In order to facilitate getting a variance for the structure on lot #49 at Pinnacle Shores,= Zip;;an eT/pN
would like to state the following facts and propose the following: Fn f
FACTS:
1. Barry Simms, the dock contractor who built my dock was unaware of the restrictions
involved with the 760 line, as he only builds docks and piers.
2. I was unaware of the restrictions as well.
3. At my insistence, Barry submitted a drawing to Duke Power and Iredell County of
what was actually built. The plan was approved before we started building.
4. From the time I bought this lot, I have done everything in my power to meet and
exceed any covenants or rules I have known about.
I worked closely with Buzz Cobb in installing an expensive sea wall to prevent
further erosion of the property. Attached is a lettei from Crescent Properties praising
the work I personally did to prevent soil erosion and runoff into the lake.
5. Also, please note the construction is still pending as it was halted on receiving the
notice of violation.
In keeping with the covenants, the county and the Division of Water Quality, I would like
to make the following proposal. This proposal will minimize the hardship on my
contractor and myself and will benefit Lake Norman.
In keeping with paragraph G of Section .0216, Fresh Surface Water Quality Standards
for WS-IV Waters:
a. The roof be taken off the structure. This would leave the part of the structure over
the 760 line above ground with only 5 poles to disturb any water flow. These 5
poles are between 1 ft. and 9 ft. above the 760 line. The decking is slatted and
will not disrupt any natural rainfall.
b. Plantings and trees will be placed around the structure to enhance its appearance
and slow the rate of water drainage down the slope.

c. There will be no walkway to the pier or any other structure to channelize the
water.
d. If this compromise is approved by the County and the DENR I will go even
further to protect the lake from runoff.
I will not plant grass in the first 30 feet of the set back but will plant shrubbery with pine
needles and fabric mesh. This will be very expensive as the lot has 330 feet on the water
for a total of 9900 ft. of planting. Surely this good will more than offset 5 poles above
the 760 line.
I believe this proposal is in everyone's best interests and I thank you for your
consideration of it.

Dear Sirs:
You have our approval, in accordance with the attached conditions, to dredge in acres of wetlands or waters for the
purpose of constructing a boat dock at Pinnade Shores South 3 development, as you described in your application dated 8
March 1999. After reviewing your application, we have decided that this fill is covered by General Water Quality
Certification Number 3099. This Certification allows you to use Nationwide Permit Number 030 when the Corps of
Engineers issues it. In addition, you should get any other federal, state or local permits before you go ahead with your
project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and Water
Supply Watershed regulations. Also this approval will expire when the accompanying 404 or CAMA permit expires
unless otherwise specified in the General Certification.
This approval is only valid for the purpose and design that you described in your application. If you change your
project, you must notify us and send us a new application. If the property is sold, the new owner must be given a copy of
this Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for
this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC
2H .0506 N. For this approval to be valid, you must follow the conditions listed in the attached certification. This
approval shall expire when the corresponding Nationwide Permit expires or as otherwise provided in the General
Certification.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must
act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to
Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh,
N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. If you

Thank you for your March 12, 1997, letter requesting U.S. Fish and Wildlife Service (Service)
comments on the proposed dredging plan for Pinnacle Shores South. This is the report of the Service
and the Department of the Interior and is submitted in accordance with provisions of the Fish and
Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661 et seq.) and Section 7 of the
Endangered Species Act of 1973, as amended (16 U.S.C. 1531-1543).
Based on our initial review, the proposed action may impact fish and wildlife resources. However,
because of staffing limitations, we have elected not to conduct a field inspection of the project and
no further action is anticipated. If, prior to Duke Power's permit issuance, further information
becomes available which affects our position, we will forward supplemental comments to you.
Under no condition should this response be construed as a "no objection" report.
