office as NBRRO 99-053. The subject feature and the
zone of protection has been delineated on the map received by this Office February 17, 1999 and the area
applicable to protection under the Neuse Buffer Rules begins off of the subject property and continues
through it.
Please be reminded that the riparian buffer is protected in two zones totaling fifty feet of protection. In
accordance with the Rule, sheet flow from stormwater must be maintained, to the maximum extent practical,
through dispersing concentrated flow and/or re-establishment of vegetation to maintain the efficacy of the
riparian area. Also, the sewer crossing for attachment to the existing collection line will require the
completion of a Pre Construction Notification. (See attached).
