After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 3112. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply Water shed regulations. This approval will expire when the accompanying 404 or CAMA permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application except as modified below. If you change your project, you must notify us and you may be required to send us a new application.. If the property is sold, the new owner must be given a copy of this Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h) (6) and (7). For this approval to be valid, you must follow the conditions listed in the attached certification and any additional conditions listed below. 1. The bulkhead replacement shall be limited to a location approximately, two feet waterward of the existing concrete bulkhead in order to minimize fill of shallow water habitat. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition, which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing. This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. PROJECT SUMMARY: The applicant is requesting to replace the concrete portion of his existing sea wall and locating the new sea wall 19 feet waterward of its present location, to align with adjacent walls. PROTECT DESCRIPTION The project site is an existing single-family residence, located at 8124 Bald Eagle Lane, adjacent to the Atlantic Intracoastal Waterway and Middle Sound, in the Porter's Neck area of New Hanover County. The site is accessed by Porter's Neck Rd. off U.S. Highway 17-North. Bald Eagle Lane lies parallel to the AIWW extending from Futches Creek south to the Figure 8 Island Bridge, and is developed with single family residences. Currently, the applicant's shoreline is stabilized by an existing sea wall. On the east side of the lot, the sea wall is standard vertical wooden bulkhead construction, approximately 4-5 feet high. on the west side of the lot, the wall is concrete, only 2.5-3 feet in height and it's alignment is approximately 20 feet landward of the east side bulkhead, and 40 feet landward of the existing bulkhead on the adjacent property to the west. There is evidence of erosion from frequent overwash, behind this lower section of concrete wall. Waterward of the concrete wall there is a remnant root mat from pre-existing vegetation, approximately 3-5 feet wide. No above ground vegetative growth was present. The remainder of the area waterward, as well as, waterward of the adjacent sea walls, is sandy bottom. The waters of Middle Sound are classified SA-ORW by the N.C. Division of Water Quality. The area is not a designated Primary Nursery Area, and is open to the taking of shellfish. New Hanover County classifies this area Conservation in their Land Use Plan. The applicant proposes to construct a new vertical wooden bulkhead to replace the section of concrete wall along the west side of his property. The new section of bulkhead would be 70 feet long and matching the heights of the adjacent walls. The applicant proposes to align the new wall with the existing bulkhead on the east side of the property. The proposed bulkhead placement would be located 19 feet waterward of the old existing concrete bulkhead. Backfill material for the proposed wall would be imported from an upland source. 10. ANTICIPATED ITUTA TS The construction of the bulkhead would incorporate 1330 square feet of Estuarine Waters, Public Trust Area, and shallow water bottom. The project would align the stabilized shoreline in the immediate area and eliminate the accumulation of trash and debris within the currently recessed area between the adjacent bulkheads, allowing the applicant equal use of his property. The high tides with heavy boat traffic has caused wash outs behind this wall and is effecting the property next to it. Wash out has occurred on both ends of this wall and will continue to erode. We feel that by closing off this cut out that it will be able to take the beating of heavy traffic and extreme weather conditions. better. The bottom in this area is sand or nonY-productive bottom with the exception of a small area of marsh grass along the bottom of the concert wall. The only reason we can see that this hole was made was to support a boat ramp years ago. From the looks of this area it can be determined that this area has always been a problem and with your permission we would like to take the first steps in correcting this matter. I have spoken to both property owners about what we would like to achieve and both have agreed that they have no objection with the proposed work that not only will this stop the erosion but will make all properties look better. PROTECT DESCRIPTION The project site is an existing single-family residence, located at 8124 Bald Eagle Lane, adjacent to the Atlantic Intracoastal Waterway and Middle Sound, in the Porter's Neck area of New Hanover County. The site is accessed by Porter's Neck Rd. off U.S. Highway 17-North. Bald Eagle Lane lies parallel to the AIWW extending from Futches Creek south to the Figure 8 Island Bridge, and is developed with single family residences. Currently, the applicant's shoreline is stabilized by an existing sea wall. On the east side of the lot, the sea wall is standard vertical wooden bulkhead construction, approximately 4-5 feet high. on the west side of the lot, the wall is concrete, only 2.5-3 feet in height and it's alignment is approximately 20 feet landward of the east side bulkhead, and 40 feet landward of the existing bulkhead on the adjacent property to the west. There is evidence of erosion from frequent overwash, behind this lower section of concrete wall. Waterward of the concrete wall there is a remnant root mat from pre-existing vegetation, approximately 3-5 feet wide. No above ground vegetative growth was present. The remainder of the area waterward, as well as, waterward of the adjacent sea walls, is sandy bottom. The waters of Middle Sound are classified SA-ORW by the N.C. Division of Water Quality. The area is not a designated Primary Nursery Area, and is open to the taking of shellfish. New Hanover County classifies this area Conservation in their Land Use Plan. The applicant proposes to construct a new vertical wooden bulkhead to replace the section of concrete wall along the west side of his property. The new section of bulkhead would be 70 feet long and matching the heights of the adjacent walls. The applicant proposes to align the new wall with the existing bulkhead on the east side of the property. The proposed bulkhead placement would be located 19 feet waterward of the old existing concrete bulkhead. Backfill material for the proposed wall would be imported from an upland source. 10. ANTICIPATED IMPACTS The construction of the bulkhead would incorporate 1330 square feet of Estuarine Waters, Public Trust Area, and shallow water bottom. The project would align the stabilized shoreline in the immediate area and eliminate the accumulation of trash and debris within the currently recessed area between the adjacent bulkheads, allowing the applicant equal use of his property. The high tides with heavy boat traffic has caused wash outs behind this wall and is effecting the property next to it. Wash out has occurred on both ends of this wall and will continue to erode. We feel that by closing off this cut out that it will be able to take the beating of heavy traffic and extreme weather conditions. better. The bottom in this area is sand or none-productive bottom with the exception of a small area of marsh grass along the bottom of the concert wall. The only reason we can see that this hole was made was to support a boat ramp years ago. From the looks of this area it can be determined that this area has always been a problem and with your permission we would like to take the first steps in correcting this matter. 1 have spoken to both property owners about what we would like to achieve and both have agreed that they have no objection with the proposed work that not only will this stop the erosion but will make all properties look better.
