After reviewing your application, we have decided that this impact is covered by General Water Quality Certification Number 3112. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply Watershed regulations. This approval will expire when the accompanying 404 or CAMA permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application except as modified below. If you change your project, you must notify us and you may be required to send us a new application for a new certification. If the property is sold, the new owner must be given a copy of this Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h) (6) and (7). For this approval to be valid, you must follow the condition listed in the attached certification. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition conforming to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing. This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. PROJECT SUMMARY: The applicant proposes to construct a new bulkhead, a second pier and dock, and roofed gazebo between the two piers. The structures would provide water access for a future duplex to be constructed on the two lots. Reid Cottrell Page 2 9. PROJECT DESCRIPTION The project site is located at 1205 Canal Drive, in Carolina Beach, NC, in New Hanover County. The property consists of two residential lots on the east side of Carolina Beach Yacht Basin. The lots are 100 feet wide (50 ft. each) and approximately 75 - 80 feet deep from Canal Drive. The highground is cleared and maintained as a lawn. There is an existing pier and floating dock extending from the northwest side of the property and an existing concrete driveway. The adjacent residential property to the south is stabilized by an existing bulkhead. There is a border of coastal wetlands along the shoreline, ranging from 10 to 24 feet in width. It is predominantly Smooth Cordgrass (Spartina alterniflora), but also includes some Black Needle Rush (Juncus roemarianus), Spike Grass (Distichlas spicada), and Sea Lavender (Lumonium, spp.) in the transition from marsh to highground. The upland elevation of the lot is approximately 6 feet above mean sea level. The Carolina Beach Yacht Basin is approximately 1300 feet wide in the project area. It is classified as SB by the NC Division of Water Quality, and is CLOSED to the harvest of shellfish. The basin is not a designated primary nursery area (PNA) by the NC Division of Marine Fisheries. The applicant proposes to construct a new bulkhead along the west side of the property. The proposed bulkhead placement would be located along the wetland he delineated by the U. S. Army Corps of Engineers field staff. Backfill material for the proposed wall would be imported from an upland source. The applicant plans to import enough fill material to raise the highground area approximately two (2) feet ( 8 ft. MSL). A second pier is proposed on the southern lot. The new structure would mirror the existing pier, curved walkway (75 ft. long X 5 ft. wide) and terminal floating dock (24 ft. long X 10 ft. wide). The applicant proposes to construct a gazebo (20 ft. X 20 ft.) between the two piers, with access walks from each. Three (3) additional mooring pilings along the center line and three (3) along the southern riparian line would complete the project. 10. ANTICIPATED IMPACTS The backfilling of the bulkhead and filling of the lot would disturb approximately 8000 square feet of highground area. The construction of the second pier and common gazebo would incorporate 640 square feet of Estuarine Waters, Public Trust. The combined structures would shade approximately 1015 square feet of coastal wetlands (120 sq.ft.) and shallow bottom (895 sq.ft.). The proposed bulkhead would stabilize the property's shoreline. There would be some disturbance of the marsh and shallow bottom during initial construction, however, provided there is adequate elevation of the walkway and gazebo, no long-term adverse impacts are anticipated.
