Good Morning,
We are in the process of reviewing the subject buffer authorization and require additional information to continue
drafting the approval.
• The buffer impacts requested in this application need to be clearly shown and enumerated on the site
plan. These impacts need to correspond to the impacts requested in the application. As the application and
impact map currently stands, it is not possible to match up what is listed the application with the site
plan. Please correct/modify the impact map and table in your response to this letter and e-mail to Erin Deck at
erin.deck@ncdenr.gov. [15A NCAC 02H .0502(g)]
• Please provide more details regarding the greenway trail bridge/stream crossings for this project. The stream
and riparian buffer impacts requested in this application need to be clearly shown and enumerated on the site
plan. These impacts need to correspond to the impacts requested in the application. The labels on the site plan
must match the impacts listed in the application. [15A NCAC 02H .0502 (g)].
The project will be placed on HOLD until the additional information has been received. If all of the requested
information is not received within 30 calendar days of receipt of this letter, the Division will be unable to approve the
application and it will be returned. The return of this project will necessitate reapplication of the Division for approval,
including a complete application package and the appropriate fee.
Please be aware that you have no authorization under the Neuse Riparian Buffer Rules for this activity. Thank you.

That is correct. If there is complete avoidance of waters, including the use of bridges over the
stream channels, a Section 404 Department of the Army permit is NOT required for the
project, and I will not be issuing a JD unless you request that document.

Thanks Sam, I thought you might do a desk top on this one. To be sure I understand, they are
OK to move forward with design and ultimately construction with the plan I submitted that
avoids all wetland impacts but will have 2 bridge crossings of streams (no impacts to

jurisdictional waters)? They do not need to wait for your PJD? We will have to apply for buffer
impacts for the bridges with DWR.

I have reviewed your JD submittal for The Bluffs Greenway. The Corps Action ID for the project
is: SAW-2019-01802. Please reference this action ID on all future correspondence. Further, this
office concurs with your September 18th JD submitta l. The Wetland Delineation Map (Sheets
1-4) dated Sept. 2019 accurately depicts waters of the U.S. within your project boundary. This
map may be used for planning and design purposes to help assist in avoidance and
minimization, but should not be used in-lieu of a jurisdictional determination or permit.
