KCI Associates of North Carolina, P.A. is happy to be applying for a 401/Wetland and Neuse River
Riparian Buffer permit to develop four Lots on the 3.56 acre Site on behalf of the owner Mr. Wayne
Timberlake. The site is located off of Lakewood Drive and surrounded by the Springdale Subdivision.
The subdivision was developed in accordance with the City of Raleigh requirements and the National Fire
Code.
We are applying to fill part of an unnamed tributary to Hare Snipe Creek as well as impacting part of
Zone 1 and Zone 2 in the Neuse River Riparian Buffer area to construct a cul-de-sac and install an 8-inch
sanitary sewer line. Construction of the cul-de-sac will impact 141 linear feet (912 sq. ft.) of perennial
stream along Tributary # 1 by the installation of a 48-inch RCP with end walls and subsequent impacts to
Zone 1 (9,395 sq. ft.) and Zone 2 (3,813 sq. ft.) of the NRRB. Additional impacts to Zone 2 (2,013 sq. ft.)
will result due to the installation of the 8-inch sanitary sewer on Lot 2 and one 4-inch sanitary sewer
service for Lot 1.
Enclosed are 6 permit applications two with Full Size Plans and the remaining four plans are provided
with 11 x 17 sheets. An extra copy is provided for Annette Lucas. Attached is a check for $240.00 made
out to the NC DWQ to cover the fees for filling less than 150-ft of stream channel. We look forward to

3. Project Description
3a. Describe the existing conditions on the site and the general land use in the vicinity of the project at the time of this
application:
The undeveloped forested 3.56-acre Wayne Timberlake Springdale Water Co. Well Site No. 8 is surrounded by the
Springdale Subdivision. The site is predominately upland and vegetated with Broadleaf Deciduous Forest Land Species.
The lower area of the site along Hare Snipe Creek is comprised of Bottomland and Wet Hardwoods Species. Unnamed
Tributaries # 1 and 2 flow across the site from the north to the west before entering Hare Snipe Creek. Access to the site
is from Lakewood Drive east of Hare Snipe Creek onto a 12-ft.wide gravel road that crosses Tributary # 1 at an existing
36" RCP. The road once provided access to three 6' wells that provided water to the surrounding Springdale Subdivision.
The subdivision now receives their water from the City of Raleigh (COR).

3d. Explain the purpose of the proposed project:
The project proposes to develop four residential lots with sewer and water that blends in with the character of the
subdivision in an area zoned R2. Each lot is designed to have a buildable area of 4,500 sq. ft. for the dwelling and
driveway. The subdivision will tie into the City sewer along Hare Snipe Creek which runs along the western property line.
3e. Describe the overall project in detail, including the type of equipment to be used:
Four residential lots are proposed for this 3.56-acre Site. Access to each lot will be provided from Lakewood Drive by
constructing a public street with curb and gutter that terminates in a cul-de-sac. Stormwater will be collected and directed
down two 20-ft wide drainage easements located between Lots 1 and 2 and Lots 3 and 4. The stormwater will be
discharged into a grassed swale directed to a level spreader prior to entering Zone 2 of the NRRB. The level spreader
was designed for a 10-year storm event instead of just the first 1 inch of runoff. The COR is requiring that an 8-inch
gravity sanitary sewer be constructed within a 20-ft sewer easement on Lot 2 for a potential future public connection to
the existing Springdale Subdivision. This area along Tributary # 1 is the only area suitable for a gravity system.
A trackhoe, small dozer and dump trucks will be used in the construction of the cul-de-sac. The trackhoe will be used to
excavate a diversion channel as needed, excavate the soil for the 48-inch culvert and end walls, lay the new 48-inch
RCP, and fill the area to establish a firm base. A sheepsfoot roller will compact the soil to the proper density. A trackhoe
and dozer will also be used to install the 8-inch sewer on Lot 2 by clearing the 20-ft sanitary sewer easement, installing
the 8-inch sewer pipe, restoring the ground surface to original grade and planting grass.

sewer on Lot 2 and one 4-inch sanitary sewer service for Lot 1. The COR has an area dedicated for a future greenway,
but permitting will be handled directly by the City and is not included in this permit application.

D. Impact Justification and Mitigation
1. Avoidance and Minimization
1a. Specifically describe measures taken to avoid or minimize the proposed impacts in designing project.
Development of this site was challenging due to the three perennial streams, the NRRB, flood hazard soils and areas set
aside for the COR greenway and tree conservation area. The engineer located four residential lots served with City water
and sewer, public street access and fire protection services, and minimized the amount of stream and buffer areas
impacted. The subdivision was designed in accordance with the COR requirements and the National Fire Code.
The engineer designed the four lots in accordance with the minimum standards required by the COR for public street
access and fire protection. The COR specified minimum size of the cul-de-sac bubble but, the engineer was able to keep
the proposed impacts to Tributary # 1 to 141 linear feet. The level spreaders are designed for a 10-year storm instead of
the first 1-inch of runoff to provide a greater degree of protection for Tributary # 1 and Hare Snipe Creek. The level
spreaders will be located 30 to 80 feet from Zone 2 of the riparian buffer as an additional step to provide diffuse flow to
the buffers along Hare Snipe Creek. The proposed crossing on Tributary # 1 will be installed at the existing crossing to
take advantage of the previous impacts.

Ron Sechler, National Marine Fisheries Services said there is no essential Fish Habitat impaired by the project.
Additionally, no fish habitat due to previous construction of sewer piping by the City of Raleigh.

On Wednesday October 28, 2009 Delores Hall State Archeologist sent an email stating that she checked her maps and
files and stated that they have no recorded archeological site within the project boundaries. Although the area has never
been surveyed for archeological sites, there is a low probability that any significant sites would be within the project
boundaries. Delores said we would not recommend any survey if we reviewed this project area. I have not heard from
Historic Resourses but there are no structures on the lot in the Springdale Subdivision.
