I am writing on behalf of Mr. And Mrs. Dombroski (ATD Construction Co.) to provide
additional information regarding their proposed project on Middle Sound Loop Road,
New Hanover County. Information on the subdivision of this tract and previous wetland
fill permits is provided as well as alternative design considerations.
Prior to 1997, the area containing the 5-acre project site and land within the South
Point subdivision were platted as two tracts, both owned by the Hoyle family. These
two tracts totaled 18.98-acres. I have spoken with the Land Records section of the
New Hanover County Planning office and it appears that Ms. Hoyle owned this property
(Map 4) since at least 1968. Landmark Developers bought both Hoyle tracts in 1997,
combined the tracts (Map 1), and subdivided the property to form the South Point
subdivision and a 5-acre undeveloped area. The Dombroskis now have an Offer to
Purchase contract on this 5-acre tract (Map 2). Property further to the north was not
previously owned by Ms. Hoyle but was also bought by Landmark Developers. This
property was subdivided to form the Middle Point subdivision, and received several
wetland fill permits. However, what are now the Middle Point and South Point
subdivisions appear to have been separate and distinct tracts, platted and recorded as
such, since well before 1985 (Map 4).

subdivision of land. However, it is my understanding that Landmark Developers
applied for and received a single Nationwide #26 permit for the South Point
subdivision. Mike Taylor, US Army Corps of Engineers, issued the permit on December
13, 1998 (Action ID # 199800721) for 0.14 acres of wetland fill for road construction.
This indicates less than 1-acre of wetland fill has been issued for both of the original
Hoyle tract. In fact, this wetland fill area and the 5-acre project tract were likely on
different Hoyle tracts (see Map 2). I have spoken with Jeff Richter, who expressed
concerns about cumulative wetland impacts resulting from subdivision of the property.
We have are discussing the issues outlined above and a possible conservation
easement to lessen concerns regarding future subdivision.
The placement and design of the proposed road has attempted to avoid and minimize
wetland impacts where practicable. The position of this tract and the wetland areas
within it do not allow access to the useable uplands without a wetland crossing.
Stoneybrook subdivision abuts the property along the east and northeast. It is not
possible to access the tract from this direction, as all property abutting these
boundaries are individual lots which have existed as such for many years (Map 2).
Platted and recorded lots also prevent entry from the northwestern corner of the tract
from the Middle Point subdivision. To have extended a road from the south Point
subdivision (to the west) into this tract would have crossed a wetland area that is, in
most places, wider than the crossing we are proposing. Currently, platted lots also
abut this boundary (Map 2).
Given these property and wetland boundaries, we feel access from Middle Sound Loop
Road is the most practicable approach. We have minimized wetland impacts by
placing the proposed crossing at the narrowest point (70') in the wetland system.
Considerable effort was also made to minimize the road width to a 30' easement, and
still met NC DOT requirements for acceptance of the road and its maintenance in the
future. Bridging the crossing was considered but determined impracticable based on
cost. I have spoken with engineers in the Structure and Design Department of NC
DOT. They feel a "cord-slab" bridge design would likely meet NC DOT specifications
for this crossing. Cost for this design is currently $55/sq.ft. And results in an estimated
$115,000 in construction cost alone, not including engineering costs. This amount of
effort and cost seems unreasonable for access to a 5-acre tract. The 30" diameter
culvert we have proposed is larger than the existing 24" culvert downstream (under
Y-a'nd a&na'4w?? 540MA, Yn'c.

APPROVAL of 401 Water Quality Certification and ADDITIONAL CONDITIONS

Dear Mr. Sirs:
You have our approval, in accordance with the attached conditions and those listed below, to place fill material in0.06
acres of wetlands or waters for the purpose of constructing an access road at your lot on Middle Sound Loop Road, as you
described in your application dated 17 February 1999. After reviewing your application, we have decided that this fill is covered
by General Water Quality Certification Number 3112. In addition, you should get any other federal, state or local permits before
you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non-
Discharge and Water Supply Water shed regulations. This approval will expire when the accompanying 404 or CAMA permit
expires unless otherwise specified in the General Certification.
This approval is only valid for the purpose and design that you described in your application except as modified below. If
you change your project, you must notify us and you may be required to send us a new application.. If the property is sold, the
new owner must be given a copy of this Certification and approval letter and is thereby responsible for complying with all
conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be
required as described in 15A NCAC 2H .0506 (h) (6) and (7). For this approval to be valid, you must follow the conditions
listed in the attached certification and any additional conditions listed below.
1. Deed notifications or similar mechanisms shall be placed on all lots with remaining jurisdictional wetlands and waters or
areas within 50 feet of all streams and ponds to notify the state in order to assure compliance for future wetland and/or
water impact. These mechanisms shall be put in place within 30 days of the date of this letter or the issuance of the 404
Permit (whichever is later).
2. An additional condition is that is that stormwater from this site shall be directed to sheetflow at non erosive velocities
through the remaining wetlands on-site before discharging into streams.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act
within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition, which conforms to Chapter
150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-
7447. This certification and its conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. If you have

we cannot make people buy property especially for a simple road crossing
to a residential lot. If flooding is the issue, it can be solved with
pipe size which is usually a local issue not 401. Unless you object i
will write 401 on this one as well. if you object, it will go to

I have read the addition,,1 infomation concerning the ADT earthern dam bridge proposal by Land
Management, I STILL c!;;ect. The people in the Stoneybrooke S/D are having flooding problems
due to poor draining in t area already. Additional impacts to the large drain there would most
likely cause additional pi )blems with water. The island development off River Road in New
Hanover County built a Iridge these folks can too.

Dear Sirs:
The Division of Water Quality has reviewed your plans for the discharge of fill material into 2419
square feet of wetlands located at your lot on Middle Sound Loop Rd. in New Hanover County. Insufficient
evidence is present in our files to conclude that your project must be built as planned in waters and/or
wetlands in accordance with 15A NCAC 2H.0506. Therefore, unless modifications of the proposal are
made as described below, we will have to move toward denial of your 401 Certification as required by 15A
NCAC 2H .0507(e) and will place this project on hold as incomplete until we receive this additional
information, we are requesting (by copy of this letter) that the U.S. Army Corps of Engineers place your
project on administrative hold.
Please provide us with information supporting your position that states your project must be
constructed as planned and that you have no practicable alternative to placing fill in these waters and/or
wetlands. Specifically can you construct your road crossing and home without wetland fill? If not,
compensatory mitigation will be required since earlier wetland fill in this subdivision was greater than one
acre. Any documentation such as maps and narrative that you can supply to address alternative designs for
your project may be helpful in our review of your 401 Certification. Also this project will require
compensatory mitigation as described in 15A NCAC 2H .0506(h). Please respond within three weeks of the
date of this letter by sending a copy of this information to me and one copy to Ms. Joanne Steenhuis
Wilmington Regional Office at NC. If we do not hear from you in three weeks, we will assume that you no
longer want to pursue this project and we will consider the project as withdrawn. I can be reached at 919-

8. PROJECT SUMMARY: The applicant proposes to construct an earthen causeway through a
wetland drain, which is adjacent and connected to waters classified SA-ORW (Outstanding
Resource Waters), to provide for road and cul-de-sac construction, a proposed single-family
residence, and future subdivision.

9. PROTECT D , IPTION
The project site is located on the north side of Middle Sound Loop Road, abutting the west side
of Stoneybrook subdivision, in New Hanover County. The project site is a 5.5 acre tract with
approximately 320 feet of road frontage and approximately 780 feet in depth. Average elevation
of the property is approximately 12 feet above mean sea level. The tract is wooded and there is
a freshwater wetland drain, ranging from 75 to 175 feet in width, running through the southern
side of the property. The wetland drain area is the downstream outlet for a much larger natural
drainage system corridor which extends well beyond this property's boundaries. The "404 type"
wetlands are wooded swamp, vegetated primarily with Red Maple (Acer rubrum), Black Gum
(Nyssa sylvatica), Pond Pine (Pinus serotina), with scattered patches of Narrow-leaved Cat-tail
(Typha angustifolia) and Bull Rush (Scirpus, spp.) along the run of the watercourse. At Middle
Sound Loop Road, water is conveyed through an existing culvert (24 " diameter) into intertidal
coastal wetlands adjacent to Howe Creek. Here the shoreline includes Marsh-elder (Iva
frutescens), and Grounsel-bush (Baccharus halimifolia) shrubs, Sea- Oxeye (Borrichia frutescens)
and Salt Meadow Grass (Spartina patens) along the road shoulder. Black Needle Rush (Juncus
roemarianus) transitions to a marsh cove of Smooth Cordgrass (Spartina alterniflora), which is
approximately 500 feet in length, and expands from 100 to 300 feet in width at the open water
edge of Howe Creek.
The waters of Howe Creek adjacent to project site are classified as SA-ORW waters by the
Division of Water Quality. The waters are designated as primary nursery area by the NC Division
of Marine Fisheries, but they are CLOSED to the taking of shellfish. The Wilmington-New
Hanover Land Use Plan classifies the wetland area of the project site as Conservation and those
areas above the 100 year flood elevation as Resource Protection.
The applicant proposes to construct a private road from Middle Sound Loop Road to provide
access into the 5.5 acre tract. The road easement would be approximately 300 feet long and 30
feet wide, terminating in a cul-de-sac, with a 60 feet radius.The applicant proposes an earthen
causeway to span the wetland drain. The earthen causeway would be 75 feet long, 30 feet wide
and averaging 3-4 feet in height. The paved road surface would be eighteen (18) feet wide, with
grassed road shoulders, three (3) feet wide. The applicant would taper the road shoulders to the
wetland surface with a rip rap (rock) embankment, three (3) feet wide and a 1:1 slope. There
would be two (2) concrete pipes (30" diameter) installed to convey water to the downstream side
of the causeway. An additional area of rocks, 10 feet long and 8 feet wide, would be placed on
the wetland surface at both ends of the two culverts, to help diffuse the water flow through the
pipes. The applicant is proposing a single-family residence and reserving the remainder of the
upland area for future development.
10. ANTICIPATED EMPACT
The project, as proposed, will incorporate 2410 square of wooded swamp wetlands. The proposed
earthen causeway will impede the wetland's function as a natural drain for the surrounding area,
promoting the potential for flooding and ponding on the upstream side of the filled roadway.
Ponding of waters would create stagnant pools and mosquito breeding habitat. An additional

14,000 square feet of highground area would be disturbed by the remainder of the road and cul-de-sac,
and house and driveway construction. Additional disturbance and impervious surfaces would be created
by future subdivision of the tract.

Construction Co., Inc. As drawn, there is a 30' width between the toes of the side slopes. The
client would like a 10' length of rip rap to extend from the toe of each slope for the purpose of
water diffusion. This diffusion rip rap would be only 8' wide.

The ATD Construction project was a part of a land parcel that has
been permitted by Landmark. The project #s are: 940757 (1.07
acre of wetland fill) and Jim had recommended then that the entire
site be planned for wetland impacts. The second project # is
951279 for a 0.48 wetland impact for a utility line for middle pointe
S/D.
I think we can say no to the wetland fill on this, because the site
was a part of a larger parcel that has wetland impacts and has
been subdivided after October 5, 1989. If you have questions<
please call Scott McLendon at he COE here. He was quite upset
about the possibility of us missing the fact that there have been
other impacts (910) 251-4725.

fill material in a wooded swamp area to construct a road including riprap and
concrete pipes, adjacent Howe Creek, Ogden, New Hanover County, North
Carolina. Your receipt of this letter verifies your acceptance of a valid
request for certification in accordance with Section 325.2(b)(ii) of our
administrative regulations. Please note the attachment, which offers further
insight into the proposal.
We are considering authorizing the proposed activity pursuant to Section
404 of the Clean Water Act, and we have determined that a water quality
certification is required under the provisions of Section 401 of the same law.
A Department of the Army permit will not be granted until the certification
has been obtained or waived.
According to our administrative regulations, 60 days is reasonable for
State action. Therefore, if you have not acted on the request, or asked for an
extension of time, by April 20, 1999, the District Engineer will deem that
waiver has occurred.

The Corps field inspector for New Hanover County states that this property is a portion
of a larger subdivision which has since been subdivided into two developments
(Landmark Corporation's Middle Point and South Point). The whole tract has had
extensive permits, violations, and "Tulloch" type ditching, resulting in cumulative
impacts to approximately 25 acres of wetlands. A prospective buyer, (possibly the
present owner) expressed an intent to create a minimum of five building lots on this
particular property, although future development is not shown on this application.

8. PROJECT SUMMARY: The applicant proposes to construct an earthen causeway through a
wetland drain, which is adjacent and connected to waters classified SA-ORW (Outstanding
Resource Waters), to provide for road and cul-de-sac construction, a proposed single-family
residence, and future subdivision.

9. PROTECT DESCRIPTION
The project site is located on the north side of Middle Sound Loop Road, abutting the west side
of Stoneybrook subdivision, in New Hanover County. The project site is a 5.5 acre tract with
approximately 320 feet of road frontage and approximately 780 feet in depth. Average elevation
of the property is approximately 12 feet above mean sea level. The tract is wooded and there is
a freshwater wetland drain, ranging from 75 to 175 feet in width, running through the southern
side of the property. The wetland drain area is the downstream outlet for a much larger natural
drainage system corridor which extends well beyond this property's boundaries. The "404 type"
wetlands are wooded swamp, vegetated primarily with Red Maple (Acer rubrum), Black Gum
(Nyssa sylvatica), Pond Pine (Pinus serotina), with scattered patches of Narrow-leaved Cat-tail
(7?pha angustifolia) and Bull Rush (Scirpus, spp.) along the run of the watercourse. At Middle
Sound Loop Road, water is conveyed through an existing culvert (24 " diameter) into intertidal
coastal wetlands adjacent to Howe Creek. Here the shoreline includes Marsh-elder (Iva
frutescens), and Grounsel-bush (Baccharus haUmifolia) shrubs, Sea- Oxeye (Borrichia frutescens)
and Salt Meadow Grass (Spartina patens) along the road shoulder. Black Needle Rush (Juncus
roemarianus) transitions to a marsh cove of Smooth Cordgrass (Spartina alterniflora), which is
approximately 500 feet in length, and expands from 100 to 300 feet in width at the open water
edge of Howe Creek.
The waters of Howe Creek adjacent to project site are classified as SA-ORW waters by the
Division of Water Quality. The waters are designated as primary nursery area by the NC Division
of Marine Fisheries, but they are CLOSED to the taking of shellfish. The Wilmington-New
Hanover Land Use Plan classifies the wetland area of the project site as Conservation and those
areas above the 100 year flood elevation as Resource Protection.
The applicant proposes to construct a private road from Middle Sound Loop Road to provide
access into the 5.5 acre tract. The road easement would be approximately 300 feet long and 30
feet wide, terminating in a cul-de-sac, with a 60 feet radius.The applicant proposes an earthen
causeway to span the wetland drain. The earthen causeway would be 75 feet long, 30 feet wide
and averaging 3-4 feet in height. The paved road surface would be eighteen (18) feet wide, with
grassed road shoulders, three (3) feet wide. The applicant would taper the road shoulders to the
wetland surface with a rip rap (rock) embankment, three (3) feet wide and a 1:1 slope. There
would be two (2) concrete pipes (30" diameter) installed to convey water to the downstream side
of the causeway. An additional area of rocks, 10 feet long and 8 feet wide, would be placed on
the wetland surface at both ends of the two culverts, to help diffuse the water flow through the
pipes.The applicant is proposing a single-family residence and reserving the remainder of the
upland area for future development.
10. ANTICIPATED IlUPACTS
The project, as proposed, will incorporate 2410 square of wooded swamp wetlands. The proposed
earthen causeway will impede the wetland's function as a natural drain for the surrounding area,
promoting the potential for flooding and ponding on the upstream side of the filled roadway.
Ponding of waters would create stagnant pools and mosquito breeding habitat. An additional

14,000 square feet of highground area would be disturbed by the remainder of the road and cul-de-sac,
and house and driveway construction. Additional disturbance and impervious surfaces would be created
by future subdivision of the tract.
