Any violation of these terms may be subject to fines, imprisonment or civil action; or may cause the permit to be null and void. Upland Development 1) Unless specifically altered herein, this permit authorizes the land disturbing activities associated with the development of the above referenced property, including the proposed duplexes and driveways, the stormwater cambers, and the walkway, all as expressly and specifically set forth in the attached permit application and workplan drawings. Any additional land disturbing activities and/or construction may require a modification of this permit. Contact a Division of Coastal Management representative at (252) 808-2808 for this determination. The permittee is further advised that non- water dependent activities are not authorized within 30 feet of the normal high water level. (See attached sheets for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. An appeal requires resolution prior to work initiation or continuance as the case may be. This permit must be accessible on-site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. CO?+DITIOtiS Sedimentation and Erosion Control In order to protect "water quality, runoff, from construction Shall nct v.S.bl`;' increase the amount of suspended sediments in adjacent waters. 3) Appropriate sedimentation and erosion control devices, measures or structures shall be implemented to ensure that eroded materials do not enter adjacent wetlands, watercourses and property (e.g. silt fence, diversion swales or berms, etc.). 4) A ground cover sufficient to restrain erosion shall be provided within 30 calendar days of completion of any phase of grading on cut or filled slopes. Spoil Disposal 5) All debris resulting from the removal of the existing boatramp shall be disposal of in an approved high ground disposal area. 6) No spoil material shall be placed within 30 feet of the normal high water line. 7) The spoil area shall be inspected and approved by the Division of Coastal Management prior to the beginning of activities associated with the removal of the boat ramp. The permittee shall contact the Division of Coastal Management at (252) 808-2808 two weeks prior to commencement of dredging activities to schedule a site visit for spoil area approval. 8) All excavated materials shall be confined above normal high water and landward of regularly or irregularly flooded Coastal Wetlands behind adequate dikes or other retaining structures to prevent spillover of solids into any marsh or surrounding waters. DockinIZ Facility 9) Should either adjacent property be sold prior to the initiation of construction of the docking facility, the permittee shall obtain a written agreement from the new owner(s) agreeing to allow the construction of the permitted docking facility within the riparian corridor of that property, and a copy of the new agreement shall be submitted to the Division of Coastal Management prior to initiating construction of the docking facility. 10) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. 11) Unless specifically altered herein, this permit authorizes the docks, piers, and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, shall become a permanent part of this docking facility without permit modification. No non-water dependent uses of structures shall be conducted on, in or over public trust waters without permit modification. leep Creek Farms, Inc., c/o Jim Maxwell Permit 4141-09 Page "3 of 4 ADDIT10--`sAL CONDITIONS 12) The permittee shall maintain the authorized .=cork in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he abandons the per-f-I act;T ?ty w;1-11 l out laving it transfer:-?d to a third party. perm-" 1 +?ll V 1L . - f 13) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the L.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, pert-nanent reflectors shall be attached to the structure in order to make it more visible during hours of darkness or inclement weather. r 14) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the docking facility. Any sewage discharge at the marina/docking facility shall be considered a violation of this permit for which the permittee is responsible. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. 15) Any portion of the permitted access pier and docking facilities built over coastal wetlands shall not exceed six feet in width and shall be elevated a minimum of three feet over the wetland substrate as measured from the bottom of the decking. 16) No portion of the authorized docking facility, including tie piles, shall extend more than one quarter of the width of the water body. Measurements to determine width of the water body shall be made from the waterward edge of any coastal wetland vegetation which borders the water body. 17) This permit authorizes a maximum of 20 boat slips. At no time shall more than 20 vessels be moored or docked at the facility. The restriction of the number of vessels shall apply to all marine vessel types, including but not limited to motorboats, sailing vessels and personal watercraft. Easement 18) An Easement from the Department of Administration's State Property Office may be required under N.C.G.S. 14-6-12(e). The permittee shall contact the State Property Office at 919-807-4650 prior to the initiation of construction of any structures over state-owned submerged lands to determine if such an easement will be required. Any required easements shall be obtained, and a copy provided to the Division of Coastal Management at 400 Commerce Avenue, Morehead City, NC 28557, prior to construction of any new boat slips or other docking facilities authorized under this permit. Shoreline Stabilization 19) The authorized bulkhead shall be constructed immediately waterward of the existing bulkhead, except that the bulkhead that will be used. to close off the existing boat ramp may be constructed as proposed. 20) The bulkhead shall be constructed prior to any backfilling activities. 21) The bulkhead shall be structurally tight so as to prevent seepage of backfill materials through the structure. :sleepy Creek Farms, Inc., c/o ,Jim Maxwell PQrmi# 141-09 Parje 4 of 4 ADDITIONAL CONDITIONS 22} The bulkhead shall be solid and constructed of treated wood, concrete slabs, metal or vinyl sheet piles, or other suitable materials approved by Division personnel. f ?3) All backfill material shall be clean and free of any pollutants except in trace quantities. 24) All backfill material shall be obtained from a high ground source and confined behind the permitted s bulkhead. a h i 2??} No backfill material is to be placed within 30 feet of the normal high water line, except that which will s be used to backfill the area behind the permitted bulkhead. 1 { f 26) All fill material to be placed below normal high water level shall be confined behind the permitted bulkhead. General 27) The permittee understands and agrees that, if future operations by the United States requires the removal, relocation, or other alteration of the structure or work authorized by this permit, or if in the opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause unreasonable obstruction to free navigation of the navigable waters, the permittee will be required, upon due notice from the Corps of Engineers, to remove, relocate or alter the structural work or obstructions caused thereby, without expense to the United States or the state of North Carolina. No claim shall be made against the United States or the state of North Carolina on account of any such removal or alteration. 28) The pilings associated with the existing docking facility shall be removed in their entirety. In the event that a piling breaks during removal and cannot be removed in its entirety, the piling may be cut off flush with the bed of the water body. 29) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the written approval of the Division of Coastal Management. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. NOTE: The permittee and/or his contractor is urged to meet with a representative of the Division prior to project initiation. NOTE: The N.C. Division of Water Quality has authorized the proposed project under DWQ Project No. 09-0616 v2. NOTE: The U.S. Army Corps of Engineers authorized the proposed project under COE Action Id. No. SAW-2009-01241 which was issued on 7/1/09.
