Dear Mr. and Mrs. Ward:
On December 2, 2019, the Washington Regional Office received your request for
a variance to Rule 15A NCAC 2C .0222(e)(5)(A). This rule requires geothermal loops
to be located at least fifteen (15) feet from a building perimeter. The variance request is
for the construction of six (6) closed-loop geothermal injection wells on property owned
by you, Dewey and Angela Ward, at 101 East Sandcastle Court in Nags Head, Dare
County, North Carolina (Pin No. 080006490913).
In your request, you indicate that the six (6) closed-loop geothermal injection
wells should be constructed at less than fifteen (15) feet from the onsite building
perimeters due to the features and limited size of the property. You also stated that the
wells will be grouted their entire depth. Based upon the information that you have
submitted, a variance to the above cited rules is granted. The variance will be effective
from the date issued until December 4, 2020.
It is my finding that the factors specified above are sufficient to satisfy the
conditions for approval of a variance as defined in 15A NCAC 2C.0241. A copy of this
variance should be attached to the required Well Construction Records (GW-1).

The granting of this variance is for the location of the well(s) only, and in no way
relieves the owner or agent from other requirements of the North Carolina Well
Construction Standards, or any other applicable law, rule or regulation that may be
regulated by other agencies. If you are dissatisfied with this decision, you may
commence a contested case by filing a petition under G.S. 150-23 within sixty (60) days
after receipt of the decision.

NORTH CAROLINA DEPARTMENT OF ENVIRONMENAL QUALITY DIVISION OF WATER RESOURCES – WATER QUALITY REGIONAL OPERATIONS SECTION PERMIT FOR THE CONSTRUCTION OF A WELL OR WELL SYSTEM
In accordance with the provisions of Article 7, Chapter 87, North Carolina General
Statutes, and other applicable Laws, Rules and Regulations:
PERMISSION IS HEREBY GRANTED TO
Dewey and Angela Ward
FOR THE CONSTRUCTION OF six (6) closed-loop geothermal injection wells owned by
Dewey and Angela Ward at 101 East Sandcastle Court in Nags Head, Dare County, North
Carolina (Pin No. 080006490913). This Permit is issued in accordance with the application
received on December 2, 2019, in conformity with specifications and supporting data, all of
which are filed with the Department of Environmental Quality and are considered integral parts
of this Permit.
This Permit is for well construction only and does not waive any provision or requirement
or any other applicable law or regulation.
Construction of any well under this Permit shall be in strict compliance with the North
Carolina Well Construction Regulations and Standards (15A NCAC 02C .0100), and other
State and Local Laws and regulations pertaining to water supply well construction.
If any requirements or limitations specified in this Permit are unacceptable, you have a
right to an adjudicatory hearing upon written request within 30 days of receipt of this Permit.
The request must be in the form of a written petition conforming to Chapter 150B of the North
Carolina General Statutes and filed with the Office of Administrative Hearings, 6714 Mail
Service Center, Raleigh, North Carolina 27699-6714. Unless such a demand is made, this
Permit is final and binding.
This Permit will be effective for one year from the date of its issuance and shall be subject
to other specified conditions, limitations, or exceptions as follows:

1. The closed-loop geothermal injection wells shall be grouted completely for the entire
length of each borehole.
2. . All identification (including Permit Number and well identification) and completion
requirements of the well standards shall apply.
3. Well construction records (GW-1) for each well shall be submitted to the Division of
Water Resources’ Information Processing Unit within 30 days of the well completion.
4. Any well, the use of which has been discontinued, shall be properly abandoned in
accordance with 15A NCAC 02C .0240 and a well abandonment record (GW-30) shall
be submitted to the Division of Water Resources’ Information Processing Unit within
30 days of the well abandonment.
