REGAN Secretory LINDA CULPEPPER Director James Stanfill Division of Mitigation Services 1672 Mail Service Center Raleigh, NC 27699-1652 (via email: jim.stanfill(cDncdenr.gov ) NORTH CAROLINA Environmental Quality December 5, 2019 Re: DWR Response to DMS proposal for out-of-HUC buffer mitigation Dear Mr. Stanfill: On November 1, 2019, the Division of Water Resources (DWR) received a formal written request from you on behalf of the Division of Mitigation Services (DMS) for authorization to meet permitted buffer mitigation requirements utilizing buffer mitigation outside of the projects' 8-digit Hydrologic Unit Codes (HUC) in the Tar -Pamlico River Basin. As provided for under 15A NCAC 02B .0295 (0, applicants or mitigation providers can meet permitted buffer mitigation requirements outside of the project's 8-digit HUC by applying a locational ratio. The proposal received from DMS requests to satisfy partially unmet or fully unmet permitted buffer mitigation required by the permits listed in the table below by utilizing approved mitigation credits anywhere within the Tar -Pamlico River Basin.
