Riparian Rules
I met with you at a proposed development along Hwy 70 near the junction of Ebenezer
Church Road. At your request, an evaluation was performed to determine whether two
(2) features as indicated by a blue high lighter on the attached map would require
compliance with the Neuse River Buffer requirements. (Please note: these are the only
features that I reviewed). Feature # 1 as indicated on the attached map is a stream and is
subject to the Riparian Buffer Rule. Feature # 2 as indicated on the attached map is not
a stream and is not subject to the Neuse Buffer Rule.
Also, the attached map indicates a proposed road pathway crossing the subject stream.
The intent of this correspondence is not to provide Regional concurrence with the
placement of the proposed road crossing foot print, only what is subject to the Nesue
Riparian Buffer Rule.
In addition, in accordance with the rule, concentrated runoff from new ditches or
manmade conveyances must be dispersed into sheet flow before the runoff enters Zone
2 of the riparian area.
