agreement that this fee is an eligible project cost and the cost can be included in the 5
sharing agreement for this project. _
The Town of Cary is handling the payment of all oos% for the project, with the Departn je

APPROVAL of 401 Water Quality Certification and ADDITIONAL CONDITIONS, WRP

Dear Sirs:
You have our approval, in accordance with the attached conditions and those listed below, to place fill material in
of waters for the purpose of constructing a recreational lake at Silverton Community in Cary in Wake County, as
you described in your application dated 13 April, 1999. After reviewing your application, we have decided that this
fill is covered by General Water Quality Certification Number 3108. This certification allows you to use
Nationwide Permit Number 26 when the Corps of Engineers issues it. In addition, you should get any other federal,
state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion
Control, Coastal Stormwater, Non-Discharge and Water Supply Watershed regulations. This approval will expire
when the accompanying 404 or CAMA permit expires unless otherwise specified in the General Certification.
This approval is only valid for the purpose and design that you described in your application except as
modified below. If you change your project, you must notify us and you may be required to send us a new
application for a new certification. If the property is sold, the new owner must be given a copy of this Certification
and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for this
project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC
2H .0506 (h). For this approval to be valid, you must follow the conditions listed in the attached certification and
any additional conditions listed below.
1. Deed notifications or similar mechanisms shall be placed on all lots with remaining jurisdictional wetlands and waters or areas
within 50 feet of all streams and ponds to notify the state in order to assure compliance for future wetland and/or water impact.
These mechanisms shall be put in place within 30 days of the date of this letter or the issuance of the 404 Permit (whichever is
later).
We understand that you have chosen to contribute to the Wetland Restoration Program in order to compensate
for these impacts to wetlands and/or streams. In accordance with 15A NCAC 2R.0402, this contribution will
satisfy our compensatory mitigation requirements under 15A NCAC 211.0506(h). According to 15A NCAC 2H
.0506(h), feet of restoration will be required. Until the Wetland Restoration Program receives and clears your check
(made payable to: DEHNR - Wetland Restoration Program), wetland or stream fill shall not occur. Mr. Ron Ferrell
should be contacted at 919-733-5083 ext. 358 if you have any questions concerning the Wetland Restoration
Program. You have one month from the date of this Certification to make this payment. For accounting purposes,
this Certification authorizes the fill of 226 feet of streams, in 030402 river and subbasin and 226 feet of
stream restoration are required. Please be aware that the Wetland Restoration Program (WRP) rules
require rounding of acreage amounts to one-quarter acre increments (15A 2R.0503(b)).
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You
must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which
conforms to Chapter 150B of the North Carolina General Statutes to the Office of
Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 276 1 1-7447. This certification and its conditions are final
and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act.

linear feet of channel impact resulting from construction of Silverton Lake. The property

NC (see Site Vicinity Map). The impacts are illustrated on the attached site plan and
summarized in Table 1.

'Channel impacts resulting from flooding have not been counted toward the project total.
Note that the project has been reviewed by John Dorney of DENR-DWQ with regard to
the Neuse Basin Rules and that a copy of the "Approval of Neuse Basin Rules" letter has
been attached.
Finally, our client is aware that mitigation may be required for impacts resulting from the
dam/ road crossing construction process and that the USACE now requires projects of
this nature to submit a plan to mitigate as part of the permit application. At this time, the
plan for mitigation is to submit appropriate payment to the Wetland Restoration Fund.

You have our approval, in accordance with the attached conditions, to construct a pond, as you
described in your application dated May 3, 1998. After reviewing your application, we have decided that
this project is covered by the Neuse River buffer rules (15A NCAC 2B .0233). In addition, you should get
any other federal, state or local permits before you go ahead with your project including (but not. limited to)
Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply Watershed
regulations.
This approval is only valid for the purpose and design that you described in your application. If
you change your project, you must notify us and send us a new application. If the property is sold, the new
owner must be given a copy of this approval letter and is thereby responsible for complying with all
conditions.
If you do not accept any of the conditions of this approval, you may ask for an adjudicatory
hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a
written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of
Administrative Hearings, P.O. Box 27447, Raleigh, NC 27611-7447. This approval and its conditions are
final and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under the Neuse River buffer

Please find attached a plan for the construction of a new recreational
lake at the Silverton Community in Cary. The plans for this dam were
prepared by Bass, Nixon & Kennedy, Inc., in 1987 and approved by the
Town of Cary on November 30, 1993. A permit to construct the
impoundment was obtained from State Dam Safety Office on May 2, 1997.
A Nationwide Permit 26 was obtained from the Corps of Engineers on
January 23, 1997, to impact 0.30 acres of wetland inundated by the
project. A 401 Water Quality Certification was not required for the
project.
The project is currently out for bid and construction should begin by
June, 1998. The area inundated by the impoundment includes riparian
buffers as described in the new Neuse River Nutrient Sensitive Waters
Management Strategy Rules. It is our understanding these new
regulations prohibit the construction of this facility. Please review
the time line associated with the design and approval of this dam, and
let us know what options we have, if any, regarding the construction of
this facility.

Parkway with a condition pertaining to future sidewalk location.
Per our conversation on November 24, 1993, I had indicated that
the Cary Town Council will soon be considering where future
installations for sidewalk along Cary Parkway will be installed.
Therefore, the plans are approved with the condition that
sidewalk may need to be located and constructed on the opposite
side (outer section) of Cary Parkway contingent upon the final
ruling by the Cary Town Council.
I hope this letter will be sufficient for documentation
indicating the final approval for Cary Parkway plans through
Silverton PUD and the installation of future sidewalk along the
portion of Cary Parkway.

This is in response to your submissions received April 26,
May 1 and June 16, 1989, September 4, 1991, July 19, 1995 and
December 23, 1996 of plans, specifications and design data for
the construction of the subject dam in Wake County on an unnamed
tributary to Crabtree Creek in compliance with the Dam Safety Law
of 1967. These plans, specifications and design data have been
prepared under the supervision Mr. Don C. Kennedy, P.E. of Bass,
Nixon & Kennedy, Inc. Also, Check No. 3036 for $200.00 serving
as the minimum application processing fee was also received on
August 3, 1995.
This letter constitutes approval of the proposal to
construct the subject dam according to the plans and
specifications received by this Division on the above dates with
the following stipulations:
1. Project construction shall be supervised by Mr. Don C.
Kennedy, P.E.
2. During construction, the Division of Land Resources may
require such progress reports as are deemed necessary.
3. Upon completion of the project, Mr. Don C. Kennedy, P.E.
shall inspect the completed work and upon finding (a) that
the work has been done as specified and (b) that the dam is
safe, shall file with the Division of Land Resources two
sets of "as-built" drawings and a certificate saying that
the work has been completed in accordance with approved
plans, specifications and other requirements.

4. A flexible, waterproof gasket shall be installed between the
anti-seep collar and the sanitary sewer pipe going through
the anti-seep collar.
5. A dam operation and maintenance plan and an emergency action
plan for the dam shall be submitted with the As-Built
drawings.
6. No water shall be impounded behind the dam until an approval
to impound is issued by the Division of Land Resources for
operation of this dam.
7. You must notify Mr. John Holley, P.E., Regional Engineer,
Land Quality Section, DEHNR, P.O. Box 27687, Raleigh, North
Carolina 27611, [phone] ten days before the start of
construction.

I am enclosing a copy of a cost certification form and an
explanation of the final processing fee calculation. An
additional fee will be required when the engineer's certification
is, submitted if the construction cost exceeds $10,001.00. In any
event, the cost certification must be completed and returned with
the engineer's certification before an approval to impound can be

The Dam Safety Law of 1967 requires that project
construction commence within one year from the date of this
approval, or the approval is void.

material within waters of the United States, impacting a total of
0.30 acre of waters, adjacent to, and above the headwaters of, an

b. A 30-day notification to the District Engineer (DE) is required if
the discharge would cause the loss of water of the U.S. greater than one acre.
For discharges in special aquatic sites, including wetlands, the notification
must include a delineation of affected special aquatic sites including
wetlands.
c. The discharge, including all attendant features, both temporary and
permanent, is part of a single and complete project.
STATE CONSISTENCY CONDITIONS
a. All fill material authorized by this permit must be obtained from an
upland source.
b. Use of this nationwide permit for waste disposal facilities is not
authorized.
C. If the proposed activity is within the North Carolina Coastal Area
and the activity will result in the loss of waters of the United States
greater than 1/3 of an acre, the applicant must receive written concurrence
from the North Carolina Division of Coastal Management (NCDCM) that the
activity is consistent with the North Carolina Coastal Management Program.
d. Should all or part of a proposed activity be located within an Area
of Environmental Concern (AEC) as designated by the North Carolina Coastal
Resources Commission, a Coastal Area Management Act (LAMA) permit is required
from the North Carolina Division of Coastal Management (NCDCM). Should an
activity within or potentially affecting an AEC be proposed by a Federal
agency, a consistency determination pursuant to 15 CFR 930 must be provided to
the NCDCM at least 90 days before the onset of the proposed activity.
GENERAL CERTIFICATION CONDITIONS
a. General Certification is denied for fills greater than one area in
SA, trout, HQW, ORW,.WS-I and WS-II watersheds. General certification is
issued for all other waters for fills of not more than 10 acres and in those
watersheds specified above for fills of not more that one acre.
b. Proposed fill or substantial modification of greater than one-third
of an acre of such waters, including wetlands, requires a written concurrence
from the North Carolina Division of Environmental Management (NCDEM).
c. Established sediment and erosion control practices will be utilized
to prevent violations.of the appropriate turbidity water quality standard (50
NTU's in streams and rivers not designated as trout waters by the North
Carolina Division of Environmental Management (NCDCM), 25 NTU's in all
saltwater classes and all lakes and reservoirs and 10 NTU's in trout waters).
GENERAL CONDITIONS
1. I-avigation. No activity may cause more than a minimal adverse effect on navigation.
2. Proper Maintenance. Any structure or fill authorized shall be properly maintained, including maintenance to ensure public
s.
3. Erosion and Siltation Controls. Appropriate erosion and siltation controls must be used and maintained in effective
operating condition during construction, and all exposed soil and other fills must be permanently stabilized at the earliest
practicable date.
4. Aquatic Life Movements. No activity may substantially disrupt the movement of those species of aquatic life indigenous to
the waterbody, including those species which normally migrate through the area, unless the activity's primary purpose is to
impound water.
5. Equipment. Heavy equipment working in wetlands must be placed on mats or other measures must be taken to minimize soil
6. Regional and Case-by-Case Conditions. The activity must comply with any regional conditions which may have been added
by the Division Engineer and any case specific conditions added by the Corps.
7. Wild and Scenic Rivers. No activity may occur in a component of the-National Wild and Scenic River System: or in a river
officially designated by Congress as a "study river" for possible inclusion in the system, while the river is in an official study
status. Information on Wild and Scenic Rivers may be obtained from the National Park Service and the U.S. Forest Service.
8. Tribal Rights. No activity or its operation may impair reserved tribal rights, including, but not limited to, reserved water
rights and treaty fishing and huntin fights.
9. Water Quality Certification. In certain states, an individual state water quality certification must be obtained or waived.
10. Coastal Zone Management. In certain states, an individual state coastal zone management consistency concurrence must be
obtained or waived.
11. Endangered Species. No activity is authorized under and NWP which is likely to jeopardize the continued existence of a
threatened or endangered species or a species proposed for such designation, as identified under the Federal Endangered Species
Act, or which is likely to destroy or adversely modify the critical habitat of such species. Non-Federal permittees shall notify the
District Engineer if any listed species or critical habitat -might be affected or is in the vicinity of the project and shall not begin
work on the activity until notified by the District Engineer that the requirements of the Endangered Species Act have been
satisfied and that the activity is authorized. Information on the location of threatened and endangered species can be obtained
from the U.S. Fish and Wildlife Service and National Marine Fisheries Service.
12. Historic Properties. No activity which may affect Historic Properties listed, or eligible for listing, in the National Register
of Historic Places is authorized, until the District Engineer has complied with the provisions of 33 CFR 325, Appendix C. Tile
prospective permittee must notify the District Engineer if the authorized activity may affect any historic properties listed,
determined to be eligible, or which the prospective permittee has reason to believe may be eligible for listing on the National
Register of Historic Places, and shall not begin the activity until notified by the District Engineer that the requirements of the
National Historic Preservation Act have been satisfied and that the activity is authorized.
Information on the location and existence of historic resources can be obtained from the State Historic Preservation Office and
the National Register of Historic Places (see 33 CFR 330.4 (g)).
13. Water Supply Intakes. No discharge of dredged or fill material may occur in the proximity of a public water supply intake
except where the discharge is repair of the public water supply intake structure or adjacent bank stabilization.
14. Shellfish Production. No discharge of dredged or fill material may occur in areas of concentrated shellfish production,
finless the discharge is directly related to a shellfish harvest activity authorized by nationwide permit.
15. Suitable Material. No discharge of dredged or fill material may consist of unsuitable material (e.g. trash, debris, car bodies,
:tc.) and material discharged must be free from toxic pollutants in toxic amounts.
16. Mitigation. Discharges of dredged or fill material into waters of the United States must be minimized or avoided to the
naximum extent practicable at the project site (i.e., on-site), unless the District Engineer has approved a compensation mitigation
plan for the specific regulated activity.
17. Spawning Areas. Discharges in spawning areas during spawnine seasons must he avnirlerl to the maximum PYtPnt
)racticable. -
18. Obstructions of High Flows. To the maximum extent practicable, discharges must not permanently restrict or impede the
assage of normal or expected high flows or cause the relocation of the water (unless the primary purpose of the fill is to
npound waters).
19. Adverse Impacts from Impoundments. If the discharge creates an impoundment of water, adverse impacts on the aquatic
ystem caused by the accelerated passage of water and/or the restriction of its flow shall be minimized to the maximum extent
racticable.
20. Waterfowl Breeding Areas. Discharges into breeding areas for migratory waterfowl must be avoided to the maximum
rtent practicable.

buffer rules (15A NCAC 2B .0233). In addition, you should get any other federal, state or local permits

Stormwater, Non-Discharge and Water Supply Watershed regulations. This approval replaces one issued on
May 1998.

Please find attached a plan for the construction of a new recreational
lake at the Silverton Community in Cary. The plans for this dam were
prepared by Bass, Nixon & Kennedy, Inc., in 1987 and approved by the
Town of Cary on November 30, 1993. A permit to construct the
impoundment was obtained from State Dam Safety Office on May 2, 1997.
A Nationwide Permit 26 was obtained from the Corps of Engineers on
January 23, 1997, to impact 0.30 acres of wetland inundated by the
project. A 401 Water Quality Certification was not required for the
project.
The project is currently out for bid and construction should begin by
June, 1998. The area inundated by the impoundment includes riparian
buffers as described in the new Neuse River Nutrient Sensitive Waters
Management Strategy Rules. It is our understanding these new
regulations prohibit the construction of this facility. Please review
the time line associated with the design and approval of this dam, and
let us know what options we have, if any, regarding the construction of
this facility.
