Dear Mr. and Ms. Owens:
You have our approval, in accordance with the attached conditions, to place fill material in 400 square feet of or
waters for the purpose of installing riprap along a shoreline at your home 400 square feet of, as you described in your
application dated 20 January 1999. After reviewing your application, we have decided that this fill is covered by General
Water Quality Certification Number 3112. In addition, you should get any other federal, state or local permits before you
go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non-
Discharge and Water Supply Watershed regulations. Also this approval will expire when the accompanying 404 or
CAMA permit expires unless otherwise specified in the General Certification.
This approval is only valid for the purpose and design that you described in your application. If you change your
project, you must notify us and send us a new application. If the property is sold, the new owner must be given a copy of
this Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for
this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC
2H .0506 (h). For this approval to be valid, you must follow the conditions listed in the attached certification. This
approval shall expire when the corresponding Nationwide Permit expires or as otherwise provided in the General
Certification.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must
act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to
Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh,
N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. If you

their property on West Shore Drive, waterward of Coastal Wetlands. The riprap alignment proposed
will be approximately 80' long and five feet wide.

PROJECT. LOCATION
The applicant's property is located along the East side of Roanoke Sound on Pond Island,
Nags Head, Dare County. The property is bisected by West Shore Road and is developed for
residential use only. Located on the east side of the road are a residence, septic system, and a
bulkhead bordering a man-made canal. On the west side of West Shore. Road is a small 25' to
35' deep strip of Coastal Wetlands (approx. 80 linear feet wide) waterward of a wooden
bulkhead. A six foot wide elevated walkway/pier is constructed over the wetlands.
Vegetation found in the wetland fringe includes cattail (Typha latifolia), common reed
(Phragmites australis), salt meadow cordgrass (Spartina patens), and smooth cordgrass
(Spartina alterniflora). Erosion along the property is evident and ongoing, forming an abrupt
erosion scarp on the waterward edge of the wetland mat. Depths along the waterward edge of
the escarpment average 1'-0" at normal water level.
Roanoke Sound is classified as coastal waters by agreement between the Marine Fisheries
Commission and Wildlife Resource Commission. The Division of Environmental
Management's water quality classification for Roanoke Sound is SA (Shellfishing), and is
closed.
No submerged aquatic vegetation was found within the proposed riprap alignment.
PROJECT DESCRIPTION
The applicant would like to place concrete riprap waterward of the coastal wetland fringe
along, the west side of his property for shoreline protection. While the property is only 65'
wide, the alignment will be approximately 80 linear feet (see attached' site plan) with -a five-
foot base. The total area of shallow water 'bottom to be filled is approximately 400 square
feet. The riprap will extend one foot above normal water level and will be placed against the
erosion scarp.
ANTICIPATED IldPACTS
1) Temporary localized turbidity in the project area during placement of the riprap
material.
2) Stabilization of an eroding coastal wetland shoreline.
3) Continued water exchange into adjacent coastal° wetlands landward of the proposed
alignment.
4) Increased shellfish habitat created by riprap material.
5) Loss of 400 square feet of shallow water bottom.

their property on West Shore Drive, waterward of Coastal Wetlands. The riprap alignment proposed
will be approximately 80' long and five feet wide.

PROJECT LOCATION
The applicant's property is located along the East side of Roanoke Sound on Pond Island,
Nags Head, Dare County. The property is bisected by West Shore Road and is developed for
residential use only. Located on the east side of the road are a residence, septic system, and a
bulkhead bordering a man-made canal. On the west side of West. Shore Road is a small 25' to
35' deep strip of Coastal Wetlands (approx. 80 linear feet wide) waterward of a wooden
bulkhead. A six foot wide elevated walkway/pier is constructed over the wetlands.
Vegetation found in the wetland fringe includes cattail (Typha latifolia), common reed
(Phragmites australis), salt meadow cordgrass (Spartina patens), and smooth cordgrass
(Spartina alterniflora). Erosion along the' property is evident and ongoing, forming an abrupt
erosion scarp on the waterward edge of the wetland mat. Depths along the waterward edge of
the escarpment average 1'-0" at normal water level.
Roanok6" Sound is classified as coastal waters by agreement between the Marine Fisheries
Commission and Wildlife Resource Commission. The Division of Environmental
Management's water quality classification for Roanoke Sound is SA (Shellfishing), and is
closed.
No submerged aquatic vegetation was found within the proposed riprap alignment.
PROJECT DESCRIPTION
The applicant would like to place concrete riprap water-ward of the coastal wetland fringe
along the west side of his property for shoreline protection. While the property is only 65'
wide, the alignment will be approximately 80 linear feet (see attached site plan) with a five-
foot base. The total area of shallow water bottom to be filled is approximately 400 square
feet. The riprap will extend one foot above normal water level and will be placed against the
erosion scarp.
ANTICIPATED EUPACTS
1) Temporary localized turbidity in the project area during placement of the riprap
material.
2) ' Stabilization of an eroding coastal wetland shoreline.
3) Continued water exchange into adjacent coastal wetlands landward of the proposed
alignment.
4) Increased shellfish habitat created by riprap material.
5) Loss of 400 square feet of shallow water bottom.
