We have decieded to further minimize our impacts by removing lots encroaching the stream and thus eliminating the need for fill and pipe the stream. We believe this new.layout will be acceptable. Since our total stream impact will now be 120" we respectfully withdraw our PRE-CONSTRUCTION NOTIFICATION PERMIT dated March 2 1999: Please review the enclosed map for the changes to the above referenced project. Charlotte N.C. 28210 Dear Mr. McAlpine: You have our approval, in accordance with the attached conditions and those listed below, to place fill material in 120 feet of streams for the purpose of residential development at Highland Park subdivision, as you described in your application dated 8 April 1999. After reviewing your application, we have decided that-this fill is covered by General Water Quality Certification Number 3108. This certification allows you to use Nationwide Permit Number 26 when the Corps of Engineers issues it. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply Water shed regulations. This approval will expire when the accompanying 404 or CAMA permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application except as modified below. If you change your project, you must notify us and you may be required to send us a new application.. If the property is sold, the new owner must be given a copy of this Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h) (6) and (7). For this approval to be valid, you must follow the conditions listed in the attached certification and any additional conditions listed below. 1. Deed notifications or similar mechanisms shall be placed on all lots with remaining jurisdictional wetlands and waters or areas within 50 feet of all streams and ponds to notify the state in order to assure compliance for future wetland and/or water impact. These mechanisms shall be put in place within 30 days of the date of this letter or the issuance of the 404 Permit (whichever is later). 2. Applicant is required that any stream fill which exceeds a total of 150 linear feet for this entire project (including this approval) will require Certification from DWQ and may require mitigation. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition, which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 276 1 1-7447. This certification and its conditions are final and binding unless you ask for a hearing. Therefore, unless modifications of the proposal are made as described below, we will have to move toward denial of your 401 Certification as required by 15A NCAC 2H .0507(e) and will place this project on hold as incomplete until we receive this additional information, we are requesting (by copy of this letter) that the U.S. Army Corps of Engineers place your project on administrative hold. Please provide us with information supporting your position that states your project must be constructed as planned and that you have no practicable alternative to placing fill in these waters and/or wetlands. Specifically can you construct your development and limit stream impacts to 150 feet or less? Any documentation such as maps and narrative that you can supply to address alternative designs for your project may be helpful in our review of your 401 Certification. Also this project will require compensatory mitigation as described in 15A NCAC 2H.0506(h). Your mitigation proposal is insufficient because none was proposed. Please respond within three weeks of the date of this letter by sending a copy of this information to me and one copy to Mr. Mike Parker, Mooresville Regional Office at Interchange Bldg. 59 Woodfin Place 28801. If we do not hear from you in three weeks, we will assume that you no longer want to pursue this project and we will consider the project as withdrawn. In this review, the applicant's engineer (}Sevin Vogle with Land Design Engineering) was advised that the proposed site lay-out did not attempt to avoid/minimize the proposed impacts to two stream channels with aquatic functions (crayfish). An alternative plan was suggested, however, the project was submitted without making the recommended changes. Prior to this Office recommending denial of the Certification request, Mr. Vogle consulted with his client (the applicant), and has indicated by phone that the project will be redesigned to reduce the total stream impacts to < 150 linear feet. March 2, 1999 Mr. John Dorney Division of Water Quality NCDENR 4401 Reedy Creek Road Raleigh, NC 27607 Re: Highland Park Subdivision Mecklenburg County, NC Impacts Minimization Narrative Deai Mr. Dorney: The measures that were taken to minimize the stream impacts with this project were put into the planning process at the very first stages of the design process„ The subdivision is bisected.into two distinct regions to maintain the existing stream system which divides the site. The McAlpine Company worked closely with the Charlotte Mecklenburg Planning Commission to minimize roadway crossings, as planning staff moved for more connectivity thru the site, and thus was able to minimize further potential impacts. Ultimately, the roadway and lot layout finalized in the design of the project was the most economically feasible while minimizing; the impacts to the streams. As you can see; we effectively avoided impacts to approximately 2000 LF of "important" streams. T_hs,, onlyalternative to further minimize impacts would be to delete lots from the current-plan. This would greatly affect 'tlie economic viability-of this project. Please review the enclosed Pre-Construction Notification Application for the above referenced project for approval or comments. Rindner subint Highl ad Park- Ctreatg y i Kevin: Based on a site visit on February 12, 1999, 1 have determined that the streams noted "A" and "B" on the attached plan could be subject to minimization and mitigation requirements by the USACE and the NCDWQ Stream "A" This stream will likely be confirmed as having important aquatic value by the USACE. Characteristics include persistent pools, riffle and pool complexes (a "special aquatic site"), small fish and crayfish: in the lower portions, amphibians and macro-invertebrates: evidence of wildlife utilizing the stream; and,rocky, . gravelly, and sandy channel substrate. Stream "A" is also lined with forested vegetation which is also. an important attribute. This stream would be subject to NCDWQ minimization and mitigation requirements as well. Waffl-!K This stream is small stream that flows through pasture and has been distur)ed by cattle. Unlike stream "ii" it has a sandy to muddy substrate. Based on NCDWQ guidelines, the channel has the characteristics that could result in minimization and mitigation requirenents by both the NCDWQ and/or the USACE. Characteristics included a. distinctive and continuous bed which varies from the surrounding vegetation; hydric. soil and hydrophytic vegetation (FACW and 08L) adjacent to the channel; etc. This stream had a very healthy population of aquatic insects and crayfish. The charnels and ditches beyond the blue and yellow flag appear to unimportant intermittent. to ephemeral streams. Although insects were present in these channels, crayfish, tadpoles, and fish were not present on the day we evaluated the site. Portions of these channels are also subject to review and. verification by the NCDWQ if they have been determined jurisdictional ("unimportant" or "important") by the USACE. Deed restrictions will likely be placed on all lots with remaining jurisdictional wetlands and waters or areas within 30 feet of streams and ponds to notify the state in order to assure compliance far future wetland and/or waters impacts as part of the 401 Water Quality Certification issued by NCDWQ. North Carolina Division of Water Quality (NCDWQ) is not required if impacts are less than 1/3 acre of jurisdictional waters and less than 150 linear feet of stream. beds and are above headwaters and no, other Nationwide Permit is required. In order to have a valid permit, a pre-construction notification is required to the USACE and the NCDWQ for impacts to streams (important or unimportant). If this is the case than the thresholds may not apply. Therefore, wetland and stream impacts may be considered in relation to previously authorized permits. Incorporating the wetlands and stream areas into lots (i.e. backyard) is acceptable as long as there, is adequate space to build the house and yard.
