APPROVAL of 401 Water Quality Certification and ADDITIONAL CONDITIONS and Neuse River Buffer Rules

Dear Mr. Lancaster:
You have our approval, in accordance with the attached conditions and those listed below, to place fill material in an
additional 0.85 acres of wetlands or waters (total fill of 1.76 acres) for the purpose of constructing roads, utilities and lot fill at
Neuse Crossing Subdivision, as you described in your revised application dated March 10, 1999. After reviewing your
application, we have decided that this fill is covered by General Water Quality Certification Numbers 3101 and 3108. These
certifications allow you to use Nationwide Permit Numbers 12 and 26 when the Corps of Engineers issues them. This approval is
also valid for the Neuse River buffer rules (15A NCAC 2B .033). In addition, you should get any other federal, state or local
permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater,
Non-Discharge and Water Supply Watershed regulations. This approval will expire when the accompanying 404 or CAMA
permit expires unless otherwise specified in the General Certification.
This approval is only valid for the purpose and design that you described in your application except as modified below. If
you change your project, you must notify us and you may be required to send us a new application.. If the property is sold, the
new owner must be given a copy of this Certification and approval letter and is thereby responsible for complying with all
conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required
as described in 15A NCAC 2H .0506 (h) (6) and (7). For this approval to be valid, you must follow the conditions listed in the
attached certification and any additional conditions listed below.
1. Deed notifications or similar mechanisms shall be placed on all lots with remaining jurisdictional wetlands and waters or areas within
50 feet of all streams and ponds to notify the state in order to assure compliance for future wetland and/or water impact. These
mechanisms shall be put in place within 30 days of the date of this letter or the issuance of the 404 Permit (whichever is later).
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act
within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition, which conforms to Chapter
150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-
7447. This certification and its conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. If you have

Grossing Subdivision project owned by ferry Creek, LLC (attu: Mr_ John Lancaster)(= attached
ccrtWCation). The appmved certiftcation evolved Prom rmsions to the Pre-Construction Notification
Application dated 1/14199 as described with the project engineer's (McKim & Creed) letter and revised
site plans dated 3/10/99. These revisions were made in response to concerns described within your
response letter dated 2/22199 (see attached response letter).
Thank you for Your quick response to my client's letter and revised plans. 1lnfortunatoly, it appears that
changes to the 3/17/99 certification will need to be made. The certification states that, "You have our
approval ... to place fill material in an additional 0.85 acres of wetlands or waters (total fill of 1.76 acres)
... as described within your revised application dated March 10, °' The revised application and site
plans proposed total impacts (NW 12 & 26) for the subdivision to be 0.8519 acres. This is a reduction in
wetland impacts of 0.0498 acres vom the originally requested 0.9017 acres. Total impacts (previously
requested and proposed) for the proparty equal 1.0019 acres (0.2623 acres (W1112) and 0.7396 acres (NW
26)].
Therdore, we believe that the Certification should state, "You have our approval to place fill material
in an additional 0.8519 acres of wetlands and waters (total fill of 10019 acres) . __ as described within
your revised application dated March 10, 1999." We apologize for any confusion that may have oecumed
within the application submittal and request that you have the changes described above made to the
3/17199 certification.

The Division of Water Quality has reviewed your plans for the discharge of fill. rnaterial into an
additional 0.9017 acrt of wetlands located at the Park at Perry Creek in Wake County for residential
development. nsu tctent evidence is present in our files to conclude that your project must be built as
planned in waters and/or wetlands in accordance with 15A NCAC. 2H.050(5. Therefore, unless
modifications of the proposal are made as described below, we wilt have to move toward deni4l of your.401
Certification as required by 15A NCAC 2H .0507(e) and will place this project on hold as incomplete until-
we receive this additional information, we are requesting (by copy of this letter) that the U.S. Army Corps
of Engineers place your project on administrative hold.
Please provide us with information supporting your position that states your project must be
constructed as planned and that you have no practicable alternative to placing fill in these waters and/or
wetlands. Specifically can you construct your road crossing on the top of the proposed dam to minimize
wetland fill? Any documentation such as maps and narrative that you can supply to address alternative
designs for your project may be helpful in our review of your 401 Certification.
Please respond within three weeks of the date of this letter by sending a copy of this information to
me and one copy to Mr. Danny Smith Raleigh Regional Office at 3800 Barrett Drive Raleigh KC 27609. If
we do not hear from you in three weeks, we will assume that you no longer want to pursue this project and

The Park at Perry Creek
Dear Mr. Domey:
We are writing on behalf of the developer John Lancaster of Perry Creek, LLC regarding your letter
of February 22, 1999 for the proposed wetland impacts at the Park at Perry Creek.
After reviewing the submitted wetlands impact map, we have determined that we can relocate the
proposed wetlands crossing in the eastern parcel below the dam reducing the impact from 8200 +/-
SF to approx. 4012 +/- SF. This will be accomplished by reconfiguring the proposed lot layout of
Phase 2 of the project and using the minimum centerline roadway radius curvature of 275'.
It is economically unfeasible and more detrimental to the existing wetlands to relocate the proposed
roadway on the eastern parcel on the proposed dam for the following reasons:
1) The top of the existing dam is approx. 10' wide. The minimum width of a residential street in
Raleigh is 31' B-B of curb for a 50' ROW. The ROW will need to be graded relatively flat
requiring much more fill in the existing wetlands to the east and west of the centerline of the
proposed road over the dam. The fill slopes to the west will extend beyond the ROW into
the proposed pond reducing its' design capacity. In addition, the dam will require complete
removal and need to be structurally rebuilt outside of the existing footprint of the dam to
support the road.
2) We have looked at alternative road alignments through Phase 2 to reach the eastern
townhome tract and once we eliminated the feasibility of going over the dam, the only other
choice was to cross the wetlands at the shortest distance just east of the 8200 SF proposed
impact. The problem with this location is that we would create a long stretch of roadway
(approx. 500'-600') without lots on either side of the road. Without lots adjacent to the
roadway to help pay for the costs of road construction, this layout becomes economically
unfeasible for the Developer.
3) The proposed wetland impact of 4,012.46 SF for the new crossing location reduces the.
previous impact in this area by over 50%. This crossing will require the Developer to install
approximately 75' of roadway with no lots adjacent to the road.
In summary, we believe that this proposed rossing which is similar to the initial 8200 SF
crossing area is the fairest location for all pa ved. This proposed impact reduces the initial
wetland disturbance in this area by over 50° quire the Developer to build at least 75 feet

The Division of Water Quality has reviewed your plans for the discharge of fill material into an
additional 0.9017 acres of wetlands located at the Park at Perry Creek in Wake County for residential
development. Insufficient evidence is present in our files to conclude that your project must be built as
planned in waters and/or wetlands in accordance with 15A NCAC 2H .0506. Therefore, unless
modifications of the proposal are made as described below, we will have to move toward denial of your 401
Certification as required by 15A NCAC 2H.0507(e) and will place this project on hold as incomplete until
we receive this additional information, we are requesting (by copy of this letter) that the U.S. Army Corps
of Engineers place your project on administrative hold.
Please provide us with information supporting your position that states your project must be
constructed as planned and that you have no practicable alternative to placing fill in these waters and/or
wetlands. Specifically can you construct your road crossing on the top of the proposed dam to minimize
wetland fill? Any documentation such as maps and narrative that you can supply to address alternative
designs for your project may be helpful in our review of your 401 Certification.
Please respond within three weeks of the date of this letter by sending a copy of this information to
me and one copy to Mr. Danny Smith Raleigh Regional Office at 3800 Barrett Drive Raleigh NC 27609. If
we do not hear from you in three weeks, we will assume that you no longer want to pursue this project and

The purpose of this letter is to request the use Nationwide Permits #12 & 26 for ercorq ie
osed Neuse Crossing Subdivision (within "The Park at Perry Creek" ately

3000 feet east of the intersection of US Highway 1 and Perry Creek Road (NCSR 2006) and south of
Thornton Rd. (NCSR 2043) (see attached USGS site vicinity map). New proposed impacts to wetlands for
the construction of the residential subdivision will total 0."17 acres [0.6857 (NW26) & 0.2160 (NW12)J.
Total impacts (previously requested and proposed) for the complex equal 0.2623 (NW12) & 0.83
(NW26). However, S&EC, Inc. believes that no mitigation will be required for this project. he total
impacts under Nationwide Permit 26 equal 0.8357 acres. The total impacts for Nationwide Permit 12 RAI
equal 0.2623 acres. All of this 0.2623 acres will be restored, but a 10-foot corridor as described in the
General Conditions of Nationwide Permit 12 will be maintained. If for some reason wetland mitigation is
required, our client proposes payment into the North Carolina Wetland Restoration Fund.
Construction of the subdivision will comply with the general conditions stated within Nationwide Permits
#12&26. No surface waters subject to the Neuse River Buffer rules (15A NCAC 2B.0233) were found to
exist within the new proposed impact areas as determined by NC Division of Water Quality (DWQ)
personnel. The project will comply with the Neuse River Buffer rules.
Included are: (1) a completed Pre-Construction Notification Application, (2) Agent Authorization Form,
(3) USGS Site Vicinity Map, (3) Construction Plans, (4) Wetland Delineation Forms and a check for
$475.00 to cover the pennit application fee.

constructing a residential subdivision. Nationwide Permit 12 will be used for the
installation of a sanitary sewer line and stormwater control piping, and Nationwide
Permit 26 will be used for lot fill, road construction and wetland excavation for the
purpose of installing stormwater control devices.
