SITE DESCRIPTION:
The City of Wilmington's municipal boat ramp has a permit history with the Division of Coastal
Management dating back to 1985, when the original permit was issued (CAN A/D&F Permit #23-85). The
CAMA/D&F permit authorized the construction of a bulkhead and boat ramp facility, located along Surry
Street, at the terminal end of Castle Street, adjacent to the Cape Fear River (CFR), in downtown
Wilmington. Although the City has maintained the site over the years, consistent use and natural forces
have prompted the need for major improvements.
In addition to the proposed boat ramp renovation, Progress Energy and River2Sea, LLC have "piggy
backed" the City's proposal to remove a considerable amount of contaminated soil from each of the
properties. Please refer to the Proposed Project section below for a detailed description of the development
activities being proposed for each property.
The City of Wilmington currently maintains a boat ramp facility at the terminal end of Castle Street in
downtown Wilmington, adjacent to the Cape Fear River. The boat ramp area consists of fourteen boat
trailer parking spaces, two launch ramps, a bulkhead, three access piers and three floating docks. The vast
majority of the site is developed and there is very little vegetation on the tract. What little vegetation that
does exist consists primarily of lawn grasses and ornamental landscaping.
Immediately adjacent to the City's boat ramp site (on the southern side), lies an undeveloped tract owned
by River2Sea, LLC. This property extends from Surry Street to the Cape Fear River and abuts the Cape
Fear Memorial bridge along the southern property boundary. The property is surrounded by a chain-link
fence and is accessible by a single access drive located along Surry Street. A deteriorated bulkhead
stabilizes the western shoreline, adjacent to the Cape Fear River. Vegetation on the tract consists primarily
of Phragmites.
Progress Energy owns the property immediately north of the City's boat ramp site, and this property also
extends from Surry Street to the Cape Fear River. A portion of Progress Energy's property is developed
and contains a fenced electrical equipment area. The remaining portions of the tract are vegetated and
contain Live Oak trees, Wax Myrtles, lawn grasses and ornamental landscaping. A wooden bulkhead
stabilizes the western shoreline, adjacent to the Cape Fear River. A residential property borders Progress
Energy to the north. Elevations on all three tracts range from 4' - 6' above Normal High Water.
The waters of the Cape Fear River, in this particular area, are classified as SC by the N.C. Division of
Water Quality. The area IS designated as a Primary Nursery Area, by the N.C. Division of Marine
Fisheries, and according to information provided by the Shellfish Sanitation Section, these waters are
CLOSED to the harvest of shellfish.
PROPOSED PROJECT:
The City of Wilmington, Progress Energy and River2Sea, LLC are requesting approval to remove
contaminated soil from all three properties. In addition, the City is requesting approval to redevelop the
existing boat ramp facility. Proposed upgrades include: replacing the driveway, parking areas, ramps,
floating docks and landscaping.
Prior to any new development activities, the applicant's are proposing to remove as much contaminated
soil as possible from each of the three properties. The high ground material would be removed, by
mechanical excavation, and transported to the Sampson County landfill. All bulk material removed from
the site, including asphalt and concrete, would be taken to Wilmington Materials and HWY 421 Recycling
Center. The applicant's have obtained suitability letters from each of the named facilities allowing
disposal. Following removal of contaminated soils, the applicant's are proposing to haul in clean fill
material, grade the area and install two temporary sediment basins, one located on the Progress Energy
property and the other on the property owned by River2Sea, LLC.

Cumulatively, approximately 2.95 acres would be disturbed as a result of the contamination clean-up.
Although development on the Progress Energy and River2Sea, LLC properties would cease following
contaminated soil removal, the City is proposing to continue their development activities by renovating the
boat ramp facility. According to the application package, the City is requesting approval to install a new
access drive that would originate along the northern side of the property. The access drive would extend
toward the west and make a "horseshoe" bend near the launch area and extend back towards Surry Street.
Parking would be provided along the southern side of the parcel and would accommodate twelve (12)
vehicles with trailers. Three additional parking spaces (one for handicap access and two for vehicles
without trailers) would be located along the northern side of the property. The remaining high ground areas
would be converted to green space.
Prior to ramp construction, the applicant proposes to install two new sections of bulkhead along the interior
of the launch area. Approximately 271 linear feet of wall would be installed along the outer edge of the
existing wall and run the entire length of the proposed ramps. The applicant states that the new bulkhead
would be located within the confines of the existing ramp footprint (i.e. no additional wall construction
along the shoreline abutting the river).
According to the applicant, boat ramp improvements would include the construction of two new launch
ramps (25' x 116'), installed approximately 50' landward of the terminal end of the existing ramp.
Reportedly, the ramp extension would reduce the undermining effect cause by strong river currents and
create a sheltered area for boaters during loading and unloading. Prior to ramp construction, the applicant
is proposing to install a temporary cut-off wall/coffer dam approximately 20' waterward of the existing
bulkhead alignment. The coffer dam would be installed so that the area could be dewatered and the new
boat ramp could be cast in place. Approximately 642 cubic yards of material would be excavated below the
Normal High Water (NHW) level in order to remove the existing ramp and concrete debris. Installation of
the new ramp would require placing approximately 261 cubic yards of material below the NHW level.
Upon ramp completion, the temporary coffer dam would be cut along the existing mudline elevation on all
sides and left in place to prevent future scouring. Due to the potential for contaminant leaching into the
CFR, all disturbance below the NHW level would be "capped" with concrete or similar impervious
material. According to the applicant, the top of the cap system would be at the final project depth of -4.5',
relative to Normal Low Water (NLW). Additionally, warning signs (two located on single pilings and one
attached to the docking system) would be placed at the ramp site to ensure that boaters are aware of cut-off
wall.
The ramp itself, would be laid on a slope of 14%, and would extend down to a depth of -4.5', relative to
NLW. Two, 6' wide floating docks (one at 95' in length and one at 115' in length) and one 8' x 92'
floating dock would provide access to the proposed ramp. A small kayak launch would be installed along
the northern side of the northern most boat ramp that would allow access for non-motorized vessels. In
addition, an 8' x 25' "L-shaped" floating dock would be installed along the southern most dock. The L-
Head would be extend towards the south, and encroach within the 15' riparian corridor of River2Sea,
LLC. The City has obtained a waiver from River2Sea, LLC allowing the encroachment.
Lastly, a 10' wide access walkway would be constructed along the City's northern property line that would
run parallel with the property line and extend toward the river. The walkway is shown on the plans as
being a future connection to the City's "Riverwalk". The walkway would stop at the water's edge and
would not extend beyond the property boundaries.
As indicated, all three applicants propose to perform grading and clearing within the 30' Coastal Shoreline
Buffer. In addition, the City is proposing to redevelop a portion of their property within the buffer.
Redevelopment within the buffer would include: a new ramp, handicap parking area, concrete apron, curb
and gutter system and walkway. As previously indicated, this area of the site has been developed and no
additional impacts are being proposed at this time.

With respect to stormwater, both existing and proposed, the City states that untreated stormwater run-off
currently discharges directly into the Cape Fear River. The project proposal would include decreasing the
amount of impervious area on the site from 76% to 60%. As part of the new development scheme,
stormwater run-off would be directed towards the depressed landscape features located between the
entrance and exit drive. Corrugated aluminum pipe "stub-ups" with trash racks would be elevated above
the finished grade to allow infiltration of stormwater into the surrounding soil. Overflow would connect to
the existing storm drain and flow into the river. Given the specific circumstances of the site, a Stormwater
Exclusion would be requested from DWQ for the project. As for the two adjacent properties, the applicants
would be seeking an exemption.
10. ANTICIPATED IWACTS:
Remediation of all three properties would result in the disturbance of approximately 128,502 sq. ft. of high
ground. The proposed boat ramp renovation would result in the excavation of approximately 3,158 sq. ft.
of material from below the Normal High Water level. Additionally, approximately 3,304 sq. ft. of
previously disturbed shallow bottom area would be disturbed as a result of the ramp installation. The dock
construction would incorporate approximately 1,968 sq. ft. of open water area. The construction of the
coffer dam would cause a temporary increase in turbidity; however, no long term impacts are anticipated.

Overview of New Open Water Impacts
Purpose
This project involves the renovation of the Dram Tree Park Boat Ramp in downtown Wilmington
along the Cape Fear River, and the implementation of a Remedial Action Plan to remove
contaminated soils from the boat ramp site and adjacent parcels to the north and south.
Background
The Dram Tree Park Boat Ramp is located at 710 Surry Street, at the western terminus of Castle
Street in Wilmington, NC. This public boating access area is owned by the City of Wilmington
("City") and was originally constructed in 1986 in partnership with the North Carolina Park
Service. The existing site consists of two concrete boat ramps; three timber fixed docks; three
floating docks; three gangways and timber/concrete bulkheads throughout the waterfront of the
site. Other site features include asphalt parking area and drive aisles, wooden boardwalk and
deck equipped with bench seating and site landscaping. A planted Cypress tree and associated
plaque was established at the site in 1989 which serves to mark the historic significance of the
"Dram Tree" - a site where sailors gathered for a dram of rum when entering and leaving the
port of Wilmington.
Due to scouring effects caused by river currents and/or "powerloading" from site users over the
20+ years of the boat ramp facility's existence, the seaward toe of the ramp structure has
subsequently become undermined. With the exposed ramp location along the river bank, strong
currents and water surface activity also present less than ideal loading and unloading conditions
for this site.
The Dram Tree Park Boat Ramp sits on the grounds of an abandoned Manufactured Gas Plant
(MGP) which operated from the mid-1800s until 1952. Due to site contamination of the
underlying soils and groundwater, this site is listed on North Carolina's Inactive Hazardous Sites
List. Since 1991, numerous investigations have been performed at the site to determine the
extent of contamination, as well as evaluate remediation alternatives. A Remedial Action Plan
(RAP) was approved by the NC Department of Environment & Natural Resources (NCDENR) in
June 2009 and plans are in place to initiate the remediation effort in the fall of 2009.
Remediation efforts generally consist of removing contaminated soils and disposing at an offsite
location. Suitable soils will then be trucked in and the area will be graded and stabilized to
approximate existing topographic conditions.

Topographic and hydrographic surveys were performed at this site to effectively evaluate curt I
conditions. Additional site visits were made to familiarize the project team with particular sit S:

Boat Launch Ramps: C)

By gathering detailed elevation data in the vicinity of the boat launch ramps, it became evident
that scour and undermining of the seaward portion of the structure has created steep slopes for
proper vessel launching during low tide conditions. Landward of the bulkhead line, cast-in-place
concrete ramps on a 12.5% slope with v-grooves were observed to be in good condition. This
results in adequate vessel loading conditions during high tide conditions.
Current observed conditions were then compared to As-Built drawings of the site to assist in
understanding the problems that have developed over the years since initial construction in
1986. Original ramp construction below the mean low water line consisted of precast concrete
planks laid parallel to one another and connected with galvanized eye-bolts. On the southern
boat launch, these planks are still in place and visible at low tide. However, scour and
undermining of the planks have created a slope of greater than 30% beyond the bulkhead line,
compared to the As-Built condition of a 15% slope. In addition, without adequate support of the
crushed stone installed with initial construction of the ramp, some planks have broken. This
scour under the planks is believed to be primarily due to high velocity river currents, in
combination with "powerloading" by larger vessels when loading onto the ramp. At the northern
launch ramp, ramp improvements utilizing "fabric-form" concrete appear to have been
performed since initial construction. Although these improvements provide a stable and
consistent surface, current slopes are not ideal for vessel loading/unloading during low tide
conditions.
Aside from the structural deficiencies of the ramp itself, the general layout appears to function
well as a public boating access area. The three floating docks, freestanding out in the river,
provide staging/docking for up to four vessels. The available use of the outside of the floating
docks on the north and south sides of the site allow docking of up to two vessels without
obstructing access to the ramp. Proposed ramp improvements should, therefore, aim to provide
equivalent or better vessel docking space.
Site:
Topographic survey information was collected for the entire parcel to aid in the engineering
design of proposed boat launch modifications, as well as any required site adaptations (such as
utilities) to accommodate the final layout. Present on the existing site are stormwater catch
basins and piping, water lines and power lines. Existing parking capacity consists of 14 car and
trailer spaces, and 1 ADA accessible car space. Parking islands are lined with landscaping,
which consist primarily of 8" Myrtle trees and one Bradford Pear tree.
Generally speaking, the site appears to function well for a boat ramp facility, with efficient traffic
flow provided in only one direction through the site. The drive aisle entering the site is
approximately 29 ft. wide, allowing sufficient room for a parked vehicle along the curb while
preparing a vessel for loading, while another site user can pass along the left side and continue
to the launch ramp location. The drive aisle for exiting the site is approximately 20 ft. wide,
slightly wider than required for vehicle access. This added width allows some flexibility for site
users to tie-down their vessels along the right side of the site without entirely blocking vehicle
access.

Project Description
Boat Ramp Improvements:
Proposed improvements involve the construction of new launch ramps, approximately 50 ft.
landward of their current location. The final improved ramp site would provide a launch area
which is not subject to undermining by the strong river currents experienced out into the river
bank, while also providing a more protected area for vessel loading and unloading.
It is believed that the ramp construction area could be dewatered fairly easily by installing a
temporary cutoff wall (coffer dam) along the perimeter of the excavation area, and allow the
construction of cast-in-place concrete ramps for the length of the boat launch area. Upon
completion of ramp construction, the coffer dam would be cut along the existing mudline
elevation on all sides and left in place to prevent future scour of the ramp structure. Because of
the potential for contaminant leaching into the Cape Fear River, all disturbed area below the
Normal High Water Line will be "capped" with concrete or similar impervious material. The top of
the cap system will be at the final project depth of -4.5 ft. Normal Low Water. Warning signs are
proposed to ensure boaters are aware of this hard structure below the water level.
The reinforced concrete ramp would be laid on a slope of 14%, and would extend down to a
depth of -4.5 ft. NLW. Two 6 ft. wide ground-out floating docks and one 8 ft. wide ground-out
floating dock (all ADA accessible) would provide access to the ramps. North of the most
northern floating dock, a floating kayak launch area would be provided. The increased dock
width in this area is provided in anticipation of joint use by kayak and boat users. On the
southern dock, an "L" shape staging dock is provided. Dock width in this location is 8 ft. due to
the more exposed location and turbulent conditions that can be expected. The increased width
is intended to provide a more stable dock surface for site users. This feature is designed to
provide boat storage for up to three boats, without obstructing access to the launch ramps.
Because depths in the vicinity of the existing ramp will be increased, new bulkheads will be
installed on the north and south sides of the new boat launch ramp area. Also, to alert boaters
of the hardened structure (concrete cap) which will be located at elevation -4.5 Normal Low
Water at the toe of the ramp and extending out to the submerged cutoff wall, three (3) timber
pilings will be installed in this area with warning placards.
Remedial Action Plan:
Contaminated soils will be excavated and removed from the three properties in accordance with
the NCDENR approved Remedial Action Plan (RAP). With a total disturbed area of 2.95 acres
and an average excavation depth of 4 ft. below existing grade, quantity estimates for total
material removed are estimated at 19,000 CY.
To facilitate construction of the new boat launch ramps, some excavation will be required below
the Normal High Water Line. Excavation in this area will be carried out by the installation of a
cutoff wall "coffer dam", which will allow dry excavation. Contaminated soils would then be
removed via land based mechanical means and transported offsite to the approved disposal
location. Upon project completion, all distJ%MlQLqrd of the new launch ramps would

be "capped" with a concrete slab or similar durable, impermeable material that will serve to
ensure future leaching of contaminants into the Cape Fear River is not a concern.
Stormwater Management
Currently, stormwater runoff from the Castle Street Boat Ramp site flows untreated into the Cape
Fear River, which has a stream classification of "SC". This project proposes to decrease the
amount of impervious area on the site from 76% (existing) to 60% (proposed). For the rebuilt
site, stormwater runoff will be directed to depressed landscape areas located between the
entrance and exit drive aisles. Corrugated Aluminum Pipe "stub-ups" with trash racks will be
elevated above finished grade to allow infiltration of stormwater runoff into the surrounding soil
media. Overflow runoff will connect to the existing stormdrain system and flow into the Cape
Fear River. Given the specific circumstances of this site, a Stormwater Exclusion will be
requested from DWQ for the Castle Street Boat Ramp site.
For the two adjacent parcels (River 2 Sea, LLC to south; Progress Energy to north), a stormwater
exemption will be requested from NCDENR-DWQ. Proposed activities will not increase the build-
upon area of these sites and upon project completion they will remain in an undeveloped,
vegetated condition.
Erosion and Sedimentation Control
Sediment runoff from the site during construction will be managed by the construction of
temporary sediment traps, diversion ditches and silt fence. All disturbed areas will be stabilized
by seeding and mulching upon completion of any phase of construction activities. Inlet
protection measures will be placed at all catch basins. Stone rip rap will be used to stabilize all
discharge locations and prevent sediment loss due to scouring effects. A construction entrance
to the project site will be established to prevent tracking or flowing of sediment away from the
site due to construction traffic.

This project will require authorization from the US Army Corps of Engineers.
401 Water Quality Certification
Because this project proposes less than 500 SF of new impact area, this project will not require
a 401 Water Quality Certification. Please see Sheet 10 of 10 for an overview of new impact
areas to open water, as compared to existing site conditions.

Upon project completion, the site will continue to function as a public boating access facility. New boat launching areas will
increase site capacity and provide protection from elements during vessel loading/unloading.
Adjacent properties to the north and south, which are involved in the Remedial Action Plan environmental cleanup, will be
returned to pre-project conditions

of equipment and where it is to be stored.
Standard land based equipment will include a grader, dump trucks, and backhoe. Equipment will be stored on site during
construction project.

Construction of two (2) new concrete boat ramps which will include some upland excavation. Installation of two (2) 6.0' wide
floating docks, one (1) 8' wide floating dock and one (1) floating kayak launch. New bulkheads throughout ramp site.
Excavation beloe MHW will be achieved by installing a coffer dam and removing with land-based equipment.
Concurrent with the proposed site improvements, Siler Services will be excavating and removing contaminated soils on the
boat ramp site, as well as adjoining parcels to the north and south. Suitable fill material will be brought in to bring site to
existing grade elevations.

This letter serves to document that the three underlying property owners (City of Wilmington, Progress
Energy, and River 2 Sea, LLC) are in agreement with the proposed "Remedial Action Plan" and the
proposed improvements to the Castle Street/Dram Tree Park Boat Ramp.
The Remedial Action Plan generally consists of excavating contaminated material and disposing at an
approved off-site location. Clean fill material will then be placed on site and graded to approximate
original elevations. This environmental cleanup will extend across three properties: Progress Energy's
parcel to the north, the City of Wilmington's public boat ramp facility in the middle, and River 2 Sea's
property to the south.
Concurrent with the remediation effort, the City of Wilmington would like to make improvements to the
Dram Tree Park Boat Ramp at the west end of Castle Street. Improvements to this public facility will
generally consist of two new concrete boat ramps, new floating docks, a kayak launch area and timber
bulkheads. The parking area will also be revised to accommodate these improvements.
We understand these activities will require a CAMA Major Permit from the NC Division of Coastal
Management. We also understand that Criser Troutman Tanner Consulting Engineers is acting as the
Authorized Agent for securing the CAMA permit for this project. As demonstrated by our signatures
below, we are in support of this project.

We understand that Progress Energy is in the process of obtaining a permit through the North Carolina
Department of Environment and Natural Resources (NCDENR), Division of Coastal Management (NC DCM) at
a former Manufactured Gas Plant (MGP) site in Wilmington, North Carolina. As part of the permitting process,
the NC DCM is requesting verification that soil removed from the site is suitable for disposal at the Sampson
County Disposal (SCD) Subtitle D Municipal Solid Waste Landfill (MSWL) in Roseboro, NC.
We are aware that a significant amount of subsurface investigation has been conducted at the site. In 2007, an
event profile (SCD E5-7041) was established for soil removed from the site. The soil was characterized with
analytical testing, and the testing results determined all target constituents to be within applicable State, Federal,
and site-specific permit limits.
Additional soil from the site should be acceptable for disposal at SCD. We understand that additional
characterization sampling will be conducted. Carroll Environmental Services, LLC (CES) will review the
analytical data generated during the removal action. Soil exhibiting results below applicable limits (i.e. 3,000
mg/Kg for Total Petroleum Hydrocarbons) will be deemed acceptable for disposal at SCD. I understand that
material that exceeds SCD's limits will be disposed of at another permitted facility.
