Stevens, Director 1 ?• NCDENR NORTH CAROLINA DEPARTMENT OF ENVIRONMENT AND NATURAL RESOURCES May 11, 1999 Avery County DWQ Project # 980960 APPROVAL of 401 Water Quality Certification and ADDITIONAL CONDITIONS Mr. Paul Brown Clark Stone co., Inc. 10801 Hwy 421 N Zionville N.C. 28698 Dear Mr. Brown: You have our approval, in accordance with the attached conditions and those listed below, to place fill material in 180 feet of streams for the purpose of constructing an entrance road to proposed Quarry, as you described in your application dated 29 Sept, 1999. After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 3108. This certification allows you to use Nationwide Permit Number 26 when the Corps of Engineers issues it. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply Water shed regulations. This approval will expire when the accompanying 404 or CAMA permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application except as modified below. If you change your project, you must notify us and you may be required to send us a new application.. If the property is sold, the new owner must be given a copy of this Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h) (6) and (7). For this approval to be valid, you must follow the conditions listed in the attached certification and any additional conditions listed below. 1. Deed notifications or similar mechanisms shall be placed on all lots with remaining jurisdictional wetlands and waters or areas within 50 feet of all streams and ponds to notify the state in order to assure compliance for future wetland and/or water impact. These mechanisms shall be put in place within 30 days of the date of this letter or the issuance of the 404 Permit (whichever is later). 2. Any additional stream impact requires approval by DWQ before impact. 3. Stream banks shall be stabilized by planting of woody plants. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition, which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 276 1 1-7447. This certification and its conditions are final and binding unless you ask for a hearing. This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. Clark Stone Company is requesting a letter of concurrence from the North Carolina Wildlife Resources Commission (NCWRC) in order to obtain a General Permit Number SAWC082-N-000-0031 (Section 404 of the Clean Water Act of 1977) from the U.S. Army Corps of Engineers. These comments are provided in accordance with the provisions of the Clean Water Act of 1977 (33 U.S.C. 466 et seq.), and the Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661-667d.). The proposed project consists of road construction to access a mine site. The new road parallels the small headwaters of Cranberry Creek crossing the stream in two locations. As part of the project, two culverts are used in transporting this stream. The first, lower pipe, is a 36" diameter and the second, upstream pipe, is a 48" diameter. The site was visited and the stream observed by a staff biologist on September 17, 1998. The road had already been built and the lower culvert was already in place. In a phone call on October 2, 1998, to Mr. Paul Brown, he stated that the upper culvert was also in place. The habitat in Cranberry Creek was in good condition but the road construction endangers its continued quality as a wild trout stream. It appears that the lower culvert is undersized. Tree laps in the stream, fill in the stream at crossings, and many intrusions into the 25' buffer zone will adversely impact the stream. This section of stream is the headwaters of Cranberry Creek, a Designated Public Mountain Trout Water, having wild trout regulations. Downstream impacts will also extend into the Elk River until vegetation reduces the impacts of erosion. Conditions likely to support any endangered, threatened, or species of special concern were not present. This project has the potential to impact downstream aquatic resources through sedimentation, the addition of pollutants, and the blockage of fish migration. Sedimentation has the potential to reduce fish numbers through habitat destruction, lowering of oxygen levels and reduced food supply, and loss of reproduction. Use of equipment in and near the stream also has the potential for introduction of pollutants into the aquatic system and alteration of aquatic community structure. Fish passage can be restricted if the culvert is not placed on grade with the stream bottom. Removal of riparian vegetation warms the water and adds to the destabilization of stream banks. The NCWRC will not object to the project if the following stipulations to avoid, minimize and mitigate impacts are implemented: Several sites have no buffer zone between the stream and the road, consequently, problems of road bed instability, fill in the creek and off site sedimentation exist. These areas need to be stabilized and revegetated immediately. 2. Avoid additional construction from 15 October through 15 April to prevent interference with spawning trout or destruction of eggs and young trout in downstream reaches. 3. Remaining riparian vegetation within the 25 foot buffer zone shall not be disturbed. 4. Remove all tree laps from the stream channel. Heavy equipment should not be operated in the stream channel in order to minimize sedimentation and reduce the likelihood of introducing other pollutants into the stream. 6. Culvert placement should be one foot below the normal stream bottom so that it does not block fish migrations. If this is not possible because of bedrock or some other constraint, then the stream should be bridged. Natural Resource Conservation Service (NRCS) should be consulted on for proper culvert size. Improper sized culverts should be replacement so that they do not wash out during a heavy rain event. Instillation of the culverts will require the armoring of the downstream banks with riprap. 9. If concrete is utilized on site, care must be taken to prevent its contact with the water which could alter the stream's water chemistry and result in a fish kill. 10. Because of the extent of this project, erosion control must emphasize the immediate use of temporary seeding, and a heavier than usual application of mulch to prevent sediment from entering the stream from disturbed areas. Permanent seeding should follow within 7 working days of the end of the project. Thank you for the opportunity to review and comment on this project.
