Sampson To Whom It May Concern: Please find enclosed seven (7) copies of the referenced application and supporting documents for the proposed fill of 0.142 acres of wetlands at 4733 Vista Lane in Kitty Hawk, NC, Dare County. This lot is under contract for sale to Jeremiah W. and Sara M. Sampson, and the contract will be executed as soon as the needed building permits are obtained. The Department of Public Health of the County of Dare on 4/7/05 provided a Site Review of this lot for the placement of a septic tank and nitrification field, finding the lot suitable for this system. In response to Jeremiah Sampson's recent application fora Wastewater System Construction Permit the County of Dare provided a subsequent Site Review, dated 2/13/07, which indicated that the wetlands needed to be flagged by the Army Corps of Engineers, and a survey obtained to document that a septic system could be placed on the lot. The wetlands were flagged, and Mr. Tom Steffens of the Corps subsequently accepted the alignment. The lot and wetland alignment were surveyed on 2/16/07, and that survey is included as part of this application package. The digital version of the survey was utilized to develop a site plan, which shows that if wetland fill is authorized through this application process, a septic system can be located on the lot. This site plan is also included as part of this application package. In anticipation that wetlands would need to be filled to make this lot suitable for building, an application was made to the NC EEP for mitigation by In-Lieu Fee, for up to 1/10 of an acre under a Nationwide #18 Corps Permit. This request was approved by NC EEP by their letter of 2/20/07, copy enclosed. In that the survey showed the wetlands to extend farther into the lot than first believed, arrangement of a suitable site plan was extremely limited, but could be accomplished with only 1/10' of acre of fill. However, this fill would be limited to an approximate 5 feet perimeter of the structures, and controlling run-off from the proposed development would not be feasible. Because of this, a request for additional fill has been made under the provision of a Nationwide #29 Corps Permit to facilitate the placement of a bulkhead .. at the existing shoreline, with backfill sloped landward to allow storm water to be directed to vegetated swales that will be constructed along the sides of the lot, as indicated on the site plan. While this would result in a marginally greater wetland loss, it would facilitate an overall environmental gain through the ability to control the run-off from the impervious structures that will be constructed on the lot. A subsequent request to NC EEP was made for In-Lieu Fee mitigation for up to 0.142 acres of wetland fill. A copy of this letter is enclosed. When a notice of acceptance is received that supplemental information will be forwarded immediately. The NC Division of Coastal Management (DCM) was contacted on 2/21 /07 concerning this proposed development. In a conversation with the Coastal Management Representative for this geographic area, Ms. Lynn Mathis, she indicated that there is no CAMA or DCM jurisdiction along the pond of Bull Ridge Swamp. Commencement of construction is awaiting the obtaining of the necessary permits. A check for the fee in the amount of $200.00 is enclosed. Prior Project History If jurisdictional determinations and/or permits have been requested and/or obtained for this project (including all prior phases of the same subdivision) in the past, please explain. Impact Justification (Avoidance and Minimization) Specifically describe measures taken to avoid the proposed impacts. It may be useful to provide information related to site constraints such as topography, building ordinances, accessibility, and financial viability of the project. The applicant may attach drawings of alternative, lower-impact site layouts, and explain why these design options were not feasible. Also discuss how impacts were minimized once the desired site plan was developed. If applicable, discuss construction techniques to be followed during construction to reduce impacts. Inability to fill wetlands on nei hg boring lots forces extremely limited area for septic system, which drives other development to back extreme of lot. Odd shape of lot, with "V" shaped shoreline limits options for dwelling and Town-required parking space placement because of setback restrictions. This historically platted lot is approximately 4000 sq. ft. smaller than currently required lot size, and financial viability of development, limited to 35% of lot size, drives structures to limits of setbacks, requiring additional wetland fill to maintain structural integrity of development. Reducing impacts for requested Nationwide 18 fill will be limited to the installation of silt-fence at extremes of wetland fill, and followed by seeding for stabilizing vegetation at end of construction. This will not be able to control run-off from constructed impervious surfaces to the adjacent pond. If remainder of wetlands is authorized to be filled under Nationwide 29, a bulkhead would be constructed along the shoreline, and the filled area sloped toward the front of the lot and toward sided vegetated swales to reduce direct run-off and provide for percolation, with direct run-off flowing to the pond onlYin excessive storm events. VIII. Mitigation DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC Division of Water Quality for projects involving greater than or equal to one acre of impacts to freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial streams. USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide Permits, published in the Federal Register on January 15, 2002, mitigation will be required when necessary to ensure that adverse effects to the aquatic environment are minimal. Factors including size and type of proposed impact and function and relative value of the impacted aquatic resource will be considered in determining acceptability of appropriate and practicable mitigation as proposed. Examples of mitigation that may be appropriate and practicable include, but are not limited to: reducing the size of the project; establishing and maintaining wetland and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of aquatic resource functions and values by creating, restoring, enhancing, or preserving similar functions and values, preferable in the same watershed. If mitigation is required for this project, a copy of the mitigation plan must be attached in order for USACE or DWQ to consider the application complete for processing. Any application lacking a required mitigation plan or NCEEP concurrence shall be placed on hold as incomplete. An applicant may also choose to review the current guidelines for stream restoration in DWQ's Draft Technical Guide for Stream Work in North Carolina, available at lam://h2o.enr.state.nc.us/ncwetlands/strmgide.hhnl. Page 10 of 13 1. Provide a brief description of the proposed mitigation plan. The description should provide as much information as possible, including, but not limited to: site location (attach directions and/or map, if offsite), affected stream and river basin, type and amount (acreage/linear feet) of mitigation proposed (restoration, enhancement, creation, or preservation), a plan view, preservation mechanism (e.g., deed restrictions, conservation easement, etc.), and a description of the current site conditions and proposed method of construction. Sampson Dear Mr. Steffens: Please find enclosed the referenced application and supporting documents for the proposed fill of 0.142 acres of wetlands at 4733 Vista Lane in Kitty Hawk, NC, Dare County. This lot is under contract for sale to Jeremiah W. and Sara M. Sampson, and the contract will be executed as soon as the needed building permits are obtained. The Department of Public Health of the County of Dare on 4/7/05 provided a Site Review of this lot for the placement of a septic tank and nitrification field, finding the lot suitable for this system. In response to Jeremiah Sampson's recent application for a Wastewater System Construction Permit the County of Dare provided a subsequent Site Review, dated 2/13/07, which indicated that the wetlands needed to be flagged by the Army Corps of Engineers, and a survey obtained to document that a septic system could be placed on the lot. The wetlands were flagged, and you subsequently accepted the alignment. The lot and wetland alignment were surveyed on 2/16/07, and that survey is included as part of this application package. The digital version of the survey was utilized to develop a site plan, which shows that if wetland fill is authorized through this application process, a septic system can be located on the lot. This site plan is also included as part of this application package. In anticipation that wetlands would need to be filled to make this lot suitable for building, an application was made to the NC EEP for mitigation by In-Lieu Fee, for up to 1/10 of an acre under a Nationwide #18 Corps Permit. This request was approved by NC EEP by their letter of 2/20/07, copy enclosed. In that the survey showed the wetlands to extend farther into the lot than first believed, arrangement of a suitable site plan was extremely limited, but could he accomplished with only 1/10"' of acre of fill. However, this fill would be limited to an approximate 5 feet perimeter of the structures, and controlling run-off from the proposed development would not be feasible. Because of this, a request for additional fill has been made .~ ~ ~ ~ ~ ~ under the provision of a Nationwide #29 Permit to facilitate the placement of a bulkhead at the existing shoreline, with backfill sloped landward to allow storm water to be directed to vegetated swales that will be constructed along the sides of the lot, as indicated on the site plan. While this would result in a marginally greater wetland loss, it would facilitate an overall environmental gain through the ability to control the run-off from the impervious structures that will be constructed on the lot. A subsequent request to NC EEP was made for In-Lieu Fee mitigation for up to 0.142 acres of wetland fill. A copy of this letter is enclosed. When a notice of acceptance is received that supplemental information will be forwarded immediately. The NC Division of Coastal Management (DCM) was contacted on 2/21 /07 concerning this proposed development. In a conversation with the Coastal Management Representative for this geographic area, Ms. Lynn Mathis, she indicated that there is no CAMA or DCM jurisdiction along the pond of Bull Ridge Swamp.
