On March 22, 1998, I completed an evaluation of the stream feature on the subject property to determine whether the site would require compliance with the Neuse Buffer Rule. This specific project is referenced by the Raleigh Regional Office as NBRRO-050. As a result it was determined that the feature present on the property is subject to protection under the Neuse River Basin: Nutrient Sensitive Waters Management Strategy; Protection and Maintenance of Existing Riparian Areas, Administrative Code T15A:02B.0233 (NCAC 0233). Please be reminded that the riparian buffer is protected in two zones totaling fifty feet of protection. In accordance with the Rule, sheet flow from stormwater must be maintained,to the maximum extent practical, through dispersing concentrated flow and/or re-establishment of vegetation to maintain the efficacy of the riparian area. The main feature is an unnamed tributary to Richland Creek and flows through this site from property line to property line along Chapel Hill Road. This Office is in receipt of two sets of plat maps. One does not show any impact to the riparian buffer and the other shows a large impact caused by a proposed road . ; crossing. The road crossing indicated on this plat map will require that no other practical alternatives for r the location exist and that the crossing can be accomplished in a manner that has little or no impact on the riparian zone. It is the opinion of this Office that the road crossing is not needed and would recommend the denial of a 401 permit to allow the impact to the buffer.
