On February 3, 1999, 1 Met with you to conduct a site visit of the property involved in the above
referenced project. It was determined as a result of the site visit that the water body present on this
tj property is an ephemeral/stormwater feature and therefore not subject to the Neuse River Basin:
r Nutrient Sensitive Waters Management Strategy; Protection and Maintenance of Existing Riparian
` i :Areas, Administrative Code T15A:02B.0233 (NCAC 0233) .
The map received by this Office indicates that the stormwater channel will be protected with a twenty
t " foot drainage easement. This exceeds the requirements of the Neuse Buffer Rules in that this feature
ti is not subject to protection. Accordingly, this Office would request that sheet flow from stormwater
be maintained, to the maximum extent practical, through dispersing concentrated flow to maintain the
efficacy of the buffered easement.
