remember Rebecca Flowers had asked us to find that she had vested
rights to develop without complying with Neuse Rules. I did not concu

with her lawyers that she had acquired vested rights?
She is now suing Johnston County on their new
policy/ordinance/whatever limiting the number of building permits to b
e
issued. In the newspaper article I read she said she had already put
in
roads, etc at her development. Did you or the Corps ever send anybody
down there to see if 404/401 necessary?

Flowers Plantation (Riverdell) Project

Johnston County
Attached for your review is a request for a decision regarding rights for Flowers
Plantation project at Riverdell development in Johnston County. We have examined our
records and find no record of a 401 Certification issued for this project. Also based on a
review of the attached materials, it is not clear whether 404 permits and 401 certifications
will be needed for this site. Please review the material by 26 March 1999.
