SECRETARY Dear Mr. Martin: a January 6, 1999 Neuse River Basin Riparian Buffer Rules Wm. G. Daniels/Falls River Project NBR-RRO 168 Wake County On October 13,1998, I met with you at the subject property to conduct a site visit for the above referenced project. This project is referenced by the Raleigh Regional Office as NBR RRO-168. At your request, an evaluation was performed to determine if the features present would require compliance with the Neuse River Basin: Nutrient Sensitive Waters Management Strategy; Protection and Maintenance of Existing Riparian Areas, Administrative Code T15A:02B.0233 (NCAC 0233). It was determined that there are several unnamed tributaries on the subject property that are subject to protection under the Neuse Basin Rules. In addition there are a few features along the river that are ephemeral (stormwater derived) and therefore not subject to the Neuse Buffer Rules. The buffer has been delineated on the map indicating the protected area along those features. The features that have been delineated as subject to the buffer protection are outlined in red and highlighted in yellow. Those features not subject to the Rule, are highlighted in blue. Please be reminded that the Neuse River itself has a 50 foot horizontal buffer extending landward of Mean High Water. Included is the final map generated by Soil & Environmental Consultants, Inc. indicating the extent of regulation by NRB.NSW riparian buffers for the Falls River project.
