I have commented on this and I just wanted conditions placed on
the permit for NO FUTURE DREDGING because it is a PNA and
shallow. Maybe limit boat sizes? Because of potential "Kicking" in
Channels.

9. NARRATIVE DESCRIPTION:
Project Setting
The applicants own the 36-acre Middens Creek subdivision located on Middens
Creek off Marshallberg Road, in Smyrna Township, Carteret County. Individual lots
within the subdivision are approximately 1.25 acres in size. A 150' to 200' expanse of
intertidal marsh borders Middens Creek and runs the length of the tract. Currently only
paved subdivision roads and a gravel parking lot exist on the site. The gravel parking
lot is part of a .40-acre parcel that serves as a water access site. The water access site
adjoins lot #6 of the subdivision to the east and a private residential tract to the west.
The high ground portion of the access site is approximately 220' deep and 50' wide.
The remaining 200' of the access site is intertidal marsh vegetated primarily with
Spartina alterniflora. The access site along the marsh/high ground interface is
approximately 25' wide but balloons to 50' wide at the waters edge. There is a drainage
ditch running down the middle of the access site and eventually turns into a 10'-wide gut
leading into Middens Creek.
Based on the plats, water depths at the project site are: -2' below MLW at 10'
from the edge of the marsh; -3' below MLW at 50' from the marsh; -3.25' below MLW
at 80' from the marsh and -3.3' below MLW at 110' from the edge of the marsh. Based
on the survey, the mid-channel depth is -4.5' at MLW. Middens Creek is approximately
362' wide at the project site. The Creek is a designated Primary Nursery Area, is SA
waters and is closed to shellfishing at the project site.
Project Description
The applicant proposes to construct a three-slip community dock along a water
access site in Middens Creek Subdivision. The dock would be constructed to provide
water access for lot owners in the subdivision. According to the applicant's attorney,
dock use would be limited to small craft, less than 25' in length, with no cabins and no
heads on board. The dock would be 5' wide and would extend approximately 105' over
an intertidal marsh and approximately 175' over the Public Trust and Estuarine Waters
of Middens Creek. An 8' X 25' "L" shaped platform would be located at the waterward
end. Two 10' (width) X 12' (length) slips would be located at the end of the dock. The
third slip would be located inside the "L" and would be 10' (width) X 20' (length).
Since much of the dock runs along the ditch/gut, the dock's outer mooring pilings would
only extend out into the main body of the creek 90 feet. After several project
modification the proposal currently locates the dock 20' from the eastern riparian
property. The applicants own lot # 6 and their attorney has drafted a letter (enclosed)
stating that any perspective buyer of lot #6 would be advised of the encroachment on the
setback prior to purchase. No additional high ground disturbance is being proposed.

• An accurate, dated work plat (including plan view
and cross-sectional drawings) drawn to scale in black
ink on an $ 1/2" by 11" white paper. (Refer to
Coastal Resources Commission Rule 7J.0203 for a
detailed description.)
Please note that original drawings are preferred and
only high quality copies will be accepted. Blue-line
prints or other larger plats are acceptable only if an
adequate number of quality copies are provided by
applicant. (Contact the U.S. Army Corps of
Engineers regarding that agency's use of larger
drawings.) A site or location map is a part of plat
requirements and it must be sufficiently detailed to
guide agency personnel unfamiliar with the area to the

numbers, landmarks, and the like.
• A Stormwater Certification, if one is necessary.
• A list of the names and complete addresses of the
adjacent waterfront (riparian) landowners and

Anticipated Impacts
The access dock and associated three slips would usurp, and when boats are
docked in the slips, shade approximately 1,515 fe of Public Trust Areas and shallow
estuarine bottom habitat. The access dock would shade another 525 ftZ of Coastal
Wetlands. Another 300 fe of dock would be located on the high ground. The
installation of the pilings would create some short-term construction-related increases in
turbidity to the adjacent waters and would probably cause minor impacts to the estuarine
bottom habitat. The most obvious question appears to be in regard to potential impacts
to the shallow PNA habitat as a result of the small motor boats maneuvering and docking
in 3' and 3.5' of water. However, small motor boats typically draw less than 3.5' and
should cause only minimal impact on the estuarine resources.

from the owner to carry out the project.
• An accurate, dated work plat (including plan view
and cross-sectional drawings) drawn to scale in black
ink on an ll 1/2' by 11" white paper. (Refer to
Coastal Resources Commission Rule 71.0203 for a
detailed description.)
Pkase rate that original drawings are preferred and
only high quality copies will be accepted. Blue-fine
prints or other larger plats are acceptable only if an
adequate,,number of quality copies are provided by
applicant. (Contact the U.S. Army Corps of
Engineers regarding that agency's use of larger
drawings.) A site or location map is a part of plat
requirements and it must be sufficiently detailed to
guide agency personnel unfamiliar with the area to the

• A Stormwater Certification, if one is necessary
• A list of the names and complete addresses of the
adjacent waterfront (riparian) landowners and

that they have 30 days in which to submit comments
on the proposed project to the Division of Coastal
