Preston Howard, Jr., P.E., Director ENVIRONMENT AND NATURAL RESOURCES January 20, 1999 Wake County DWQ Project # 980699 APPROVAL of 401 Water Quality Certification and ADDITIONAL CONDITIONS and Neuse River Buffer Rules Realty Services Group, Inc. 8641 Baypine Road; Suite 1 Jacksonville, NC 32256 Dear Sirs: You have our approval, in accordance with the attached conditions and those listed below, to place fill material in 165 linear feet of streams for the purpose of constructing a road crossing and utility crossings for Thistledown Apt., as you described in your application dated January 5, 1999. After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Numbers 3101 and 3103. These certifications allow you to use Nationwide Permit Numbers 12 and 14 when the Corps of Engineers issues them. This approval is also valid for the Neuse River buffer rules (15A NCAC 2B .033). In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply Watershed regulations. This approval will expire when the accompanying 404 or CAMA permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application except as modified below. If you change your project, you must notify us and you may be required to send us a new application.. If the property is sold, the new owner must be given a copy of this Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h) (6) and (7). For this approval to be valid, you must follow the conditions listed in the attached certification and any additional conditions listed below. 1. Deed notifications or similar mechanisms shall be placed on all lots with remaining jurisdictional wetlands and waters or areas within 50 feet of all streams and ponds to notify the state in order to assure compliance for future wetland and/or water impact. These mechanisms shall be put in place within 30 days of the date of this letter or the issuance of the 404 Permit (whichever is later). 2. Stormwater management from this site shall be designed to result in non-erosive velocities and diffuse flow for up to the 10 year, 24 hour storm. DWQ must be provided this design and calculations to support the design for written approval before any stream impact. 3. All sediment and erosion control devices except those for the road and sewer crossings must be placed outside the 50 foot wide buffer zone. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition, which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611- 7447. This certification and its conditions are final and binding unless you ask for a hearing. This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. If you have any questions, please telephone John Dorney at 919-733-1786. Below we have addressed all issues in your letter. 1. Yes, we must construct this project with the proposed road crossing. As per city of Raleigh ordinance, we must provide two access points to all parts of the project for the safety and welfare of the public for all projects with more than 180 units. Also the maximum length for a cal-de-sac in the city of Raleigh is 800' which we would exceed if we did not provide the proposed crossing. We have provided a draft copy of the letter to be signed by the city of Raleigh. It is currently being reviewed by the city's planning department and will be forwarded to you upon its signing by the city. 2. We have provided the stream and wetland impact information as requested. Please see the attached revised pre-construction certification application and plans. 3. Please see the attached letter from Bass, Nixon and Kennedy regarding stormwater issues. 4. All soil and erosion control measures have been revised as per your comments. As per a conversation with Cindy Bell we have provided silt fence along the toe of slope for the road ,--- crossing. 5. Please see revised application for nationwide pert-nit numbers. S&EC Environmental IZ- Consultants will file these permits at a later time. 6. Regarding compensatory mitigation for a perennial stream, we have revised our plans to limit stream disturbances to less than 150 LF total per stream. Thank you for your time. All storm water runoff from buildings are also dispensed into sheet flow and filtered through, in most cases, undisturbed woods and assorted vegetation before entering the Neuse River buffers. The layout for this project contains one street crossing which impacts a Neuse River buffer. This second crossing is needed to meet the safety needs of this proposed community. Also it is my understanding that the City of Raleigh requires a second access. Currently there are no other locations to provide the second access without impacting the buffer. Only 280 feet separates the property line from the upper end of the buffer which splits the property in half. This area already contains our first access to the rear of the property. The access which impacts the buffer has been designed with 2:1 sideslopes to minimize the disturbance which has been restricted to less than 130 feet of stream impact. Any documentation such as maps and narrative that you can supply to address alternative designs for your project may be helpful in our review of your 401 Certification. Also this project will require compensatory mitigation if the stream being impacted is a perennial stream as described in 15A NCAC 2H .0506(h). Your mitigation proposal is insufficient because this issue was not addressed. As you know the Neuse Buffer Rules: Neuse River Basin: Nutrient Sensitive Waters Management Strategy; Protection and Maintenance of Existing Riparian Areas, Administrative Code T15A:02B.0233 state the following: ".0233-Existing riparian areas shall be protected and maintained in accordance with Sub- Items (3)(a)-(e) of this Rule on all sides of surface waters in the Neuse River Basin. F' ' As we discussed, the riparian buffer must be protected in two zones. (a) "Zone 1 is intended to be undisturbed forest....Zone 1 begins at the upper edge of the active channel of the water body or the mean high water line and extends landward a W distance of 30 feet, measured horizontally on a line perpendicular to the waterbody.. Forest vegetation of any width that exists in Zone 1 on the effective date of this Rule .>.>... ,_ must be preserved and maintained." (b) "Zone 2 begins at the outer edge of Zone 1 and extends landward a minimum of 20 feet as measured horizontally on a line perpendicular to the waterbody. This meets the requirements of the Neuse Buffer Rule. As you indicated in your letter submitted with the plans, this project will require three stream crossings. Two for sanitary sewer and one for a road. These stream crossing are subject to further approval in that you must prove that there is no practical alternative to the crossings. In order to accomplish that, you will need to submit an Application for Pre-Construction Notification to the Division of Water Quality Wetlands/401 Unit. As a part of this you must show that the proposed project cannot be accomplished in a manner that would have less impact on the riparian area, maximize nutrient removal, and minimize impacts to water quality.
