Dear Mr. Clemons:
On November 15, 2019, Isaiah Reed from the Asheville Regional Office of the Division of
Energy, Mineral and Land Resources (DEMLR), conducted a site inspection for the Everest
Textile USA facility located at 1331 West Main Street, Forest City, North Carolina. A copy of
the Compliance Inspection Report is enclosed for your review. The site visit and file review
revealed that the subject facility is covered by NPDES Stormwater General Permit
NCG170000 under Certificate of Coverage NCG170425. Permit coverage authorizes the
discharge of stormwater from the facility to receiving waters designated as an unnamed
tributary of Bracketts Creek, a Class C waterbody in the Broad River Basin.
As a result of the site inspection, the following permit conditions violation(s) are noted:
1) Twenty-four Hour Reporting
The permittee did not report within twenty-four hours to the central office or the
appropriate regional office following an event which may endanger health or the
environment.
2) Secondary Containment
The permittee did not provide secondary for bulk storage of liquid materials on site.

Requested Response:
You are asked to respond to this office, in writing, within 30 calendar days from receipt of
this notice. Your written response should include a reasonable explanation as to why the
aforementioned violations have occurred as well as a Plan of Action to prevent these
violations from recurring.
Thank you for your attention to this matter. This Office is considering sending a
recommendation for enforcement to the Director of the Division of Energy, Mineral & Land
Resources regarding these issues. Your above -mentioned response to this correspondence
will be considered in this process. This office requires that the violations, as detailed
above, be properly resolved. These violations and any future violations are subject to
a civil penalty assessment of up to $25,000 per day for each violation. Should you have

Inspection Summary
On November 15, 2019 this facility was inspected in response to a notification received from Forest City concerning a spill
on site. I met with Mark Clemons and Jeff Childers on site. During the inspection, the following items were noted:
1) The oil/water separator on site overflowed while being filled from the air clear unit.
2) Oil/water drained across the parking lot and reached the storm drain.
3) An inspection of the storm drain area was not performed when the spill occurred.
4) Secondary containment has not been provided for bulk storage of liquid materials on site.
The permittee is directed to provide a full report on the extent and circumstances of the spill within 30 days of the receipt of
the accompanying Notice of Violation.
The permittee is directed to immediately begin providing for, or making modifications to the secondary containment on site
to allow secondary containment to be provided for all bulk storage of liquid materials.
