project was on hold since three copies of the application form and location maps were not
included. To date, we have not received the mentioned information regarding this
project.
If we do not hear anything from you within two weeks of the date of this letter, we
will be forced to withdraw the project.

The Division of Water Quality has reviewed your submittal for a 404/401 Permit or
approval under the Neuse River buffer rules for the Black Creek Greenway, Phase III in Wake
County. Your application was not complete since three copies of the application form and
location maps were not included. Please provide information regarding the location of your
project. This information is needed by DWQ in order for us to decide whether this project is
approvable.
I can be reached at 919-733-1786 if you have any questions. Until this information is
received, I will request (by copy of this letter) that the Corps of Engineers place this project on
hold. Also, the project will be placed on hold for our processing due to incomplete information
(15A NCAC 2H .0507(a)(4)). Your processing time will begin once we receive a complete
application.

RE: Black Creek Greenway, Phase III
Dear Mr. Dorney:
In response to your September 4, 1998 letter, regarding the Black Creek Greenway trail alignment and where it falls
within Zone 1 and 2, we have attached three copies of a new set of drawings. You had asked to receive mapping that
included topography so that you could evaluate our alignment. We have adjusted the alignment of the greenway, so that
the greenway would be within Zone 2 except for all creek crossings. This alignment has been given preliminary ap-
proval by NCDOT. We have met all of their requirements for project funding which includes:
• minimum 95 foot radius for all curves
• minimum 20 foot tangent segment between curves
• maximum slope gradient of 5%n with a 2% cross slope
(will allow 8% for a short segment)
• minimize removal of trees
• minimize stream crossings (all Black Creek crossings will be wooden boardwalk bridges, smaller perennial tributaries
will be culverted)
• minimize cut and fill
• must be a paved surface to meet bicycle facility and ADA requirements
These requirements must be met in order to receive funding for greenway construction. I have highlighted this informa-
tion in the August 18, 1998 letter that I sent to the Division of Water Quality at your attention.
We would like the preliminary construction documents to be reviewed for the Neuse River Basin Rulings and Guidelines
prior to our submittal for a 404/401 permit review. This would allow us to move on with new surveying of the entire
corridor in order to receive more accurate information to complete construction documentation. Then we would be able
to complete the 404/401 permitting process after the surveying has been completed.
At the present time, this project is under pressure by the NCDOT Office of Bicycle and Pedestrian Transportation to
begin construction or we may lose funding for the project. We would like to begin surveying as soon as possible. Thank

Dear Mr. Dorney:
I have been out of the office on business for the past two weeks, but received your letter regarding the
Black Creek Greenway last week. I sent you a letter on August 18, 1998 regarding the alignment of the
Black Creek Greenway. The Town of Cary had asked us to send the Black Creek Greenway Construction
Documents to the Division of Water Quality to review to make sure that we were going to meet the Neuse
River Basin rulings before we began surveying the alignment.
I received your letter stating that we had submitted for a 404/401 permit for this greenway. Alice Webb,
Town of Cary, had asked that we send the construction documents to your office for review concerning the
alignment in regards to the Neuse River Basin Rulings and Guidelines; we had not intended the drawings to
be reviewed for a 404/401 permit.
When we began work on this project, the Office of Bicycle and Pedestrian Transportation within the
NCDOT, had prepared a feasibility report that stated that a wetland delineation of the project study area
had been conducted by Soil and Environmental Consultants, Inc. in 1995. This delineation had been
verified by Eric Alsmeyer of the Corps of Engineers. Based on the delineation, the estimated impact to
wetlands from the subject project is .4 hectare (1 acre). This report also stated that it was anticipated that a
Section 404 Nationwide 23 permit would fulfill permit requirements for the project. This report also stated
that a 401 Water Quality General Certification would be required. The Town of Cary is handling all of the
permitting for this project and was going to send in the drawings for permit review after we worked out the
alignment issues with NCDOT and the Neuse River Basin Guidelines.
We would like for the construction drawings to be reviewed for Neuse River Basin Rulings and Guidelines
prior to submitting the drawings for 404/401 permit review. This would allow us to receive more accurate
surveying information to complete construction documentation. Then we would be able to complete the
404/401 permitting process after the surveying is complete.
We did not receive a 404/401 permit application in your letter; while it was stated that it was enclosed in
the letter. We will provide information regarding the location of the project area in more detail in the next
submittal. There is a project location map on the cover sheet of the plans. In your letter, it also asks
whether the stream will be culverted or bridged at trail crossings. Black Creek will be bridged at all trail
crossings. There are a few small tributary crossings that will be culverted.
