Mundorff Shell Services Intl. P.O. Box 4855 Houston, TX 77210 Dear Mr. Mundorff: You have our approval, in accordance with the attached conditions and those listed below, to place fill material in an additional 0.055 acres of wetlands or waters for the purpose of constructing a commercial development at Westpark site as you described in your application dated 22 Dec. 1999. After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 3108. This certification allows you to use Nationwide Permit Number 26 when the Corps of Engineers issues it. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply Water shed regulations. This approval will expire when the accompanying 404 or CAMA permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose.and design that you described in your application except as modified below. If you change your project, you must notify us and you may be required to send us a new application.. If the property is sold, the new owner must be given a copy of this Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h) (6) and (7). For this approval to be valid, you must follow the conditions listed in the attached certification and any additional conditions listed below. 1. Deed notifications or similar mechanisms shall be placed on all lots with remaining jurisdictional wetlands and waters to notify the state in order to assure compliance for future wetland and/or water impact. These mechanisms shall be put in place within 30 days of the date of this letter or the issuance of the 404 Permit (whichever is later). 2.An additional condition is that a final, written stormwater plan including a wet detention basin must be approved by DWQ before wetland (or stream) impacts occur. Also, before any building is occupied at the subject site the stormwater treatment facilities shall be constructed and operational and the stormwater management plan be implemented. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition, which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611- 7447. This certification and its conditions are final and binding unless you ask for a hearing. This letter completes the review of-the Division of Water Quality under Section 401 of the Clean Water Act. If you have any questions, please telephone John Domey at 919-733-1786. That is, this feature would not require STREAM mitigation as per DWQ current policy. There are two issues remaining: 1) Mitigation is NOT requried....... reason: Additional WETLAND impacts would require mitigation. However, due to age of the 404 and the 401 certification it is my understanding that only the new impact acreage would require mitigation. Having said that, the NEW proposed impacts is to a stream (not wetlands). Therefore no mitigation would be required (unless we count non-significant streams as area for the purposes of mitigation ...... I am almost positive this is not DWQ's current policy). 2)Stormwater should be required.... reason: Because of the past impacts and most notably the current proposed impacts a storm water management plan should be required. I recommend requiring the applicant to detail the plans that meet the 85% TSS reduction criterion prior to receipt of the 401 Certification. d f?? One Shell Plaza PO Box 4855 Suite 725 Houston, TX 77210 Dear Mr. Mundorff: The Division of Water Quality has reviewed your plans for the discharge of fill material into an additional 0.055 acres of streams and/or wetlands located at Westpark Commercial site, Cary in Wake County for commercial development. Based on this review, we have identified significant uses, which would be removed or degraded by this project. Insufficient evidence is present is present in our files to allow us to determine where the previous fill occurred and whether 401 Certification was issued for this fill. Therefore your project is incomplete. Therefore, unless we receive this information, we will have to move toward denial of your 401 Certification as required by 15A NCAC 2H .0507(e) and will place this project on hold as incomplete until we receive this additional information, we are requesting (by copy of this letter) that the U.S. Army Corps of Engineers place your project on administrative hold. Please provide us with information regarding the design and location and dimensions of the downstream pond referred to in the application. Also this project will require compensatory mitigation as described in 15A NCAC 2H.0506(h). Please respond with three weeks of the date of this letter by sending a copy of this information to me and one copy to Mr. Danny Smith Raleigh Regional Office at 3800 Barrett Drive Raleigh NC 27609. If we do not hear from you in three weeks, we will assume that you no longer want to pursue this project and we will consider the project as withdrawn. Dear Mr. Dorney and Mr. Tugwell: The purpose of this letter is to request the authorization of Nationwide Permit 26 for 0.055 acres. The project is located in Wake County in the southeast quadrant of Highway 55 and Highhouse Road, near Cary, NC (see Site Vicinity Map). All impacts will result from the fill of jurisdictional waters for parking, roads and buildings for commercial development (see Site Plan). The project was previously approved as shown by both the State and the Corps. (See Site Maps). The dimensions and other specific information regarding the downstream pond can be obtained from John Gilleece at Hugh J. Gilleece & Assoc. (91946971101). Project impacts to jurisdictional areas and resultant totals is shown on the map. Todd Tugwell of the Corps has made important stream determinations on-site but, DWQ has not.
