Our Washington Regional Office has performed a site investigation, and the Division has completed its review of the permit application. Our review has determined that the receiving stream designated by you has no natural flow on at least seven (7) consecutive days during a ten (10) year period and at least thirty (30) consecutive days during a two (2) year period. We refer to this stream as having zero 7Q10 and 30Q2 flow. Title 15A of the North Carolina Administrative Code, 2B .0206 (d) (2), specifically prohibits new or expanded discharges under such flow conditions. After thirty (30) days from receipt of this letter, this Division will send your permit application to public notice stating our intent to deny your NPDES permit modification request unless you withdraw your request for an NPDES permit by requesting a project return. If you wish to withdraw your request for a NPDES permit, you may do so by stating that desire in a letter to our office. Your letter must be received by our office within thirty (30) days of your receipt of this letter. The City should continue investigating alternatives other than discharging into the East Prong of Slocum Creek. The Division strongly encourages the City of Havelock to pursue a regional treatment facility with the Marine Corps Air Station or other local municipalities or units of local government. Type of treatment (specify whether proposed or existing) : Existing 1 . 50 MGD facility consisting of preliminary treatment (bar screen and grit removal ) followed by a contact stabilization process including aeration , clarification, reaeration, followed by nitrification basins followed by a final clarifier for sedimentation. The wastewater then flows through a chlorine contact basin for disinfection followed by a reaeration basin. However the facility proposes 1 .9 MGD facility consisting of preliminary treatment followed by primary clarifiers for sedimentation followed by a . biological process (anaerobic, anoxic and aerobic units) , activated sludge for carbonaceous and nutrient removal . The biological process would be followed by secondary clarifiers and filters then disinfection in the chlorine contact basin followed by reaeration. 4 . Sludge handling and disposal scheme: The sludge will be treated by lime stabilization and land applied on a permitted site . 5 . Other: PART IV -- EVALUATION AND RECOMMENDATIONS Havelock Wastewater Treatment facility request these modifications of upgrade to meet the nutrient and phosphorus limitations that will take effect January 1993 . Also included is an expansion fron 1 . 5 MGD to 1 . 9 MGD. The receiving stream has a 7-day 10-year low flow of zero. Therefore the City should be requested to show that there is no other feasible alternative to discharge in a zero flow stream.
