Harris, III, P.E., CPM Natural Environment Section Head Project Development and Environmental Analysis North Carolina Department of Transportation 1598 Mail Service Center Raleigh, North Carolina, 27699-1598 Subject: Correction to the 401 Water Quality Certification Pursuant to Section 401 of the Federal Clean Water Act with ADDITIONAL CONDITIONS for US 158 Improvements from I-95/NC46 in Roanoke Rapids to SR 1312 (St. John Church Rd) in Northampton County, TIP R-2582A. NCDWR Project No. 20190230 Dear Mr. Harris: Condition 29 of the 401 Water Quality Certification for the aforementioned project dated June 24, 2019 incorrectly lists Sites 3 and 9 as requiring monitoring for temporary impacts. This condition should only apply to Site 3 and should read as follows: 29. Due to the possibility that compaction and/or other site alterations might prevent the temporary wetland impact area from re -attaining jurisdictional wetland status; the permittee shall provide an update on the wetland area temporarily impacted by temporary fill needed for utility installation at Site 3. This update shall be conducted two growing seasons after completion of the work and shall consist of photographs and a brief report on the progress of the area in re -attaining wetland jurisdictional status. Upon submission of this update to the NCDWR, the permittee shall schedule an agency field meeting with the NCDWR to determine if the wetland area temporarily impacted by this project has re -attained jurisdictional wetland status. If the wetland area temporarily impacted by this project has not re -attained jurisdictional wetland status, the NCDWR shall determine if compensatory wetland mitigation is to be required. [15A NCAC 02H.0506(b)(2) and (b)(3)] Please attach a copy of this letter with any copies of the original Water Quality Certification. All other conditions of the original Water Quality Certification dated June 24, 2019 still apply except where superseded by this correction. We apologize for any inconvenience this may have caused.
