Greensboro, Guilford County, North Carolina Dear Mr. Wright: Westminster Homes, Inc. purchased the property formerly owned by Weaver Investment known as Brassfield, and has completed the development as Saddle Creek Subdivision. During the development of the project various storm sewer lines were installed in accordance with the approved construction plans and in keeping with the wetlands impact delineation exhibits previously submitted. In April 1996 we extended a 36-inch storm sewer line in the area of the rear of lots 73 and 74 to eliminate an unsightly and erosive bankslope. At that time an additional 7,654 square feet of wetlands were impacted and your office approved the impacts (see enclosed attachment). This area continues to be a highly erosive area and a major washout has occurred at the terminus of the newly installed 36-inch storm sewer line. Westminster Company's buyer of lot 72 has contacted them on numerous occasions to complain of erosion problems, as well as potential hazards for the neighborhood children in light of the size of the washout. It is for this reason we hereby request an additional extension of this 36-inch storm sewer line. This will impact an additional 2,593 square feet of wetlands beyond the total which was previously approved. I have included for your use our proposed extension exhibit and copies of the previous exhibits and ask that you consider this matter for approval. We will be glad to meet onsite with a representative of your office, or from the regional office, to further review and discuses the situation and request. Preston Howard, Jr., P.E., Director ENVIRONMENT AND NATURAL RESOURCES February 15, 1999 Guilford County DWQ Project # 981035 APPROVAL of 401 Water Quality Certification and ADDITIONAL CONDITIONS Westminster Homes, Inc. 2706 North Church Street Greensboro, NC 27405 Dear Sirs: You have our approval, in accordance with the attached conditions and those listed below, to place fill material in 60 feet of streams for the purpose of constructing a road crossing at Saddle Creek subdivision, as you described in your application dated December 23, 1998. After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 3108. This certification allows you to use Nationwide Permit Number 26 when the Corps of Engineers issues it. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply Water shed regulations. This approval will expire when the accompanying 404 or CAMA permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application except as modified below. If you change your project, you must notify us and you may be required to send us a new application.. If the property is sold, the new owner must be given a copy of this Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H.0506 (h) (6) and (7). For this approval to be valid, you must follow the conditions listed in the attached certification and any additional conditions listed below. 1. Deed notifications or similar mechanisms shall be placed on all lots with remaining jurisdictional wetlands and waters to notify the state in order to assure compliance for future wetland and/or water impact. These mechanisms shall be put in place within 30 days of the date of this letter or the issuance of the 404 Permit (whichever is later). 2. The invert of the culvert shall be buried in the substrate to a depth of at least 6" to allow aquatic life movement. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition, which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611- 7447. This certification and its conditions are final and binding unless you ask for a hearing. This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. If you have any questions, please telephone John Dorney at 919-733-1786. All wetland information in these documents has been taken from a wetland boundary prepared by Evans Engineering on December 9, 1991. This boundary was based on a wetland delineation performed by the U.S. Army Corps of Engineers. Approximately 0.06 acres of wetlands is proposed to be disturbed for extending an existing 36" storm sewer line. This extension and its wetland impacts are shown on an enclosed exhibit. In April of 1996 we extended a 36" storm sewer line at the rear of lots 73 and 74 to eliminate an unsightly and highly erosive bankslope. At that time we received approval for additional impacts of 0.18 acres (see NWP 26 Action ID 199200729). This area continues to be highly erosive and a major washout has occurred at the terminus of the newly installed 36" storm sewer line. Westminster Company's buyer of lot 72 has contacted them numerous occasions to complain of erosion problems, as well as potential hazards for the neighborhood children in light of the size of the washout. The U.S. Army Corps of Engineers has already approved this request for additional impacts (see NWP 26 Action ID 199920073). On behalf of Westminster Homes, Inc., we are requesting approval from your office for an additional wetland impact of 0.06 acres for a 60' extension of the existing 36" storm sewer line. Due to the severity and danger of this erosion problem we would suggest a site meeting so you can better understand the nature of the problem before reviewing the permit application.
