Proposed Activity Provide a detailed description of the proposed activity including its purpose and include the type of equipment to be used:* The proposed project will reroute a section of natural surface trail in order to reduce the trail's impact to Jordan Lake buffers adjacent to an unnamed tributary to Bolin Creek. The current trail location impacts 231 square feet of Zone 1 Buffer and 101.5 square feet of Zone 2 Buffer. Once the trail is moved to the proposed location, the total impact to Zone 1 will 112 square feet and total impact to Zone 2 will be 73.5 square feet. The trail relocation work will be done entirely with hand tools. Once the trail is relocated to the proposed route, the former route will be covered with leaf mulch and pine straw and will replanted with native riparian buffer tree species on eight foot by eight foot centers. By realigning the trail to the proposed location, impacts to Zone 1 of the buffer will be reduced by 119 square feet and impacts to Zone 2 of the buffer will be reduced by 32 feet. The existing trail will be covered in leaf mulch and pine straw and will be replanted with native riparian buffer vegetation. 1b. The proposed trail relocation is being constructed with low impact, modern trail building techniques using hand tools. The trail is designed to minimize flow along the path of the trail. The Conservation Areas are subject to the covenants and restrictions set forth herein. II. PURPOSE OF DECLARATION. This Declaration is made for the purpose of maintaining, restoring, enhancing, and preserving the ecological attributes of the Conservation Areas that contribute to the protection and improvement of aquafic habitat, terrestrial habitat, water quality, flood control, and opportunities for human recreation, education and research. The covenants and restrictions set forth in this Declaration are intended to constitute a "conservation agreement' as defined by G.S. 121-35(1) in that the covenants and restrictions imposed herein shall serve to retain the applicable land and water are predominantly in their natural, scenic or open condition. III. RESTRICTED OR PROHIBITED USES AND ACTIVITIES. Consistent with the purpose of this Declaration, the following specific uses and activities within the Conservation Areas are restricted or prohibited as indicated below: A. Construction. PERMITTED USES AND ACTIVITIES. Consistent with the purpose of this Declaration and notwithstanding anything to the contrary in Section III, the following uses and activities within the Conservation Areas are permitted or reserved as indicated below: A. Recreational, Research and Educational Activities. Appropriate research, educational, and recreational activities are permitted in the Conservation Areas to the extent they are not prohibited by Section III of this Declaration. Be Sustainable Trail Maintenance. Sustainable trail maintenance activities are permitted in the Conservation Areas. Such maintenance shall include minor repair, restoration, or relocation of existing trails. Such trail work shall adhere to the guidelines for sustainable single track trails as set forth by the International Mountain Bike Association. [31 (00050761.DOC 8} RB5541 363 4/12 C. Crossings of Waterways. Where a road or trail necessarily must cross a watercourse in the Conservation Areas, the development and maintenance of such crossing is permitted in a resource conservation district so long as such crossing (i) is located and designed so as to allow convenient access by wildlife through and beyond such crossing, (ii) is designed to safely convey floodwaters to the same extent as before construction of such crossing, (III) minimizes built -upon area, and (iv) maximizes the use of best management practices, and (v) otherwise is consistent with the terms of the Development Agreement. Motorized vehicles are permitted on trails and roads within the Conservation Areas, if operated or authorized by the University, for all purposes not prohibited by Section III of this Declaration. D. Restoration Activities. Restoration activitie Areas, including, but not limited to, planting of trees, shrubs of invasive exotic species, utilization of equipment to grade, fill, and prepare the soil, modification of hydrology, and installation of natural and manmade materials as needed to direct in -stream, above ground, and subterraneous water flow according to a restoration plan based on best practices. Use of pesticides is permitted for the control and removal of invasive exotic 0 species,. s are permitted in the Conservation and herbaceous vegetation, removal E. Existing Conditions. All uses of land in the Conservation Areas existing as of the effective date of the Development Agreement (July 1, 2009) are permitted, including maintenance of utilities and utility corridors. Exhibit E depicts the conditions existing in the Conservation Areas as of the effective date of the Development Agreement. F. Other Permitted Uses and Activities. Other land uses and activities are permitted in the Conservation Areas to the extent they are not prohibited bv Section III of this Declaration. V. ENFORCEMENT, MAINTENANCE AND FUNDING. The right of enforcement of this Declaration is hereby granted to and vested entirely with the University,, its successors and assigns. The University shall be responsible for maintaining the Conservation Areas and for monitoring compliance with the covenants and restrictions imposed herein. The performance of these obligations may be carried out by University employees, by contractors, or by a combination of the two. The University shall provide the funding necessary on an annual basis for the performance of these obligations. Each year, the University will publicly release the results of the compliance monitoring for the preceding year, together with a general description of maintenance activities conducted in the Conservation Areas during such period. VI. DURATION. This Declaration and the covenants and restrictions imposed herein shall be binding upon and inure to the benefit of Declarant, its successors and. assigns, and shall continue as a servitude running in pe etuity with the property.
