I will be sending a more formal response to your PCN but I thought that I would give you all a head's up on review status. The PCN is considered incomplete pending the following information: 1. Your PCN notes mitigation on-site through enhancement as well as payment to EEP for 160 linear feet. Please include a copy of an acceptance letter from the NCEEP In-Lieu-Fee Program. 2. Please provide a copy of a draft Conservation Easement for the mitigation area as well as a draft recordable map that clearly depicts the surveyed boundaries of the preservation areas. Keep in mind that the third party easement holder must be approved by the Corps as an appropriate easement holder. If you cannot find an easement holder, or you do not wish to use a Conservation Easement, other legal mechanisms are available. Please see the attached link regarding preservation mechanisms. 3. Please include a detailed planting plan for the riparian buffers, to include species and locations. 4. Please include more detailed plans and specifications for the stream enhancement (basic Rosgen-type analysis, plans and profiles are acceptable). 5. Please submit your proposed schedule of construction and vegetation planting. Please let me know if you have any questions. As is our procedure, if we do not receive this information within 30 days we will consider your application incomplete and probably pursue an alternative violation resolution via restoration (culvert removal) and/or elevation to the EPA or the US Attorney General.
