Dear Mr. Hutton:
On September 23, 2019, the Division of Water Resources (DWR) received a Year 5 Monitoring
Report from Wildlands Engineering, Inc on behalf of Wildlands Holdings 11, LLC (Wildlands) for
the Buck Swamp Mitigation Bank (Site). On October 24, 2019, Katie Merritt with the DWR, visited
the Site to compare vegetation data submitted in the report with onsite conditions and to evaluate the
Site for closeout of the monitoring requirements. Staff with Wildlands were also present. While
onsite, DWR noted that additional easement signs with contact information needed to be installed.
DWR also observed a maintained path absent of trees within the Conservation Easement and within
credited areas. On November 26, 2019, Wildlands confirmed this area to be approximately 0.15
acres (1,675 ft2 within buffer credited areas and 5,053 ft2 within nutrient offset credited areas) and
provided confirmation that additional easement signs had been installed. As a result of the site visit
evaluation, along with supporting information received on November 26, 2019, Ms. Merritt supports
closing out the Site for any further monitoring and maintenance of the riparian vegetation and
conservation easement.
The riparian buffer and nutrient offset credits being released with this letter have been adjusted
based on the area of the encroachment noted above as 1,675 ft2 and 5,053 ft2 (0.116 acres)
respectively.
By copy of this letter, the monitoring requirements at the subject Site have been met and DWR is
releasing Wildlands from its financial assurance obligations under Performance Bond #106207178
with Travelers Casualty and Surety Company of America. Lastly, according to DWR files, the
Grantee of this Site's conservation easement is Unique Places to Save.
According to the UMBI signed on June 10, 2014 and modified on April 2, 2015 the following Project
Milestones have been met, and the corresponding credits shall be released:

9) Monitoring Report #5: Approved by the DWR 10%
By copy of this correspondence, DWR confirms that you have fully satisfied the above requirements
for the above -referenced tract and 10% of your Neuse riparian buffer credits (0.10 x 152,460 ft2 =
15,246 ft2) minus 1,675 ft2 yields 13,571 ft2 that are now available to sell. Additionally, 10% of your
nitrogen nutrient offset credits (0.10 x 88,283.03 lb-N = 8,828.301b-N) minus 263.67 lbs-N yields
8,564.63 lbs-N that are now available to sell.
Please note that nutrient offset credits generated at this site must be used for impacts in HUC
03020201 of the Neuse River Basin excluding the Falls Watershed. Additionally, the riparian
buffer credits must be used for impacts in the Neuse River Basin according to guidelines in the
Consolidated Buffer Mitigation Rule, 15A NCAC 02B .0295, which became effective as of
November 1, 2015.
