NC 107 - Safety Improvements from SR 1142 to SR 1145

Dear Mr. Baker:
The North Carolina Department of Transportation (NCDOT) is proposing to widen the pavement
and shoulders and improve drainage along a 4,145=foot section of NC -107 in-Jackson County. The
project section is from slightly south of SR 1142, Laurel Knob Road, to just north of SR 1145,
North Norton Road. The project will include the installation of dedicated turn lanes for the Blue
Ridge School to improve safety and efficiency at the SR 1145 intersection. Also, the road widening
through this section will address safety issues associated with a narrow corridor and overhanging
rock.
This project is similar to one that was permitted in 2004 as part of the North Carolina Moving
Ahead Program; however, the project was never constructed and the permits have expired.
NCDOT would like to complete the project with funding provided by the American Recovery and
Reinvestment Act of 2009. The project is scheduled to let in January 2010.
I am enclosing a completed PCN application, plan views of permit sites, a marked county map, a
USGS topographic map and photographs for your review.
The North Carolina Natural Heritage Database was checked for records of federally threatened and
endangered species. There were.no records found for the unnamed tributaries of Hurricane Creek.
Additionally, there were no records found for the entiie Hurricane Creek watershed. Hurricane
Creek and the unnamed tributaries are cold water streams. This watershed does not provide suitable
habitat for the Appalachian elktoe (Alasmidonta raveneliana), which is found downstream in the
Tuckasegee River below Cullowhee. This project is limited in scope and will involve only minimal
disturbance for widening and two jurisdictional impacts for culvert extensions. Erosion and

sedimentation control measures to protect High Quality Waters will be used for this project.
Thereforexhe effects.from this project should be minimal. For these reasons, we believe there will
be-`'no effect" toi.threatened or endangered species.
Impacts to,historic or cultural resources are not anticipated. NCDOT has submitted this project to
the State Historic Preservation Office (SHPO) for review. NCDOT will conduct the appropriate
site investigations if recommended by SHPO.
The best management practices will be used to minimize and control sedimentation and erosion on
this project. The construction foreman will review all erosion control measures daily to ensure
sedimentation and erosion is being controlled effectively. If the planned devices are not functioning
as intended, they will be replaced immediately with better devices.
Impacts to Waters of the United States
The unnamed tributary of Hurricane Creek at site one is not shown on the USGS topographic map.
There is a defined channel composed of sand and gravel. There is flow above and below the
culvert; however, there is no flow through the culvert. The unnamed tributary at site two is shown
on the USGS topographic map as a perennial stream. The channel is well-defined and is
approximately six feet in width at the culvert site. The substrate is primarily sand and gravel. The
channel lacks vegetation. There is sufficient flow to support fish, including trout. The unnamed
tributary at site 1 flows approximately 750 feet to Hurricane Creek (DWQ Class: WS-III Tr HQW).
Hurricane Creek then flows approximately 4000 feet to the backwaters of Lake Glennville. The
unnamed tributary at site 2 flows approximately 575 feet ,to.its confluence with Hurricane Creek.
Hurricane Creek flows approximately 2800 feet to Lake Glenville. Lake Glenville meets the
definition of a Traditional Navigable Water. For these reasons, we believe the unnamed tributaries
of Hurricane Creek meet the definition of Relatively Permanent Water and are under the jurisdiction
of the U.S. Army Corps of Engineers. In order to complete the proposed safety improvements on
NC 107, it will be necessary to impact waters of the United States in the Little Tennessee River
Basin. Specifically, NCDOT is requesting to extend one concrete box culvert and one metal culvert
in unnamed tributaries of Hurricane Creek. The proposed impacts are listed in the table below.

NCDOT is hereby requesting authorization under Section 404 of the Clean Water Act to proceed
with the project outlined above. By copy of this letter, I am asking Mr. David McHenry, Mountain
Region Coordinator, of the North Carolina Wildlife Resources Commission (NCWRC) to comment
directly to you concerning the Nationwide 14 Permit request.
Also, by copy of this letter, I am requesting authorization under Section 401 of the Clean Water Act
from the North Carolina Department of Environment and Natural Resources (DENR), Division of
Water Quality (DWQ). In addition, I am asking Mr. McHenry and Mr. Ed Ingle, Roadside
Environmental Field Operations Engineer (NCDOT), to comment directly to me concerning this
permit request.

The area of the project is rural with a forested landscape with a few single family residences, a school, fire station and a
few businesses.

3d. Explain the purpose of the proposed project:
The purpose of the project is to widening NC107 between SR 1142 and SR 1145 to improve safety by removing
overhanging rocks along the highway, increasing shoulder width and installing dedicated turn lanes at SR 1145 to allow
safer and more efficent flow of school traffic at the SR 1145 intersection.
3e. Describe the overall project in detail, including the type of equipment to be used:
The work will require extending an existing box culvert and a corrugated metal culvert on the outlet ends. Sandbags, pipe
and pumps will be used as needed for flow diversion. Roadwork involves widening the footprint of the existing road to
facilitate increasing shoulder width. At the intersection of SR 1145, the road will have to be widened to accommodate the
dedicated turn lanes. Trackhoes, drills, dump trucks and other typical road construction equipment will be used to
accomplish the work.

The work is being performed at a narrow section of roadway and to add a turn lane. The construction is for safety
