On November 21, 2006, the Division of Water Quality (DWQ) received your written response to our
notice to you dated November 6,.2006 of materials needed to continue review of your application. The
purpose of this correspondence is to acknowledge receipt of confirmation we have received from the
Division of Solid Waste that this project qualifies for an Exception from the Landfill Moratorium
established by Senate Bi11353 on August 14, 2006. Therefore, we will be able to proceed with review of
your application fora 401 Water Quality Certification as usual. Thank you for forwarding the stream
confirmation forms completed by the Raleigh Regional Office as well as correspondence from the
Ecosystem Enhancement Program confirming that they will accept this project if needed to meet
mitigation requirements. We understand that you are in the process of finalizing the comprehensive
mitigation plan for this project, and will be investigating mitigation alternatives further in an onsite
meeting scheduled for November 29, 2006 in coordination with DWQ and the US Army Corps of
Engineers. Please note that your application will be considered complete upon receipt of the final
mitigation package in this office.
This letter only addresses the application review and does not authorize any impacts to wetlands, waters
or protected buffers. Please be aware that any impacts requested within your application are not
authorized (at this time) by the DWQ. Please call Ms. Cyndi Karoly or Ms. Amy Chapman at 919-733-
