Judge issues stay of Alcoa permit

A state administrative law judge issued a temporary stay of a water-quality permit that had been issued to Alcoa Power Generating Inc.
earlier this month.
The permit from the N.C. Division of Water Quality was the last step needed before Alcoa was issued a federal license to operate four
reservoirs, including High Rock Lake in Davidson County, along the Yadkin River.
The Yadkin Riverkeeper and Stanly County appealed the permit in a state administrative-law court, which held a hearing last
Wednesday. Both asked for a temporary stay of the permit, citing concerns of contamination in Badin Lake. Gov. Bev Perdue filed a
friend-of-the-court brief supporting the temporary stay.
Stanly County officials have said they are concerned about contamination from a now-closed smelting plant that Alcoa operated in
Badin until 2002.
Dean Naujoks, the Yadkin Riverkeeper, filed a 13-page petition that said that state environmental
officials failed to follow the requirements of the federal Clean Water Act and state laws when the water-quality division issued the
permit.
