SUBJECT: 401 Water Quality Certification for Eric and Laura Panner
Shoreline stabilization, Lake Lure, Rutherford County

Dear Ms. Karoly:
Mr. Eric and Laura Panner requested a 401 Water Quality Certification from NCDENR, Division of
Water Quality to build a seawall on Lake Lure. Comments from Commission staff are provided under
provisions of the Clean Water Act of 1977 (33 U.S.C. 466 et seq.) and the Fish and Wildlife Coordination
Act (48 Stat. 401, as amended; 16 U.S.C. 661-667d).
We recommend that the applicants use rip rap to stabilize the shoreline because it is more durable and less
prone to wash-out than walls. Also, it provides habitat complexity for aquatic life. However, if the wall
is permitted, then, as proposed, a rip rap toe should be placed along the new wall to improve stability and
provide some shoreline habitat.
