Please reference our August 5, 2009 letter regarding the mitigation non-compliance of our
May 30, 2008 verification of Nationwide Permit No. 39 for your 20-acre development, known as
Coastal Commercial Complex, a commercial/light industrial park located approximately 0.5
miles north of NC 58 and Peletier Loop Road (SR 1109) intersection, adjacent to Starkey Creek,
in Peletier Community, Carteret County, North Carolina.
As requested in our letter, a recorded copy of the restrictive covenants has been provided to
our office via e-mail dated October 12, 2009. Upon review of the covenants, our office has
determined that your authorization is in compliance with Special Conditions (1) and (2)
concerning the remaining 4.68 acres of jurisdictional areas within the development. Therefore,
no further enforcement action will be taken by our office.
Please be reminded that all permit conditions remain valid and must be adhered to. If you
have any questions or comments in this or any other matter with the development, please do not
