Please find the attached revised Pre-construction Notification (PCN) and supporting documentation to apply
for a Nationwide Permit (NWP) No. 39 for Phase II of the Parkside Town Commons Development for the NC
55 Roadway Improvements in Cary, NC.
As you are aware, the Parkside Town Commons Development (Phase 1) has already been permitted with
NCDWQ (#EXP 07-1503) and USACE (#2005-21328 and 2007-04171). A 401 certification was issued on
April 30, 2009 and a 404 permit was issued on June 14, 2009 for Phase H. Changes to the crossings were
made based on NCDOT comments which resulted in an additional 11 feet of permanent perennial stream
impact. In the original application, one crossing (O'Kelly Stream Impact #1) had a permanent impact of 11
linear feet associated with a culvert extension. This impact has now been shortened to 8 linear feet. Another
crossing (O'Kelly Stream Impacts #2 & #3) had a temporary impact of 35 linear feet related to the installation
of a new inlet structure and endwall on either end of the existing pipe. The headwall was not approved by
NCDOT and a culvert extension of 14 feet (permanent impact) is now required at that location. Temporary
impacts are no longer present at Stream Impact Site #3. The total impacts onsite for Phase II are now 22
linear feet of perennial stream channel.
As requested by USACE, the impacts are being mitigated at a 2:1 ratio. The NC Ecosystem Enhancement
program has approved the project for mitigation credit purchase. The NCEEP approval is attached to this
letter.
The attachments contain the revised PCN form, revised roadway and impact area map for O'Kelly Chapel
Road, and the NCEEP approval acceptance letter. Please contact me if you have any questions.

3a. Describe the existing conditions on the site and the general land use in the vicinity of the project at the time of this
application:
The majority of project work will take place within the existing NCDOT right of way for NC 55 and O'Kelly Chapel Road.
The right of way consists of existing roadway and grassed shoulders. The surrounding area is undeveloped and forested.
A few residential and commercial properties are sparsely located near the corridor.
3b. List the total estimated acreage of all existing wetlands on the property:
0.04 acres of wetlands are located within the NCDOT right-of-way / project area near Kit Creek.
3c. List the total estimated linear feet of all existing streams (intermittent and perennial) on the property:
There are three perennial streams within the NCDOT right-of-way / project area totalling 123 linear feet.
3d. Explain the purpose of the proposed project:
The NC 55 roadway improvement project is being completed to improve safety for all travelers and reduce traffic
congestion through the corridor by adding turn lanes and improving intersections in the area of the proposed Parkside
Town Commons Development.
3e. Describe the overall project in detail, including the type of equipment to be used:
The mixed use Parkside Town Commons Development is proposed to be located in the NE quadrant of the NC540 and
NC55 interchange in Cary. The Parkside Town Commons Development has already been permitted with NCDWQ (#EXP
07-1503) and USACE (#2005-21328 and 2007-04171) and is considered Phase I of this project. Teer Associates was
listed with Kite Realty as co-applicants for Phase I; Teer Associates is no longer involved in the project. Phase II includes
the roadway improvements required to the surrounding infrastructure as a result of this development. NC55, O'Kelly
Chapel Road, Morrisville Carpenter Road, McKrimmon Parkway will all be widened to facilitate new turn lanes. The
railroad crossing on Carpenter Fire Station Road will be removed and a new crossing placed on O'Kelly Chapel Road.
Three existing stream crossings occur within the roadway project area. One crossing (O'Kelly Stream Impact #1) has a
permanent impact of 8 linear feet associated with a culvert extension. Another crossing (O'Kelly Stream Impact #2) has a
permanent impact of 14 linear feet also related to a culvert extension. (Stream Impact #3 has been removed and is no
longer shown on the impact maps). The third crossing (NC 55 Site #4) will involve the installation of a floodplain culvert to
be bored and jacked under NC55 parallel to the perennial stream. The stream will be protected in this area and no
impacts are expected to occur. Wetlands are located near Kit Creek (NC 55 Site #5) within the project area and are not
being impacted by this project. Typical roadway construction equipment will be used including backhoes, bulldozers,
pans, pavers, rollers, sheepsfoot, and dumptrucks. The floodplain culvert will be installed using jack and bore equipment.

USACE ID Number: 2005-21328 and 2007-04171. Approved on 12/27/2007 for fill of 61 If of intermittent UT to Kitt Creek
and 0.32 acres of adjacent open water man-made pond due to the extension of O'Kelly Chapel Road.
NCDWQ ID Number: EXP-07-1503. Approved on 9/17/07 for fill of 0.64 acres of isolated wetland, 0.32 acres of open
water, 127 If of isolated perennial stream, 1,035 If of isolated intermittent stream, and 56 If of intermittent stream for the
purpose of constructing a new mixed use development.
This permit application is a revision to an already approved permit/certification for Parkside Phase II. The headwall at
Impact #2 outlined in the original Phase II permit was not approved by NCDOT and additional impacts from the resulting
culvert extension are outlined in this permit application. The culvert extension at Impact #1 has also been reduced from
14 feet to 8 feet. Temporary impacts are no longer planned at Impact #3.
No stream or wetland mitigation was previously required for Phase I.

D. Impact Justification and Mitigation
1. Avoidance and Minimization
1 a. Specifically describe measures taken to avoid or minimize the proposed impacts in designing project.
This project is dependent on the location of existing roadway with little flexibility to completely avoid impacts. However,
multiple areas were redesigned to minimize impacts to streams and wetlands. Referring to the attached site plan, the impact
at site 1 was shortened by 3 feet, the temporary impact at site 3 has been removed, site 4 includes a floodplain culvert for high
stormwater flows; the floodplain culvert will be installed in such a way as to avoid impacts to the perennial stream that flows
under NC 55. The stormwater outfall drainage ditch at Site 5 was shortened to avoid impacts to jurisdictional wetlands near Kit
Creek on the east side of NC55. As a result of these redesigns, only 22 feet of unavoidable impact to perennial streams at Site
1 and 2 remains.

Typical sediment and erosion control measures will be taken onsite. Silt fences and temporary sediment basins will be utilized
to prevent sediment from entering streams and wetlands. Silt fencing and other protective fencing will be used at the bore and
jack site at Site 4 to protect that perennial stream from disturbance due to construction equipment.

The purpose of this letter is to notify you that the North Carolina Ecosystem Enhancement Program (NCEEP) is willing to accept
payment for impacts associated with the above referenced project. Please note that this decision does not assure that the payment will
be approved by the permit issuing agencies as mitigation for project impacts. It is the responsibility of the applicant to contact these
agencies to determine if payment to the NCEEP will be approved. You must also comply with all other state, federal or local
government permits, regulations or authorizations associated with the proposed activity including SL 2009-337• An Act to Promote
Compensatory Mitigation by Private Mitigation Banks
This acceptance is valid for nine months from the date of this letter and is not transferable. If we have not received a copy of the
issued 404 Permit/401 Certification/CAMA permit within this time frame, this acceptance will expire. It is the applicant's
responsibility to send copies of the permits to NCEEP. Once NCEEP receives a copy of the permit(s) an invoice will be issued based
on the required mitigation in that permit and payment must be made prior to conducting the authorized work. The amount of the In
Lieu Fee to be paid to NCEEP by an applicant is calculated based upon the Fee Schedule and policies listed at www.nceep.net.
Based on the information supplied by you the impacts that may require compensatory mitigation are summarized in the following
table.

Upon receipt of payment, EEP will take responsibility for providing the compensatory mitigation. If the regulatory agencies require
mitigation credits greater than indicated above, and the applicant wants NCEEP to be responsible for the additional mitigation, the
applicant will need to submit a mitigation request to NCEEP for approval prior to permit issuance. The mitigation will be performed
in accordance with the Memorandum of Understanding between the N.C. Department of Environment and Natural Resources and the
U.S. Army Corps of Engineers dated November 4, 1998.
