On November 13, 2019, the Division of Water Resources (Division) received your application dated
October 25, 2019, requesting a 401 Water Quality Certification from the Division for the subject
project. The Division has determined that your application is incomplete and cannot be processed.
The application is on hold until all of the following items are addressed: [15A NCAC 02H .0507 (c)]
1. According to the application, the proposed work will include 500 feet of shoreline
stabilization. 300 feet of shoreline stabilization was approved for the same project on
September 27, 2018 (DWR#18-1229). The terms and conditions of the Regional General
Permit (RGP30) allow for 500 linear feet of shoreline stabilization. The Corps of Engineers
will be required to issue a waiver if the proposed stabilization is greater than 500 feet. This
project will be placed on hold until you can confirm with the Corps of Engineers that the
project can be covered under the RGP 30.
Pursuant to Title 15A NCAC 02H .0502 (c), the applicant shall furnish all of the above requested
information for the proper consideration of the application. If all of the requested information is not
received within 30 calendar days, of receipt of this email, the Division will be unable to approve the
application and it will be returned. The return of this project will necessitate reapplication to the
Division for approval, including a complete application package and the appropriate fee.
