Academy Street, Suite 200 Cary, NC 27513 Dear Mr. Spaulding: NC ENR NORTH CAROLINA DEPARTMENT OF ENVIRONMENT AND NATURAL RESOURCES April 5, 1999 You recently sent in a request for Neuse River Riparian Buffer Rule evaluation for a 12 acre tract on the west side of Ebeneezer Church Road adjacent to the Brownleigh Industrial Park. During a recent site visit I determined that there are two drainage features on the property to which the Neuse River Riparian Buffer Rule would apply. The first stream (stream A) forms in the large draw located in the center of the property as indicated on the topography plat that you sent in. The Neuse River Riparian Buffer Rule jurisdiction would begin at the eastern most (up stream) S & EC flagging. The second stream (stream B) to which the Neuse River Riparian Buffer Rule would apply is the tributary that comes in from the southern property line in the other draw shown on the plat. The jurisdictional point is indicated by orange flagging hung approximately 150 feet upstream from the confluence. The flagging at both jurisdictional points was signed DWQ NBR and the date. From these points downstream there is a 50 foot wide protected, riparian buffer as defined by 15A NCAC 213.0233. Both streams show up on the Wake County soil survey maps as tributaries to Pots Branch. There are also wetland areas along stream A at the headwaters, just above the confluence of the two tributaries, and near the pump station. There also appears to be some smaller areas of wetlands along headwaters of stream B. I would recommend that you have wetland areas on the tract delineated prior to designing development plans for the property.
