Stevens, Director ENVIRONMENT AND NATURAL RESOURCES June 21, 1999 Wake County DWQ Project #990226 APPROVAL of 401 Water Quality Certification and ADDITIONAL CONDITIONS Dr. Robert Finch 3612 Ranlo Dr. Raleigh NC 27612 Dear Mr. Finch: You have our approval, in accordance with the attached conditions and those listed below, to place fill material in 100 feet streams and flood about 500 feet of streams for the purpose of constructing an irrigation pond at old Creedmore and Norwood roads as, described in your application dated March 7,1999. After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 3108. This certification allows you to use Nationwide Permit Number 26 when the Corps of Engineers issues it. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply Water shed regulations. This approval will expire when the accompanying 404 or CAMA permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application except as modified below. If you change your project, you must notify us and you may be required to send us a new application.. If the property is sold, the new owner must be given a copy of this Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h) (6) and (7). For this approval to be valid, you must follow the conditions listed in the attached certification and any additional conditions listed below. 1. Deed notifications or similar mechanisms shall be placed on all lots with remaining jurisdictional wetlands and waters or areas within 50 feet of all streams and ponds to notify the state in order to assure compliance for future wetiand and/or water impact. These mechanisms shall be put in place within 30 days of the date of this letter or the issuance of the 404 Permit (whichever is later). 2. An additional condition is that stormwater shall be directed to sheetflow at nonerosive velocities through a 50 foot wide wooded buffer established around the new pond. Sediment and erosion control measures shall adhere to the design standards for sensitive watersheds (T 15:04b .0024). If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition, which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing. Division Of Water Quality Attention: Mr. John Domey 4401 Reedy Creek Road Raleigh, N.C. 27607 Dear Mr. Domey, I reviewed my proposed project with Mr. Danny Smith of your office, and Mr. Todd Tugwell(Core of Engineers) on Thursday the 23rd of February. This project is based on my desire to purchase 12.16 Acres on Norwwod Road in Wake County and to build 3 private residences for me and my immediate family. I would like to retire from IBM in the year 2001 and begin a small part time wholesale nursery business at my residence. The nursery will require a source of irrigation water, hence my need for a pond. The property currently has a small 25 aicre pond on it, but unfortunately it only has a small amount of water in it during the N.C. `vet season' months of Nov. through April. In the rw airing months (for lacking a better description) it is a "dry crater". Based on my i.eLI discussion with Mr. Smith and Mr. Tugwell; for my purpose of using this as a maidential site, and to protect the water juality, I propose to drain the pond by installing a Green Tree Retention Basin as described to me by Mr. Tugwell. Once installed, I will plant additional vegetation in the pond area to absorb nutrients thus improving down stream water quality. Since the existing pond is not a dependable water source; I also wish to construct a new pond approximately 400 ft, north of the existing pond which will be fed by 2 small steams which have cut into the ground approximately 8 ft. over the years. (They are approximately 4 ft. wide) These 2 streams meet at an apex at which I would build a dam at a hey .t of 9'/z ft. I would remove approximately IA acre of earth to form a pond between the 2 channels. I would retain the vegetation on the "outer side" of the channels (approximately 150 ft,) which previously which formed the streams, and would not tamper with any other growth as noted in the in the Guidance Manual. I believe my intended use of this property, (building on 3 private residences) presents a far better environmental use of the property than if it were used to build the maximum number of residences permitted by the zoning and soils present for septic systems. . More runoff would result from the additional structures and paved surfaces, and the additional fertilization applied to the lawns of up to 7 residences would do much more harm than the construction of a .5 acre pond. and 3 residencies The current Riparian Area Rule would: • Result in a financial hardship by limiting my ability to seek additional retirement income at the residence I wish to build. • No other property in Wake County is either affordable and /or of sufficient size to support my intentions. • The general purpose of this rule will be preserved, and water quality protected by the modifications I plan for the current pond, and by the limited scope of the new construction proposed. None of the following options are available or prudent: • Ground water > I do not wish to jeopardize the availability of the limited amount of ground water available in this location, as it will be needed to support the 3 households planned for the project. • Utilization of drainage form local topography > The water level of the proposed pond will also be supported by drainage from the "old pond" above it and will continue to accept drainage from the surrounding topo. • Pump and storage > As noted above a well as a water source is not a choice; and there is not sufficient flow in the 2 small streams to support pumping into alternate storage. This option would also require the removal of additional vegetation equal to or grater than the pond proposed. • High Flow Diversion > There is no "High Flow" in the water source under consideration. Please contact me with any questions or concerns you may have, I am not a "Developer" accustomed to the preparation of such project files, but just a simple individual wishing to pursue a retirement plan which would be supported by this project.I have endeavored to answer all questions and intend to demonstrate that I can do it while maintaining the intent of the current legislation, put in place to protect the environment for all of us. WITNESSETH, that Norwood Rd. is the owner of a 12.13-acre tract located on the northern right-of-way of Norwood Road (see deed recorded in Book 6084, Page 350, Wake County Registry) and Shoafs are the owner of a 11.9288-acre tract located on the northern right-of-way of Norwood Road adjoining the Norwood Rd. tract on the West (see deed recorded in Book , Page , Wake County Registry); and WHEREAS Shoafs are desirous of constructing a dam on their property, which dam would impound water and create a small pond below the 375=foot contour (mean sea level) line with resultant flooding of two small streams which will feed this pond; and WHEREAS one of the small streams flows through the property of Norwood Rd. and, when the pond is constructed, will impound water up to the 375-foot contour line causing a portion of the property of Norwood Rd. to be under water (see area shaded in red on attached map) and WHEREAS Norwood Rd. has agreed to allow Shoafs to construct a pond which would result in this flooding of a portion of its property.
