It is issued to N.C. Division of Water Resources to dredge 529,000 cubic yards of material in Dare County pursuant to an application filed on the 15' day of December 1998 to conduct maintenance dredging in Roanoke Sound and Shallowbag Bay. The application provides adequate assurance that the discharge of fill material into the waters of Roanoke Sound and Shallowbag Bay in conjunction with the proposed development will not result in a violation of applicable Water Quality Standards and discharge guidelines. Therefore, the State of North Carolina certifies that this activity will not violate the applicable portions of Sections 301, 302, 303, 306, 307 of PL 92-500 and PL 95-217 if conducted in accordance with the application and conditions hereinafter set forth. This approval is only valid for the purpose and design that you submitted in your application, as described in the Public Notice. If you change your project, you must notify us and send us a new application for a new certification. If the property is sold, the new owner must be given a copy of the Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for this project (now or in the future exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h) (6) and (7). For this approval to be valid, you must follow the conditions listed below. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion control, Coastal Stormwater, Non-discharge and Water Supply watershed regulations. Condition(s) of Certification: Appropriate sediment and erosion control practices which equal or exceed those outlined in the most recent version of two manuals. Either the "North Carolina Sediment and Erosion Control Planning and Design Manual" or the "North Carolina Surface Mining Manual" (available from the Division of Land Resources in the DEHNR Regional or Central Offices). The control practices shall be utilized to prevent exceedances of the appropriate turbidity water quality standard (50 NTUs in all fresh water streams and rivers not designated as trout waters; 25 NTUs in all lakes and reservoirs, and all saltwater classes; and 10 NTUs in trout waters); 2. All sediment and erosion control measures placed in wetlands or waters shall be removed and the natural grade restored after the Division of Land Resources has released the project; 3. Measures shall be taken to prevent live or fresh concrete from coming into contact with waters of the state until the concrete has hardened; 4. Should waste or borrow sites be located in wetlands or other waters, compensatory mitigation will be required since it is a direct impact from road construction activities; x 5. A minimum two foot free board shall be maintained in all upland diked disposal sites at all times. 6. A post-dredging survey shall be submitted to DWQ's Washington Regional Office within 30 days of the completion of the project. 7. Dredging depth must be maintained at a depth of twelve feet for the Manteo to Wanchese channel and 10 feet for the North channel. A maximum of two foot overdredge is allowable for this project. Violations of any condition herein set forth shall result in revocation of this Certification and may result in criminal and/or civil penalties. This Certification shall become null and void unless the above conditions are made conditions of the Federal 404 and/or coastal Area Management Act Permit. This Certification shall expire upon expiration of the 404 or CAMA permit. If this Certification is unacceptable to you have the right to an adjudicatory hearing upon written request within sixty (60) days following receipt of this Certification. This request must be in the form of a written petition conforming to Chapter 150B of the North Carolina General Statutes and filed with the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. If modifications are made to an original Certification, you have the right to an adjudicatory hearing on the modifications upon written request within sixty (60) days following receipt of the Certification. We are considering authorizing the proposed activity pursuant to Section 404 of the Clean Water Act, and we have determined that a water quality certification is required under the provisions of Section 401 of the same law. A Department of the Army permit will not be granted until the certification has been obtained or waived. In accordance with our administrative regulations, in most cases, 60 days after receipt of a request for certification is a reasonable time for State action. This maintenance will provide safe navigation for boats and ships, including the Elizabeth II, the State historic ship which draws approximately 8.5 feet of water. The locations of these channels are shown in Figure 1. Complete dredging of the Manteo to Wanchese channel was last done in 1985; partial dredging of the North channel was done in 1989; and shoals in both channels were dredged in 1994. Use The Manteo to Wanchese and North Navigation Channels are used by the Elizabeth II, recreational power and sailboats, fishing boats, and tour and party boats. Dare County is trying to attract some of the boats and ships traveling the Intercoastal Waterway from the Alligator River Channel to the North and Manteo to Wanchese Channels. The maintenance of these two channels is critical to this effort. It is also critical for,the efficient operation and sailing of the Elizabeth II, which has been hitting bottom when trying to use these channels. The Manteo to Wanchese and North channels were authorized to be 12 feet and 10 feet deep, mean low water, respectively. For the past 14 years, however, the State has maintained the Manteo to Wanchese Channel to 10 feet deep, and the North Channel to 9 feet. The proposed dredging would deepen the Manteo to Wanchese channel to 12 feet, and the North Channel to 10 feet. The current controlling depths of these two channels are approximately 6.0 feet and 5.0 feet, mean low water, respectively. Methods of Construction The maintenance dredging of these two channels will be accomplished using a hydraulic dredge with a cutter head that breaks up the bottom so that it can be transported in a slurry through a pipeline. The disposal site for material pumped from the North Channel (and possibly a portion of the Manteo to Wanchese Channel south of the Highway 64-264 Bridge) will be to Nags Head beach. The pipeline will pass under major highways through culverts. See Figures 2 through 7. The disposal site for material from the Manteo to Wanchese Channel will be high ground diked areas located on Roanoke Island shown in Figures 8 through 13. Volumes of the high ground sites are listed in Table 1. The water in the pipeline will drain into the ocean during beach disposal and drain into either Shallowbag Bay or Croatan Sound during high ground disposal. The material placed on the beach will be shaped by a bulldozer to create a berm approximately 75 wide as shown in Figure 7. The material placed in the high ground disposal areas, after the water in these areas is allowed to drain away, will be mixed with the sandy material in the dikes and then leveled and seeded.
