Salisbury Street Raleigh, NC 27604 Dear Mr. Thornburg, The Wastewater Irrigation System Permit for the City of Raleigh Wrenn Road Spray Irrigation Facility, Permit No. WQ0002708 is set to expire on June 30, 2020 and is due for renewal. In accordance with NCDENR DWR non -discharge permit renewal requirements, the City of Raleigh is submitting the enclosed Non -Discharge Permit Renewal request package within six months of the permit expiration date to request renewal of Permit No. WQ0002708. The enclosed permit renewal request submittal package includes the following: • A signed copy of completed and executed Non -Discharge System Renewal Application (Form NDSR 08-19). (Attachment A) • The most recently issued permit, dated July 14, 2015. (Attachment B) • A report prepared by HDR, NC 540 Impacts on Raleigh Wrenn Road Facility, which describes the anticipated loss of spray irrigation area sustained by the Wrenn Road Facility. (Attachment C) • An updated site map for the facilities, including a general overall location map and multiple site plans that have been prepared for the Spray Irrigation Modifications Project. (Attachment D) The current permit includes a statement regarding the reduction of setbacks to residences that are part of the Buffaloe Preserve LLC subdivision. The setbacks were reduced to 200 feet per setback waiver allowance in 15A NCAC 02T .0506(d). The City would like to continue with this setback. We do not believe the data in the table in Section IV of the permit application form is necessary. As part of the previous permit requirements, the City has installed four groundwater monitoring wells at various locations approved by NC DEQ that are at or near the Wrenn Road Facility. The purpose of these wells is to evaluate background concentrations of manganese, iron and arsenic above 15A NCAC 02L standards. Per conversations with NC DEQ, modeling may be required after the sampling campaign is completed. It is anticipated that, NC 540 will be expanded on a portion of the Wrenn Road Spray Irrigation Facility. Potential changes to the facility as a result of this project have been previously discussed with NC DEQ during initial conversations for this permit renewal and as part of the City's Groundwater Monitoring Plan for the Wrenn Road facility Wastewater Irrigation System Memorandum submittal to NC DEQ. The NC 540 project is currently in the design phase, but it is anticipated that there will be impacts to spray irrigation fields 2A and 3B as a result of construction. Potential impacts may include a loss of 8.3 acres of irrigable land and modifications to spray field operations. The attached NC 540 Impacts on Raleigh Wrenn Road Facility report prepared by HDR provides a detailed analysis of the anticipated impacts. Changes to facility operations from NC 540 will be addressed by submitting a separate application for a revised permit when design is complete. This permit shall be effective from July 14, 2015, until June 30, 2020, shall void Permit No. WQ0002708 issued November 7, 2012, and shall be subject to the following specified conditions and limitations: 1. Plans and specifications for a flow measuring device pursuant to Condition IV.3. shall be prepared by a licensed North Carolina Professional Engineer and submitted to the Raleigh Regional Office 30 days prior to installation. The tlow measuring device shall be installed within one year of the date of this permit. 2. No later than sir months prior to the e�pimtimr of this permit, the Permittee shall request renewal of this perurit on official Division forms. Prior to distribution of DAF residuals to City of Raleigh Wrenn Road Facility from DE Benton WTP, the Permittee shall submit a completed Residuals Source Certification for the DAF residual waste stream and all associated analyses to the Division demonstrating similar characteristics to the sedimentation blowdolva waste stream and that the combined effluent qualities are suitable for treatment at the City of Raleigh Wrenn Road Facility. Once the Division has approved, the Wrenn Road Wastewater Irrigation System shall be permitted to treat the DAF residual waste stream. II. PERI+ORMANCE STANllARDS The subject non -discharge facilities shall Ue effectively maintained and operated at all times so there is no discharge to surface waters, nor any contravention of groundwater or surface water standards. In the event the facilities fail to perform satisfactorily, including the creation of nuisance conditions due to improper operation and maintenance, or failure of the irrigation areas to adequately assimilate the effluent, the Permittee shall take immediate corrective actions including Division required actions, such as the construction of additional or replacement wastewater treatment or irrigation facilities. [G.S. 143-215.1, 143-213.3(a)] 2. This permit shall not relieve the Permittee of their responsibility for damages to groundwater or surface water resulting from the operation of this facility. This disposal system was individually permitted on or after DecemUer 30, 1983; therefore, the compliance boundary is established at either 250 feet from the effluent disposal area, or 50 feet within the property boundary, whichever is closest to the effluent disposal area. An exceedance of groundwater standards at or beyond the compliance boundary is subject to remediation action according to 15A NCAC 02L .0106(d)(2) as well as enforcement actions in accordance with North Carolina General Statute 143-215.6A through 143-215.6C. [15A NCAC 02L .0106(d)(2), 02L .0107(b)] 7. hr accordance with 15A NCAC 02L A108, the review boundary is established midway between the compliance boundary and the effluent disposal area. Any exceedance of groundwater standards at the review boundary shall require action in accordance with 15A NCAC 02L .0106. [15A NCAC 02L .0106, 02L .0108] 8. The Permittee shall apply for a permit modification to establish anew compliance boundary prior to any sale or transfer of property affecting a compliance boundary. [15A NCAC 02L .0107(c)] 9. In accordance with 15A NCAC 02L .0107(d), no wells, excluding Division approved monitoring wells, shall be constructed within the compliance boundary except as provided for in 15A NCAC 02L .0107(g). Except as provided for in 15A NCAC 02L .0107(g), the Permittee shall ensure any landowner who is not the Permittee and owns land within the compliance boundary shall execute and file with the Wake County Register of Deeds an easement running with the land containing the following items: a. A notice of the permit and number or other description as allowed in 15A NCAC 02L .0107(f)(1); b.Prohibits construction and operation of water supply wells within the compliance boundary; and c.Reserves the right of the Permittee or the State to enter the property within the compliance boundary for purposes related to the permit. 11. 'The Director may ternninate the easement when its purpose has been fulfilled or is no longer needed. [15A NCAC 02L .0107(f)]Tlne facilities permitted herein shall be constructed according to the following setbacks: a. Any well with exception of monitoring wells: 100 vI Any property line: 50 [ 15A NCAC 02H .0219(j) / 15A NCAC 02T .O50G(b)] III. OPERATION AND MAINTENANCE REQUIREMENTS 1. The facilities shall be properly maintained and operated at all times. The facilities shall be effectively maintained and operated as a non -discharge system to prevent the discharge of any wastewater resulting from the operation of this facility. The Permittee shall maintain an Operation and Maintenance Plan pursuant to 15A NCAC 02T .0507, which at a mininnun shall include operational functions, maintenance schedules, safety measures and a spill response plan. [I5A NCAC 02T .0507] 2. Upon the Water Polhrtion Control System Operators Certification Commission's (WPCSOCC) classification of the subject non -discharge facilities, in accordance with 15A NCAC 08G .0200 the Permittee shall designate and employ a certified operator in responsible charge (ORC) and one or more certified operator(s) as back-up ORC(s). The ORC or their back-up shall visit the facilities in accordance with 15A NCAC 08G .0200, and shall comply with all other conditions specified in the previously cited rules. [15A NCAC 02T .0117] 3. A suitable year round vegetative cover shall be maintained at all times, such that crop health is optimized, allows for even distribution of effluent and allows inspection of the irrigation system. [15A NCAC 02T .0108(b)(1)] 4. Adequate measures shall be taken to prevent effluent pondiug hi or runoff from the irrigation sites listed in Attachment B. [15A NCAC 021 .0108(b)(1)] 5. Irrigation shall not be performed during inclement weather or when the ground is in a condition that will cause pondiug or runoff [15A NCAC 02T .0108(b)(1)] 6. All irrigation equipment shall be tested and calibrated at least once per permit cycle. Calibration records shall be maintained at the facility for a period of uo less than five years, and shall be made available to the Division upon request. [15A NCAC 02T .0108(b)(1)] 7. Only effluent from Wrenn Road WWTF shall be irrigated on the sites listed in Attachment B. [G.S. 143-215.1 ] 8. No automobiles or machinery shall be allowed on the irrigation sites except during equipment installation or while maintenance is being performed. [15A NCAC 02T .0108(b)(1)] 9. Public access to the irrigation sites and wastewater treatment facilities shall be prohibited. Raleigh may provide for limited access, with appropriate fenoing and gates, to accommodate emergency services on the property or adjacent properties. [15A NCAC 02T. 1000(a)(1)] 10. The residuals generated from the wastewater treatment facilities shall be disposed or utilized in accordance with 15A NCAC 02T .I100. The Permittee shall maintain a residual management plan pursuant to 15A NCAC 02T .0508. [15A NCAC 02T .0508, 02T .1100] 11. Diversion or bypassing of untreated or partially treated wastewater from the treatment facilities is prohibited. [15A NCAC 02T .OSOSQ)] W00002708 Version 3.0 Shell Version 141027 Page 4 of 10 12. Freeboard inthe lagoon shall not be less than two feet at any time. [ 15A NCAC 02T .0505(d)] 13. A gauge to monitor Waste levels in the lagoon shall be provided. This gauge shall have readily visible permanent markings, at inch or tenth -of -a -foot increments, indicating the following elevations: maximum liquid level at the top of the temporary liquid storage volume; minimum liquid level at the bottom of the temporary liquid storage volume; and the lowest point on top of the data. [15A NCAC 02T .0108(b)(1)] 14. A protective vegetative cover shall be established and maintained on all earthen embankments (i.e, outside toe of embankment to maximum allowable temporary storage elevation on the inside of the embankment), berms, pipe runs, erosion control areas, and surface Water diversions. Trees, shrubs, and other Woody vegetation shall not be allowed to grow on the earthen dikes or embankments. Earthen embankment areas shall be kept mowed oil otherwise controlled and accessible. [ 15A NCAC 02T .0108(b)(1)] IV. MONITORING AND REPORTING REQUIREMENTS 1. Any Division required monitoring (including groundwater, plant tissue, soil and surface water analyses) necessary to ensure groundwater and surface water protection shall be established, and an acceptable sampling reporting schedule shall be followed. [15A NCAC 02T .0108(c)] 2. Per 15A NCAC 02H .0800, a Division certified laboratory shall conduct all laboatory analyses for the required effluent, groundwater o• surface water parameters. [15A NCAC 02H .0800] 3. Flow through the treatment facility shall be continuously monitored, and daily flow values shall be reported on Form NDMR. The Permittee shall install and maintain an appropriate flow measurement device to ensure tine accuracy and reliability of flow measurement consistent With accepted engineering and scientific practices. Selected flow measurement devices shall be capable of measuring flows With a maximum deviation of less than ten percent from true flow; accurately calibrated at a minimum of once per year; and maintained to ensure the accuracy of measurements is consistent with the selected device's accepted capability. The Permittee shall maintain records of flow measurement device calibration on file for a period of at least five years. At a minimum, documentation shall include: a. Date of flow measurement device calibration, b. Name of person performing calibration, mud c. Percent from true flow. [ 15A NCAC 02T .0105(k)] 4. The Permittee shall monitor the effluent from the subject facilities at the frequencies and locations for the parameters specified in Attachment A. [15A NCAC 02T .0108(c)] 5. The Permittee shall maintain adequate records hacking the amount of effluent irrigated. At a mininnun, these records shall include the following information for each irrigation site listed in Attachment B: a. Date of irrigation; b. Volume of effluent irrigated; c. Site irrigated; d. Length of time site is irrigated; e. Continuous weekly, monthly, and year-to-date hydraulic (inches/acre) loadings; f. Continuous monthly and year-to-date loadings for any non -hydraulic parameter specifically limited in Attachment B; g. Weather conditions; and I. Maintenance of cover crops. [15A NCAC 02T .0108(c)] WQ0002708 Version 3.0 Shell Version 141027 Page 5 of 10 Freeboard (i.e., waste level to the lowest embankment elevation) in the lagoon shall be measured to the nearest inch or tenth -of -a -foot, and recorded weekly. Weekly freeboard records shall be maintained at the facility for a period of no less than five years, and shall be made available to the Division upon request. [15A NCAC 02T .0108(c)] Three copies of all monitoring data (as specified in Conditions IV.3. and 1V.4.) on Form NDMR for each PPI and three copies of all operation and disposal records (as specified in Conditions IV.5. and IV.6) on Form NDAR-1 for every site in Attachment B shall be submitted on or before the last day of the following month. If no activities occurred daring the monitoring month, monitoring reports are still required documenting the absence of the activity. All information shall be submitted to the following address: Division of Water Resources Information Processing Unit 1617 Mail Service Center Raleigh, North Carolina 27699-1617 [15A NCAC 02T .0105(1)] 8. Pursuant to § 143-215.1C., the Permittee shall provide to its users and the Division of Water Resources an annual report summarizing the performance of the water treatment residuals sedimentation and irrigation facility and the extent to which the facility has violated this permit, or federal or State laws, regulations, or rules related to the protection of water quality. This report shall be prepared on either a calendar or fiscal year basis and shall be provided no later than 60 days after the end of the calendar or fiscal year. Two copies of the annual report provided to the Permittee's users shall be submitted to: Division of Water Resources Water Quality Permitting Section Non -Discharge Permitting Unit 1617 Mail Service Center Raleigh, North Carolina 27699-1617 [G.S. 143-215.1C] 9. A record shall be maiutained of all residuals removed from this facility. This record shall be maintained at the facility for a period of no less than five years, and shall be made available to the Division upon request. At a minimum, this record shall include: a. Name of the residuals hauler; b. Non -Discharge permit number authorizing the residuals disposal, or a letter from a municipality agreeing to accept the residuals; c. Date the residuals were hauled; and d. Volume of residuals removed. [15A NCAC 02T .0108(b)(1)] 10. A maintenance log shall be maintained at this facility. This log shall be maintained at the facility for a period of no less than five years, and shall be made available to the Division upon request At a mininnum, this log shall include: a. Date of calibration of flow measurement device; b. Visual observations of the plant and plant site; and c. Record of preventative maintenance (e.g., changing of equipment, adjustments, testing, inspections and cleanings, etc.). [15A NCAC 02T .0108(b)(1)] 11. Monitoring wells shall be sampled after conshuctimn and withiu 3 months prior to initiating non - discharge disposal operations. Monitoring wells shall be sampled thereafter at due frequencies amd for the parameters specified in Attachment C. All mapping, well construction forms, well abandonment forms and monitoring data shall refer to the permit number and the well nomenclature as provided in Attachment C and Figure I. [ 15A NCAC 02T .0105(m)] W00002708 Version 3.0 Shell Version 141027 Page 6 of 10 12. Two copies of the monitoring well sampling and analysis results shall be submitted on a Compliance Monitoring Form (GW-59), along with attached copies of laboratory analyses, on or before the last Working day of the month following the sampling month. The Compliance Monitoring Form (GW- 59) shall include this permit number, the appropriate Well identification number, and one GW-59a certification form shall be submitted with each set of sampling results. All information shall be submitted to the following address: Division of Water Resources Information Processing Unit 1617 Mail Service Center Raleigh, North Carolina 27699-1617 [I5A NCAC 02T .0105(nr)] 13. An annual representative soils analysis (i.e., Standard Soil Fertility Analysis) shall be conducted on each irrigation site listed in Attachment B. These results shall be maintained at the facility for a period of no less than five years, and shall be made available to the Division upon request. At a minimum, the Standard Soil Fertility Analysis shall include the following parameters: Acidity Exchangeable Sodium Percentage Phosphorus Base Saturation (by calculation) Magnesium Potassium Calcium Manganese Sodium Cation Exchange Capacity Percent Humic Matter Zinc Copper pH Sodium Adsorption Ratio [15A NCAC 02T .0108(c)] 14. Noncompliance Notiiicatimr: The Permittee shall report by telephone to the Raleigh Regional Office, telephone number (919) 791- 4200, as soon as possible, but in no case more than 24 hours, or on the next working day following the occurrence or first knowledge of the occurrence of any of the following: a. Wastes abnormal in quantity or characteristic, including the known passage of a hazardous substance. b. Any process unit failure (e.g., mechanical, electrical, etc.), due to known or unknown reasons, rendering the facility incapable of adequate Wastewater treatment. c. Any facility failure resulting in a by-pass directly to receiving surface waters. d. Any time self -monitoring indicates the facility has gone out of compliance with its permit limitations, e. discharge of 1,000 gallons or more of untreated wastewater to the surface waters of the State. £ Pending in or runoff from the irrigation sites. Any emergency requiring immediate reporting (e.g., discharges to surface waters, imminent failure of a storage structure, etc.) outside normal business hours shall be reported to the Division's Emergency Response personnel at telephone number (800) 662-7956, (800) 858-0368, or (919) 733-3300. Persons reporting such occurrences by telephone shall also file a written report in letter form within five days following first knowledge of the occurrence. This report shall outline the actions taken or proposed to be taken to ensure the problem does not recur. INSPECTIONS ftllllllll The Permittee shall provide adequate inspection and maintenance to ensure proper operation of the wastewater heatnnent and irrigation facilities. [15A NCAC 02T .0108(b)] 2. The Permittee or their designee shall inspect the wastewater treatment and irrigation facilities to prevent malfunctions, facility deterioration and operator errors resulting in discharges, which may cause the release of wastes to the environment, a threat to human health or a public nuisance. The Permittee shall maintain an inspection log that includes, at a mininaun, the date and time of inspection, observations made, and any maintenance, repairs, or corrective actions taken. The Permittee shall maintain this inspection log for a period of five years from the date of the inspection, and this log shall be made available to the Division upon request. [15A NCAC 02T .0108(b)] 3. Anry duly authorized Division representative may, upon presentation of credentials, enter and inspect any property, premises or place on or related to the wastewater treatment and irrigation facilities permitted herein at any reasonable time for the purpose of determining compliance with this permit; may inspect or copy any records required to be maintained under the terms and conditions of this permit, and may collect groundwater, surface water or leachate samples. [G.S. 143-21.5.3(a)(2)] VI. GENERAL CONDITIONS 1. Failure to comply with the conditions and limitations contained herein may subject the Permittee to an enforcement action by the Division in accordance with North Carolina General Statutes 143- 215.6A to 143-215.6C. [G.S. 143-215.6A to 143-215.6C] 2. This permit shall become voidable if the permitted facilities are not constructed in accordance with the conditions of this permit, the Division approved plans and specifications, and other supporting documentation. [15A NCAC 02T .0110] 3. This permit is effective only with respect to the nature and volume of wastes described in the permit application, Division -approved plans and specifications, and other supporting documentation. No variances to applicable rules governing the construction or operation of the permitted facilities are granted, unless specifically requested and approved in this permit pursuant to 15A NCAC 02T .0105(n). [G.S.143-21,5,1] 4. The issuance of this permit does not exempt the Permittee from complying with any and all statutes, rules, regulations, or ordinances, which may be imposed by other jurisdictional government agencies (e.g., local, state, and federal). Of particular concern to the Division are applicable river buffer rules in 15A NCAC 02B .0200; erosion and sedimentation control requirements in 15A NCAC Chapter 4 and under General Permit NCG010000; any requirements pertaining to wetlands under 15A NCAC 02B .0200 and 02H .0500; and documentation of compliance with Article 21 Part 6 of Chapter 143 of the General Statutes. [15A NCAC 02T .0105(c)(6)] hi the event the permitted facilities change ownership or the Permittee changes their name, a formal permit nnodification request shall be submitted to the Division. This request shall be made on official Division forms, and shall include appropriate property ownership documentation and other supporting documentation as necessary. The Permittee of record shall remain fully responsible for maintaining and operating the facilities permitted herein until a permit is issued to the new owner. [ 15A NCAC 02T .0104] 6. The Permittee shall retain a set of Division approved plans and specifications for the life of the facilities permitted herein. [15A NCAC 02T .0108(b)(I)] 7. The Permittee shall maintain this permit until all permitted facilities herein are properly closed or permitted under another permit issued by the appropriate permitting authority pursuant to 15A NCAC 02T .0105(j). This permit is subject to revocation or unilateral modification upon 60-day notice from the Division Director, in whole or part for the requirements listed in 15A NCAC 02T .0110. Unless the Division Director grants a variance, expansion of the permitted facilities contained herein shall not be granted if the Perinittee exemplifies any of the criteria in 15A NCAC 02'f .0120(b). [15A NCAC 02T .0120] 10. The Permittee shall pay the annual fee within 30 days after being billed by the Division. Failure to pay the annual fee accordingly shall be cause for the Division to revoke this permit pursuant to 15A NCAC 02T .0105(e)(3). City of Raleigh Public Utilities Department i NC 540 Impact on Wrenn Road Facility Evaluation ��� Executive Summary Executive Summary The City of Raleigh Public Utilities Department (City) is seeking to quantify the impacts to its Wrenn Road Facility from construction of the NC 540 Triangle Expressway Southeast Extension by the North Carolina Department of Transportation (NCDOT), Federal Highway Administration (FHWA) and North Carolina Turnpike Authority (NCTA) (Figure ES- 1). The Wrenn Road Facility site will be impacted in at least three ways: • Sprayfield irrigated area and other physical infrastructure for the treatment facility are lost at the southern end of the site, either directly (taken by NCDOT for Expressway right of way or for a stormwater drainage easement) or indirectly (state -required setbacks between Wrenn Road Facility sprayfields and property lines) • Irrigation system pumping systems and controls are impacted; modified pumping systems and controls programming will be required • New infrastructure will need to be constructed at another location to replace the treatment capacity lost due to NCDOT's project Other impacts may also occur, including the lost opportunity to utilize the southern end of the site for additional wastewater pumping infrastructure and the value of the lost land area itself. The Wrenn Road Facility receives water treatment process residuals from the Dempsey E. Benton Water Treatment Plant through a 16-inch influent force main. Liquid from the residuals is spray - applied to the site's 14 irrigation zones. Capacity impacts from the NC 540 project occur in spray irrigation zones 2A and 3B, in the southeast portion of the site. These impacts are effectively the same whether or not the specified setback is 50-ft or 150-ft from the NC 540 right of way because of the operational requirements and how the setbacks intersect the sprayfield grid system. With a 50-ft or 150-ft setback, irrigation zone 2A will lose approximately 7.1 acres of its original 20.2 acres irrigated area; zone 3B will lose approximately 4.3 acres of its 16.7 acres of irrigated area. The total loss of approximately 11.4 acres of irrigation is 4.3 percent of the total 268.68 irrigated acres at the site. The conceptual level opinion of probable project cost for replacement of treatment capacity at the Wrenn Road Facility ranges from $2.5 million to $9.2 million. A new location offsite will be needed to replace the lost capacity; the wide range of cost opinion presented reflects the difference in expected costs between an adjacent site and a site 5 miles away. The other factors in the significant uncertainty of the probable project cost opinion are lack of site - specific data for the capacity replacement site, such as soil conditions, agronomic rates for irrigation, potential underground utility conflicts, property acquisition requirements and the route of a pipeline between the Wrenn Road Facility and future replacement site. Property values for suitable size parcels, for both fee -simple acquisition and temporary or permanent easements, are also uncertain in this developing area. The City's ability to acquire additional land is not guaranteed, nor is the ability to permit additional off -site irrigation lands. The cost estimates fall within the Association for the Advancement of Cost Engineering (AACE) International definition of a Class 5 industry standard for cost opinions at this stage of the project definition. City of Raleigh Public Utilities Department I NC 540 Impact on Wrenn Road Facility Evaluation ��� Introduction Introduction Background Construction of Interstate Highway 540 (1-540) and North Carolina Highway 540 (NC 540), a perimeter loop around Raleigh, began in the early 1990s in response to continued strong population growth in Raleigh, Wake County, and the Research Triangle region. Construction has been completed on approximately 41 miles of expressway between I-87/US 64/US 264 near Knightdale, in eastern Wake County, around the neighborhoods of north Raleigh, through an 1-40 interchange near RDU Airport, to NC Highway 55 south of Apex. Based on projected future regional transportation needs to reduce traffic congestion in the region during peak travel periods and to improve linkages throughout the regional roadway network, the North Carolina Department of Transportation (NCDOT), Federal Highway Administration (FHWA) and North Carolina Turnpike Authority (NCTA) have collaborated to plan for the completion of the 1-540/NC 540 perimeter loop, joining the current terminal ends of the Triangle Expressway and providing interchanges at US 401 South between Fuquay Varina and Garner, 1-40 South and US 70. NCDOT, FHWA, and NCTA collaborated on a siting study and evaluation of environmental impacts. This process is documented in their Final Environmental Impact Statement (FEIS) for the Complete 540 Triangle Expressway Southeast Extension, completed in December 2017. The NC 540 extension will be constructed along a route that will cross the southeast portion of the Wrenn Road Facility. The Wrenn Road Facility was constructed as a wastewater treatment facility by the Town of Garner and has been operated by the City since the merger of Garner's water and wastewater utilities with Raleigh in 2001. The function of Wrenn Road Facility is described as follows on the City's website: The Wrenn Road Facility, located in Garner, became a City asset upon utility system merger agreement with the Town of Garner. Consisting of over 600 acres of fields and woodlands, the facility was originally used to treat wastewater collected from the sewer system serving most of the Garner area. The facility has not received waste from the sewer system since 2008, when all wastewater flow was permanently redirected to the Neuse River Resource Recovery Facility. Operations at this site have since been repurposed for the management of residuals generated by operation of the Dempsey E. Benton Water Treatment Plant. These residuals are composed of the lake sediments and other particles that are removed from the water during the production of potable water. Water plant residuals are currently land applied and irrigated onto hay fields, and hay is baled and sold to local area farmers. The City's goal is to quantify the impacts on the facility by the alignment of NC 540, in terms of lost treatment capacity, and the costs to replace this capacity at another suitable location, including: 1. Quantify physical infrastructure impacted by NC 540, either from direct impacts (right of way [ROW] and stormwater drainage easements) or indirect impacts (irrigation area setback requirements) a. Communicate with the North Carolina Department of Environmental Quality (NCDEQ) Division of Water Resources (DWR) to identify the expected setback for Wrenn Road Facility's sprayfields from NC 540 ROW to comply with state permits. b. Map the proposed NC 540 ROW boundary with the Wrenn Road Facility infrastructure and overlay the required setback from the ROW line. c. Estimate loss of irrigated area and impact on the Wrenn Road Facility treatment capacity. d. Quantify irrigation system pumping and controls logic impacts resulting from the proposed loss of irrigated area and infrastructure. 2. Describe high-level requirements to replace impacted treatment capacity 3. Estimate the replacement value of the impacted infrastructure Impact Analysis Current Operation The Wrenn Road Facility receives residuals of the water treatment process from the Dempsey E. Benton Water Treatment Plant (DEBWTP) through a 16-inch influent force main. Spray irrigation application on the Wrenn Road Facility's 268.68 acres occurs by pumping from two onsite lagoons to sprinklers in 14 irrigation zones (e.g., zones 1A, 1 B, 2A, 2B, 3A, 3B, 4A, 4B, 5A, 5B, 6A, 6B, 7A, 7B). The on -site pump station includes four 100 HP pumps with variable frequency drives. The required flow rate to each of the zones has been balanced, with the flow rate and irrigation time designed to match the seasonal agronomic rate which can be utilized by the irrigated hay crop and trees. Multiple irrigation zones can be irrigated simultaneously. Table 1 summarizes the current permit limits for the Wrenn Road Facility (NCDWR Permit No. WQ0002708, Attachment A; current permit was issued July 14, 2015). The permit limits define irrigated acreage and yearly maximum inches of liquid which can be applied to each zone; the yearly maximum number of gallons which can be applied to each zone was not defined in the permit but can be calculated from the data provided, and is also shown in Table 1. The remainder of the site is used for the required setbacks, buffer areas, lagoons, roads, and maintenance and office facilities. The variability in the permit's limits on hourly application rate and yearly maximum application is due to agronomic analysis of differences in site conditions between the zones, including soil series, topography and crop type. The Wrenn Road Facility's design enables flexible operation to respond to current conditions so that agronomic application rates are not exceeded for the spray zones. Operations staff monitor weather and soil conditions and variations in residuals flow rate and adjust application schedules accordingly. The onsite lagoon storage permits the City to pause irrigation on days when ground conditions are not favorable. As of 2019, the average day flow through the Wrenn Road Facility is approximately 309,000 gpd. Continued growth in customer water demands are expected to drive increases in DEBWTP water production, with corresponding increases in residuals flows toward Wrenn Road Facility capacity limits. Physical Infrastructure Impacted By NC 540 The Wrenn Road Facility NC 540 Impacts analysis was completed based on the identified project goals and preliminary evaluation of the proposed alignment of NC 540 across the site, as provided by NCDOT's Design -Build Team. HDR performed a desktop review of the estimated project impacts and reviewed existing infrastructure, existing survey information, limited information on underground and above -ground utilities, Geographic Information System (GIS) data and other factors potentially influencing NC 540 project impacts. 5 City of Raleigh Public Utilities Department I NC 540 Impact on Wrenn Road Facility Evaluation ��� Impact Analysis NCDWR Guidance Regarding Setbacks Subchapter 15A 2T of the North Carolina Administrative Code (NCAC) — Waste Not Discharged to Surface Waters - governs permits for waste management systems that do not discharge to surface waters. Section 15A NCAC 2T.0500 addresses operational requirements for wastewater spray irrigation systems like the Wrenn Road Facility, including setbacks. Setbacks are defined as the horizontal separation between the sprinkler irrigation system and various physical features such as buildings, road right of ways, property lines, and water bodies. Subsection .0506 requires 50-ft setbacks for sprinkler irrigation systems from road rights of way and 150-ft setbacks from each property line. HDR verbally confirmed these set -back requirements with NCDWR's Tessa Monday, Environmental Engineer III, and was advised that a 50-ft setback would be required from the new NC 540 ROW line. There is a potential risk that in the future the City is held to the 150-ft property line setback in place of the 50-ft right of way setback. Because of this potential, an analysis was performed to estimate impacts from both 50-ft and 150-ft setbacks from the ROW. The analysis shows effectively the same impact because of the operational requirements and how the setbacks intersect the sprayfield grid system. Project Impacts to Irrigated Area HDR used GIS mapping to overlay the proposed NC 540 alignment on the Wrenn Road Facility, to determine the direct impacts of the Expressway ROW and stormwater drainage easement taking, and to evaluate the indirect impacts resulting from the additional 50-ft or 150-ft setback from the ROW imposed by the state's 2T regulations. Figures 1 and 2 illustrate the area impacted by the NC 540 project. Figure 1 shows the entire Wrenn Road Facility, while Figure 2 focuses on the impact area for the 50-ft and 150-ft setback respectively. Capacity impacts occur in irrigation zones 2A and 3B, in the southeast portion of the site. With a 50-ft or 150-ft setback, irrigation zone 2A will lose approximately 7.1 acres of the original 20.2 acres of the irrigated area due to the NC 540 project; zone 3B, with 16.7 acres of spray irrigation, will lose approximately 4.3 acres. This is a combined loss of approximately 11.4 acres of Wrenn Road Facility's total 268.68 irrigated acres. At the Wrenn Road Facility's design irrigation rates for each zone, this loss of irrigation area is estimated to be equivalent to a 5.6 million gallon per year (mg/y) loss in treatment capacity for zone 2A and a 3.2 mg/y capacity loss for zone 3B. Based on permit spray application limits, Wrenn Road's overall average day capacity would reduce by 3.7 percent (681,000 gpd) with a 50 or 150- ft. setback. These losses are experienced in 2 of the 14 irrigation areas. Direct and indirect impacts are measured in terms of infrastructure loss and lost irrigation capacity. Infrastructure impacts include the piping (both mains and smaller irrigation system lines), valves and sprinkler heads for the area lost to irrigation — which could not be relocated and reused elsewhere — as well as changes to the service requirements for the irrigation system's pumps and programmed control system. Table 3 summarizes Wrenn Road Facility property loss and irrigation capacity impacts estimated to result from the NC 540 project. With a 50-ft or 150-ft setback, the annual average day volume to irrigation zones 2A and 3B will be reduced, respectively, to 35,809 gallons (35.2% reduction) and 40,678 gallons (25.8%). Significant seasonal variations exist in application flow rates. These modifications can be accommodated by programming modifications to the variable frequency drives and the irrigation system controls logic for these zones. Mitigating for Loss of Infrastructure and Treatment Capacity Based on the impacts described above, the City will experience a real loss of infrastructure and irrigation capacity with either the 50-ft or 150-ft setback. A financial value can be associated with this impact based on infrastructure losses and costs to restore Wrenn Road Facility's capacity. HDR's preliminary opinion of the probable costs of these impacts is discussed in the following section. The City's water service area is expected to continue growing at a strong rate through the planning horizon, and the City cannot sustain the loss of the Wrenn Road Facility's treatment capacity resulting from the construction of NC 540. It will be necessary to offset the lost treatment capacity at a nearby available parcel by constructing a pipeline from the pump station and irrigation infrastructure (sprinklers, valves, etc.). Therefore, the cost opinion in the following section will incorporate replacement costs for the infrastructure and irrigation capacity impacts. The elements required to mitigate for the loss of infrastructure and treatment capacity are: ■ Parcel of land area comparable in size to the land taken for the project, located adjacent to the current site if possible to minimize pumping costs between the Wrenn Road Facility and new irrigated areas. However, if an adjacent site cannot be acquired, a more remote site several miles from the Wrenn Road Facility could be utilized. ■ Soil types that are at least comparable to the soil types found in the impacted portions of zones 2A (Granville, Wedowee, Chewacla and Wehadkee sandy loams, and Fuquay loamy sand) and 3B (Wedowee sandy loams). Further details are provided in Attachment B. ■ Irrigation infrastructure (piping, valves, sprinkler heads) sufficient for the treatment capacity to be replaced at a new location. ■ Modifications to pumping facilities and control logic as required to serve the new irrigation facilities. A dedicated pump station may be required to convey flows to an offsite sprayfield location. ■ Depending on the site location, cellular or radio communication may be necessary for the irrigation control system. ■ Monitoring wells for the new irrigation facilities, as required to comply with state -issued permits. • Site improvements for the new irrigation facilities, including security fencing, gravel roads, and site lighting. 10 City of Raleigh Public Utilities Department I NC 540 Impact on Wrenn Road Facility Evaluation Preliminary Project Opinion of Probable Costs Preliminary Project Opinion of Probable Costs Capacity Replacement Cost Opinion The preliminary opinion of probable cost for replacement of treatment capacity at the Wrenn Road Facility ranges from $2.5 million to $9.2 million for a 50-ft or 150-ft setback. The project cost opinion for irrigation capacity replacement is shown in Table 4. The opinion confirms to the Association for the Advancement of Cost Engineering (AACE) International definition of a Class 5 industry standard for cost opinions at this stage of the project definition. This type of information is valuable for understanding the potential changes that could occur to cost estimates as more detailed project information is developed during the design phase. The location of a replacement treatment site and the route of a pipeline 11 City of Raleigh Public Utilities Department I NC 540 Impact on Wrenn Road Facility Evaluation ��� Preliminary Project Opinion of Probable Costs between the Wrenn Road Facility and future replacement site are unknown; the new site could be immediately adjacent to the existing site or could be as much as five miles away. Property values for suitable size parcels, for both fee -simple acquisition and temporary or permanent easements, are also uncertain in this developing area. In addition, the City's ability to acquire additional land is uncertain, as well as the ability to permit additional off -site irrigation lands. The level of certainty for the project cost opinion is +50%/-30% within the AACE International definition of a Class 5 standard for cost opinions at this stage of project definition, meaning that the range of construction costs could be from $1.8 million to $6.0 million on the low end of the scale to $4.8 million to $13.8 million on the high end of the scale for a 50-ft setback or 150-ft setback. The following assumptions were applied in developing the cost opinion: • Property acquisition for new irrigation area to replace the area lost due to NC 540 is based on an irrigation area of 11.4 acres for a 50-ft setback or 150-ft setback. Accounting for land which is not usable for spray irrigation, the suitable minimum parcel size is estimated to be 22 acres, depending on the particular site and setback requirements applied. The estimated cost per acre is based on Wake County property tax database value of representative parcels exceeding 20 acres in the vicinity of the Wrenn Road Facility site. However, as noted above, there is significant uncertainty in property costs due to market conditions and parcels available for sale, and the City's costs could be significantly higher. For planning purposes, the property acquisition cost is estimated at $30,000 - $60,000 per acre. A property immediately adjacent to the Wrenn Road Facility site is preferred, though the City may need to include parcels remote from the site in their search. The range of per -acre costs would be applicable to either case. • Easement acquisition for the pipeline between the Wrenn Road Facility and a new remote irrigation area is based on an easement width of 30 feet centered over the line, with an irrigation area minimum parcel size of 20 acres. Easement cost is estimated to be approximately $100,000 per mile of offsite pipeline. • On -site installed PVC piping costs are based on similar project costs in unpaved easement, varying by pipe diameter, $20 to $30 per linear foot. Offsite installed piping costs, including an allowance for fittings, valves, and air release valves, are based on similar project costs in roadway rights of way, 6-inch ductile iron, $120 per linear ft. • On -site irrigation system components are based on vendor -provided unit costs with added installation allowance. Cost for fittings and all installation costs are incorporated into the $250 per -sprinkler cost. • A $50,000 allowance is provided for control system programming. In addition, an allowance of $100,000 to $500,000 is provided for a dedicated control system for the new irrigated area including cellular or radio communication to support SCADA monitoring and control; the higher end of the range represents additional costs if the new irrigation site is not adjacent to the existing Wrenn Road Facility. 12 City of Raleigh Public Utilities Department I NC 540 Impact on Wrenn Road Facility Evaluation ��� Preliminary Project Opinion of Probable Costs • A new dedicated pump station is assumed to serve an off -site new irrigation area, with an approximate firm capacity of 550 gpm, due to the complexity of modifying current pump facilities for significantly different operating requirements. • Site improvements budgeted for the new irrigation site include security fencing (estimated at 4,000 linear ft), site lighting, gravel roads and monitoring wells (estimated at 4 wells). • Design and construction administration costs for the project are included as a multiplier applied to the construction cost estimates at 15 percent of construction costs. PERFORMANCE STANDARDS The subject non -discharge facilities shall be effectively maintained and operated at all times so there is no discharge to surface waters, nor any contravention of groundwater or surface water standards. In the event the facilities fail to perform satisfactorily, including the creation of nuisance conditions due to improper operation and maintenance, or failure of the irrigation areas to adequately assimilate the effluent, the Permittee shall take immediate corrective actions including Division required actions, such as the construction of additional or replacement wastewater treatment or irrigation facilities. [G.S. 143-215.1, 143-213.3(a)] 2. This permit shall not relieve the Permittee of their responsibility for damages to groundwater or surface water resulting from the operation of this facility. [15A NCAC 02B .0200, 02L .0100] All wells constructed for purposes of groundwater monitoring shall be constructed in accordance with 15A NCAC 02C .0108 (Standards of Construction for Wells Other than Water Supply), and any other jurisdictional laws and regulations pertaining to Well construction. Upon the Water Pollution Control System Operators Certification Commission's (WPCSOCC) classification of the subject non -discharge facilities, in accordance with 15A NCAC 08G .0200 the Permittee shall designate and employ a certified operator in responsible charge (ORC) and one or more certified operator(s) as back-up ORC(s). The ORC or their back-up shall visit the facilities in accordance with 15A NCAC 08G .0200, and shall comply with all other conditions specified in the previously cited rules. [15A NCAC 02T .0117] 3. A suitable year round vegetative cover shall be maintained at all times, such that crop health is optimized, allows for even distribution of effluent and allows inspection of the irrigation system. [15A NCAC 02T .0108(b)(1)] 4. Adequate measures shall be taken to prevent effluent ponding in or runoff from the irrigation sites listed in Attachment B. [15A NCAC 02T .0108(b)(1)] 5. Irrigation shall not be performed during inclement weather or when the ground is in a condition that will cause ponding or runoff. [15A NCAC 02T .0108(b)(1)] 6. All irrigation equipment shall be tested and calibrated at least once per permit cycle. Calibration records shall be maintained at the facility for a period of no less than five years, and shall be made available to the Division upon request. [15A NCAC 02T .0108(b)(1)] 7. Only effluent from Wrenn Road WWTF shall be irrigated on the sites listed in Attachment B. [G.S. 143-215.1 ] 8. No automobiles or machinery shall be allowed on the irrigation sites except during equipment installation or while maintenance is being performed. [15A NCAC 02T .0108(b)(1)] 9. Public access to the irrigation sites and wastewater treatment facilities shall be prohibited. Raleigh may provide for limited access, with appropriate fencing and gates, to accommodate emergency services on the property or adjacent properties. [15A NCAC 02T .1000(a)(1)] 10. The residuals generated from the wastewater treatment facilities shall be disposed or utilized in accordance with 15A NCAC 02T .I100. The Permittee shall maintain a residual management plan pursuant to 15A NCAC 02T .0508. [15A NCAC 02T .0508, 02T .1100] 11. Freeboard i n the lagoon shall not be less than two feet at any time. [ I5A NCAC 02T .0505(d)] 13. A gauge to monitor Waste levels in the lagoon shall be provided. This gauge shall have readily visible permanent markings, at inch or tenth -of -a -foot increments, indicating the following elevations: maximum liquid level at the top of the temporary liquid storage volume; minimum liquid level at the bottom of the temporary liquid storage volume; and the lowest point on top of the data. [15A NCAC 02T .0108(b)(1)] 14. A protective vegetative cover shall be established and maintained on all earthen embankments (i.e., outside toe of embankment to maximum allowable temporary storage elevation on the inside of the embankment), berms, pipe runs, erosion control areas, and surface Water diversions. Trees, shrubs, and other Woody vegetation shall not be allowed to grow on the earthen dikes or embankments. Earthen embankment areas shall be kept mowed or otherwise controlled and accessible. [ 15A NCAC 02T .0108(b)(1)] IV. MONITORING AND REPORTING REQUIREMENTS 1. Any Division required monitoring (including groundwater, plant tissue, soil and surface water analyses) necessary to ensure groundwater and surface water protection shall be established, and an acceptable sampling reporting schedule shall be followed. [15A NCAC 02T .0108(c)] 2. Per 15A NCAC 02H .0800, a Division certified laboratory shall conduct all laboratory analyses for the required effluent, groundwater or surface water parameters. [15A NCAC 02H .0800] 3. Flow through the treatment facility shall be continuously monitored, and daily flow values shall be reported on Fornn NDMR. The Permittee shall install and maintain an appropriate flow measurement device to ensure the accuracy and reliability of flow measurement consistent with accepted engineering and scientific practices. Selected flow measurement devices shall be capable of measuring flows With a maximum deviation of less than ten percent from true flow; accurately calibrated at a minimum of once per year; and maintained to ensure the accuracy of measurements is consistent with the selected device's accepted capability. The Permittee shall maintain records of flow, measurement device calibration on file for a period of at least five years. At a minimum, documentation shall include: a. Date of flow measurement device calibration, b. Name of person performing calibration, and c. Percent from true flow. [15A NCAC 02T .0105(k)] 4. The Permittee shall monitor the effluent from the subject facilities at the frequencies and locations for tine parameters specified in Attachment A. [15A NCAC 02T .0108(c)] 5. The Permittee shall maintain adequate records tracking the amount of effluent irrigated. At a minimum, these records shall include the following information for each irrigation site listed in Attachment B: a. Date of irrigation; b. Volume of effluent irrigated; c. Site irrigated; d. Length of time site is irrigated; e. Continuous weekly, monthly, and year-to-date hydraulic (inches/acre) loadings; f. Continuous monthly and year-to-date loadings for any non -hydraulic parameter specifically limited in Attachment B; g. Weather conditions; and In. Maintenance of cover crops. [15A NCAC 02T .0108(c)] WQ0002708 Version 3.0 Shell Version 141027 Page 5 of 10 Freeboard (i.e., waste level to the lowest embanknici t elevation) in the lagoon shall be measured to the nearest inch or tenth -of -a -foot, and recorded weekly. Weekly freeboard records shall be maintained at the facility for a period of no less than five years, and shall be made available to the Division upon request. [15A NCAC 02T .0108(c)] Three copies of all monitoring data (as specified in Conditions IV.3. and 1VA.) on Form NDMR for each PPI and three copies of all operation and disposal records (as specified in Conditions IV.5. and IV.6) on Form NDAR-1 for every site in Attachment B shall be submitted on or before the last day of the following month. If no activities occurred daring the monitoring month, monitoring reports are still required documenting the absence of the activity. Pursuant to § 143-215.1C., the Permittee shall provide to its users and the Division of Water Resources an annual report summarizing the performance of the water treatment residuals sedimentation and irrigation facility and the extent to which the facility has violated this permit, or federal or State laws, regulations, or rules related to the protection of water quality. This report shall be prepared on either a calendar or fiscal year basis and shall be provided no later than 60 days after, the end of the calendar or fiscal year. Two copies of the annual report provided to the Permittee's users shall be submitted to: Division of Water Resources Water Quality Permitting Section Non -Discharge Permitting Unit 1617 Mail Service Center Raleigh, North Carolina 27699-1617 [G. S. 143-215.1 C] 9. A record shall be maintained of all residuals removed from this facility. This record shall be maintained at the facility for a period of no less than five years, and shall be made available to the Division upon request. At a minimum, this record shall include: a. Name of the residuals hauler; b. Non -Discharge permit number authorizing the residuals disposal, or a letter from a municipality agreeing to accept the residuals; c. Date the residuals were hauled; and d. Volume of residuals removed. [15A NCAC 02T .0108(b)(1)] 10. A maintenance log shall be maintained at this facility. This log shall be maintained at the facility for a period of no Tess than five years, and shall be made available to the Division upon request. At a mininnum, this log shall include: a. Date of calibration of flow measurement device; b. Visual observations of the plant and plant site; and c. Record of preventative maintenance (e.g., changing of equipment, adjustments, testing, inspections and cleanings, etc.). [15A NCAC 02T .0108(b)(1)] 11. Monitoring wells shall be sampled after construction and within 3 months prior to initiating non - discharge disposal operations. Monitoring wells shall be sampled thereafter at the frequencies and for the parameters specified in Attachment C. The Compliance Monitoring Form (GW- 59) shall include this permit number, the appropriate well identification number, and one GW-59a certification form shall be submitted with each set of sampling results. Noncompliance Notification: The Permittee shall report by telephone to the Raleigh Regional Office, telephone number (919) 791- 4200, as soon as possible, but in no case more than 24 hours, or on the next working day following the occurrence or first knowledge of the occurrence of any of the following: a. Wastes abnormal in quantity or characteristic, including the known passage of a hazardous substance. b. Any process unit failure (e.g., mechanical, electrical, etc.), due to known or unknown reasons, rendering the facility incapable of adequate wastewater treatment. c. Any facility failure resulting in a by-pass directly to receiving surface waters. d. Any time self -monitoring indicates the facility has gone out of compliance with its permit limitations. e. discharge of 1,000 gallons or more of untreated wastewater to the surface waters of the State. f. Pending in or runoff from the irrigation sites. Any emergency requiring immediate reporting (e.g., discharges to surface waters, imminent failure of a storage structure, etc.) outside normal business hours shall be reported to the Division's Emergency Response personnel at telephone number (800) 662-7956, (800) 858-0368, or (919) 733-3300. Persons reporting such occurrences by telephone shall also file a written repot in letter form within five days following first knowledge of the occurrence. This report shall outline the actions taken or proposed to be taken to ensure the problem does not recur. INSPECTIONS The Permittee shall provide adequate inspection and maintenance to ensure proper operation of the wastewater heatnnent and irrigation facilities. [15A NCAC 02T .0108(b)] 2. The Permittee or their designee shall inspect the wastewater treatment and irrigation facilities to prevent malfunctions, facility deterioration and operator errors resulting in discharges, which may cause the release of wastes to the environment, a threat to human health or a public nuisance. The Permittee shall maintain an inspection log that includes, at a mininnun, the date and time of inspection, observations made, and any maintenance, repairs, or corrective actions taken. The Permittee shall maintain this inspection log for a period of five years from the date of the inspection, and this log shall be made available to the Division upon request. [15A NCAC 02T .0108(b)] 3. Any duly authorized Division representative may, upon presentation of credentials, enter and inspect any property, premises or place on or related to the wastewater treatment and irrigation facilities permitted herein at any reasonable time for the purpose of determining compliance with this permit; may inspect or copy any records required to be maintained under the terms and conditions of this permit, and may collect groundwater, surface water or leachate samples. [G.S. 143-21.5.3(a)(2)] VI. GENERAL CONDITIONS 1. Failure to comply with the conditions and limitations contained herein may subject the Permittee to an enforcement action by the Division in accordance with North Carolina General Statutes 143- 215.6A to 143-215.6C. [G.S. 143-215.6A to 143-215.6C] 2. This permit shall become voidable if the permitted facilities are not constructed in accordance with the conditions of this permit, the Division approved plans and specifications, and other supporting documentation. [15A NCAC 02T .0110] 3. This permit is effective only with respect to the nature and volume of wastes described in the permit application, Division -approved plans and specifications, and other supporting documentation. No variances to applicable rules governing the construction or operation of the permitted facilities are granted, unless specifically requested and approved in this permit pursuant to 15A NCAC 02T .0105(n). [G.S. 143-21.5.1] 4. The issuance of this permit does not exempt the Permittee from complying with any and all statutes, rules, regulations, or ordinances, which may be imposed by other jurisdictional government agencies (e.g., local, state, and federal). Of particular concern to the Division are applicable river buffer rules in 15A NCAC 02B .0200; erosion and sedimentation control requirements in 15A NCAC Chapter 4 and under General Permit NCG010000; any requirements pertaining to wetlands under 15A NCAC 02B .0200 and 02H .0500; and documentation of compliance with Article 21 Part 6 of Chapter 143 of the General Statutes. [15A NCAC 02T .0105(c)(6)] hi the event the permitted facilities change ownership or the Permittee changes their name, a formal permit modification request shall be submitted to the Division. This request shall be made on official Division forms, and shall include appropriate property ownership documentation and other supporting documentation as necessary. The Permittee of record shall remain fully responsible for maintaining and operating the facilities permitted herein until a permit is issued to the new owner. [ 15A NCAC 02T .0104] 6. The Permittee shall retain a set of Division approved plans and specifications for the life of the facilities permitted herein. [15A NCAC 02T .0108(b)(1)] 7. The Permittee shall maintain this permit until all permitted facilities herein are properly closed or permitted under another permit issued by the appropriate permitting authority pursuant to 15A NCAC 02T .01050).
