I see what you are referring to. It appears we didn’t catch the grading and erosion control discrepancy on the plans
before sending them to you. My apologies.
Attached are updated Grading, ESC and SCM Details sheets showing a 6’retaining wall that will limit the stream impact
to 119LF, allowing an additional foot for construction activities if needed.
We proposed the retaining wall because the steep grades forced us to play catch up with the existing grade and
increased the stream impact to an unnecessary length. Unfortunately, though, we failed to update the plans before
sending them to you.
As I would like to get this project wrapped up before you get transferred, please let me know if this is sufficient or it you
require any additional information from us. Phone calls are always welcome.

Thanks for the information.
However, the “Wetland Impact Map” does not match what is shown on the most recent plans as described in my email
below. The “Wetland Impact Map” proposes to impact only 120 linear feet of stream; whereas, the impacts on the
“Overall Erosion Control Plan” (sheet C4.07) measure to be approximately 145 linear feet of stream impact as measured
from the headcut to the end of the proposed riprap dissipator pad (see attached file with my notes and the Wetland
Impact Map for comparison).
Do the most recent plans accurately show the proposed project? If so, please revise the “Wetland Impact Map” to
reflect the changes. If not, please provide accurate plans that match the “Wetland Impact Map.” I need to have an
accurate accounting for what is being proposed by the project.
Feel free to give me a call to discuss as it may be easier to ensure we are on the same page.
Also, note that next Friday is my last day in the Raleigh Regulatory Field Office as I am moving to another Corps office.
Therefore, I have included Andy Williams (email: Andrew.E.Williams2@usace.army.mil) in the email as he will be helping

The engineer’s response to item 1 does not appear to be complete as the last sentence is left unfinished. Can you
provide the complete response?
Also, the plans (Sheets C4.07, C5.01, and C5.04) submitted in your response appear to show more impacts to the stream
below the stormwater pond than the “Wetland Impact Map” submitted with the PCN application submitted to the Corps
on 9/26/2019. If this is a change, please revise the “Wetland Impact Map” to show the actual amount of impacts
proposed by the project.

Hey Wyatt,
Thank you for the Pre-Construction Notification (PCN) and attached information, dated and
received 9/26/2019, for the above referenced project. I have reviewed the information and need
clarification before proceeding with verifying the use of Nationwide Permit (NWP) 29. Please
submit the requested information below (via e-mail is fine) within 30 days of receipt of this
Notification, otherwise we may deny verification of the use of the NWP or consider your
application withdrawn and close the file:
1. As indicated by the Corps during the 6/26/2019 site visit, the NWP 29 2017 Regional
Condition 4.1.1 prohibits "\[d\]ischarges in perennial streams, intermittent streams and wetlands
for stormwater management facilities." However, with sufficient justification it may be possible
to permit impacts to streams/wetlands for stormwater management facilities under a NWP 18 for
Minor Discharges. Please provide a more detailed explanation for how the proposed stormwater
wetland design has avoided and minimized impacts to waters to the maximum extent practicable.
This should include an explanation for the size and location of the proposed SCM and why
stormwater could not be treated at other locations within the project area. Note that the Corps
discourages the use of existing creeks, streams, lakes and wetlands to remove pollutants from
storm water runoff (in-stream treatment). Please review the attached EPA Region 4 guidance on
the subject of in-stream treatment.
This site is an urban infill project and has many challenges that complicate the site design. It is
nestled between three roads (northeast to southwest) and a perennial stream that almost
completely divides the northern portion of the property. The existing topography offered another
set of challenges. The overall site layout is designed such that perennial stream impacts are
avoided, and intermittent stream impacts are minimized to the maximum extent practical. The
street network and associated utilities systems are designed to avoid perennial stream and
intermittent stream impacts. However, there are proposed impacts to the intermittent stream on
the eastern portion of the site. This proposed intermittent stream impact is for a portion of the
embankment of the proposed wet pond (mislabeled as stormwater wetlands on original
submittal) with a greenway trail along the dam. (Please note: No existing creeks, stream, lakes
or wetlands will be used to remove pollutants form stormwater runoff.) We considered other
locations for stormwater control measures; however, topographic constraints as well as existing
adjacent development patterns made alternative locations impractical. The proposed wet pond is
located at the most practical low point on the site and is sized to meet the Town of Clayton,
Johnston County and North Carolina stormwater quantity and quality requirements. The wet
pond is designed to follow existing contours as much as possible, curving to minimize
intermittent stream impacts to the maximum extent practical. The proposed 120lf impact is
mainly from the inside top of dam to existing condition tie-in points of the slope, outside the
pond. Alternative designs were considered but required extensive retaining walls reaching
heights up to 20’ near the property line adjacent to the existing Cooper Academy school site
rendering those designs unsafe and not practical. It should also be noted that the majority of the
drainage area currently feeding this intermittent stream is the aforementioned adjacent Cooper
Academy elementary school site. The contributing portion of the school site is more than 50%
impervious. Currently the runoff from this portion of the school site enters the stream via
overland flow without receiving any stormwater treatment (quantity nor quality). The proposed
wet pond design will allow this runoff to be captured and treated (quantity and quality) before

being released back into the intermittent stream, providing opportunity for debris, suspended
solids, nutrients, etc. to be captured and filtered out. The wet pond will also reduce the existing
peak flow for the 1yr, 2yr, 5yr and 10yr storm events. Given all the above information it is our
opinion that the proposed

construction drawings, proposed final conditions, details on outlet structure/pipe (length,
dimensions, material), etc. Additionally, will there be any outlet protection proposed for the
stormwater wetland's outlet? If not, how do you propose to minimize downstream impacts to
aquatic resources during large storm events?
Please see attached sheet C5.04 for SCM details as well as the pond routing calculations
provided. As can be seen from the routing calculations, even the 100-year storm is
expected to leave the proposed wet pond via the outlet structure, which discharges into an
appropriately sized riprap pad to allow the water energy to dissipate before entering the
stream. Also, since the proposed pond treats water that is currently entering the stream
untreated (above mentioned runoff from Cooper Academy and neighboring impervious
areas) the treatment of this water should improve the aquatic resources compared to
existing conditions.
3. Provide plans to show how the proposed lots will be serviced by utilities (sanitary/sewer,
septic, water, gas, electric, etc.). Will any of the necessary utilities impact any potential
jurisdictional waters?
There are no additional impacts necessary/proposed to provide utility service for all lots in the
project. Please see attached sheets C3.01 for an overall utility layout.
4. Provide grading and erosion control plans for the total project.
Please see attached sheets C4.07 and 5.01 for Erosion Control and Grading plans.
