PROJECT SUMMARY: The applicant proposes to construct a bulkhead along Far Creek and the eastern and western canal. The applicant proposes to construct 6' wide docks the entire length of each canal extending 1' waterward of the proposed bulkhead. Also the applicant proposes to add an additional 8' to the existing 8' wide dock adjacent Far Creek Philip Carawan Hyde County Project setting The applicant's property is located on SR 1101 on the south side of Far Creek at Englelhard in Hyde County, North Carolina. The 1.4 acre project site is within the Engelhard harbor area of Far Creek and varies from 2.5' to 4.0' above mean sea level. The property is bordered on the north by Far Creek and to the east and west by man made canals, 33' wide and 29' wide respectively. State Road 1101 is adjacent the applicant's site to the south. The canal on the western side is bordered on the landward end by a coastal marsh that extends northward down the canal for approximately 100' that is vegetated primarily with Juncus roemerianus and Distichlis spicata. The existing canal on the east side of the property has a boat ramp at the landward end of the canal. Water depths in the canals range between 7' to 11'. The area adjacent Far Creek has the existing 8' wide dilapidated dock and old concrete block building that once served as a wholesale seafood packing facility. This area is also fronted with a failing bulkhead that extends around and down ±80' of the canal on the eastern side of the property. The adjacent property on the west side is developed and bulkheaded and serves as a wholesale seafood packing facility while the property on the east side is occupied by a church. Project Description The applicant proposes to construct a new bulkhead 2' waterward of the existing bulkhead adjacent Far Creek and a new bulkhead along the inside edge of each manmade canal which includes bulkheading in front of the 100'x10' coastal wetland along the western canal for a total of X630'. The applicant proposes to backfill behind the bulkhead with the exception of the coastal wetland. The existing 8'x 228' loading dock adjacent Far Creek is to be replaced with an additional 8' added waterward for a total of 16'x 228'. The applicant proposes to install a 6' wide dock extending 1' beyond the waterward edge of the bulkhead along the entire length of each canal for a combined total of ±400'. Anticipated impacts The project as proposed will result in the loss of 1,000 ft2 of coastal wetland. The proposed loading dock will result in the shading of 3,648 ft2 of creek bottom. Localized turbidity is expected as a result of the bulkhead and dock construction. This area of Far Creek is a commercial fishing vessel harbor of refuge and the proposed project will increase space for mooring of commercial fishing vessels and their associated impacts. Steve J. Your receipt of this letter verifies your acceptance of a valid request for certification in accordance with Section 325.2(b)(ii) of our administrative regulations. We are considering authorizing the proposed activity pursuant to Section 404 of the Clean Water Act, and we have determined that a water quality certification is required under the provisions of Section 401 of the same law. A Department of the Army permit will not be granted until the certification has been obtained or waived. In accordance with our administrative regulations, in most cases, 60 days after receipt of a request for certification is a reasonable time for State action.
