On behalf of Glenwood Homes, LLC. (applicant), please find attached a complete application and supplemental
information requesting written authorization from the North Carolina Division of Water Resources (NCDWR) that
the activities associated with the buffer and stream impacts for the proposed residential subdivision project may
proceed. No impacts to wetlands are proposed. Proposed impacts do not require written authorization from the
USACE.
Project Summary, Location, and Purpose
The purpose of the Project is to construct a townhome subdivision with associated roads and utilities which will
connect to existing adjacent infrastructure in the area. The Project site is currently undeveloped and consists of +/-
9.12-acres of wooded land located south of Camel Drive and east of Mail Street in Clayton, NC. Land -use in
immediately adjacent properties consist of residential, institutional, commercial, and undeveloped wooded land.
The project site drains to the Neuse River within the Neuse River Basin. Please see attached supplemental file for
corresponding Johnston County parcel PIN. The coordinates of 35.65386'N, 78.45256*W generally correspond to the
center of the Site.
Project History
The Site was evaluated and delineated by Brown's Environmental Group, Inc. A site meeting to verify the limits of
the Waters of the US delineation was held on February 27, 2018 with Mr. Ross Sullivan of the USACE (see attached
email). Streams on the site are present in the field as approximately shown on the USGS and Soil Survey maps
therefore a buffer verification site meeting was not requested.
Avoidance and Minimization
Proposed roads and lots were positioned and aligned so as to avoid impacts to streams and buffers to the extent
practicable (no stream or wetland impacts are proposed). In addition, open space was provided around drainages
containing streams and buffers. Construction fencing will be used to define the construction corridor and prevent
any accidental impacts. Silt fencing will be installed to provide additional protection from runoff.

Project Impacts
Permanent buffer impacts proposed for the project include 2,490 Square Feet (ftz) in Zone 1 and 2,100 ftz in Zone 2
resulting from the installation of the proposed sewer line. Overall riparian buffer impacts total 4,590 ftz. No other
riparian buffer impactssa�e proposed.
Mitigation $ .
The riparian buffer impacts associated with this project are considered "allowable" and "exempt" within the table
of uses. Therefore, no riparian buffer mitigation is proposed at this time.

application. The Site is currently wooded and undeveloped. Two streams enter the property from the west and flow east
where they converge near the center of the southern property line. The stream exits the Site near the southeastern
property comer. The surrounding land use is urban residential and includes schools and businesses as well as some
undeveloped forested land

The purpose of the project is to construct residential townhomes to meet the demand for housing in this part of Johnston
County.

The proposed project consists of a single-family residential townhome subdivision with approximately 62 units. Two
entrance roads enter from the north of the Site via Camel Street. No impacts are proposed for the construction of the
townhomes or roads. Utilities for the proposed project will connect to existing utility lines on the southern portion of the
site. Impacts will result from installation of proposed utilities. Heavy equipment typically used for utility installation
projects (e.g. back hoes, bull -dozers, etc.) will be utilized.

la. Specifically describe measures taken to avoid or minimize the proposed impacts in designing project. Impacts resulting
from fill or permanent crossings were avoided for the proposed for the project. The proposed sewer crossing was
positioned so as to result in only one stream crossing and minimized by using a perpendicular crossing. Because the
sewer line is a gravity line a crossing could not be achieved further upstream (to the west). The stream crossing could not
be located further downstream (to the east) from the proposed location because the property to the south of the stream is
under separate ownership.

General techniques include the use of construction fencing to define the construction corridor and prevent any accidental
additional impacts. Silt fencing and temporary basins will also be used to prevent sediment runoff into the stream.

Hey Wyatt,
Ross Sullivan conducted a site visit with you at the above referenced property on February 27, 2018 to
verify the limits of any potentially jurisdictional waters of the United States (WoUS) within the project
area. I have determined that the delineation map that you provided to me on September 25, 2019
entitled "Terramisu, LLC" accurately depicts the limits of any potentially jurisdictional WoUS within the
project area.
I will issue the Preliminary Jurisdictional Determination for this project in the order that it was received,
but please note that I have a substantial backlog of permits and JDs to work through at this time and it
may take several months. However, please note that delineation concurrence is more than sufficient for
any required permitting under section 404 of the Clean Water Act.

The North Carolina Natural Heritage Program (NCNHP) appreciates the opportunity to provide
information about natural heritage resources for the project referenced above.
Based on the project area mapped with your request, a query of the NCNHP database indicates that
there are no records for rare species, important natural communities, natural areas, and/or
conservation/managed areas within the proposed project boundary. Please note that although there
may be no documentation of natural heritage elements within the project boundary, it does not
imply or confirm their absence; the area may not have been surveyed. The results of this query
should not be substituted for field surveys where suitable habitat exists. In the event that rare
species are found within the project area, please contact the NCNHP so that we may update our
records.
The attached 'Potential Occurrences' table summarizes rare species and natural communities that
have been documented within a one -mile radius of the property boundary. The proximity of these
records suggests that these natural heritage elements may potentially be present in the project area
if suitable habitat exists. Tables of natural areas and conservation/managed areas within a one -mile
radius of the project area, if any, are also included in this report.
If a Federally -listed species is found within the project area or is indicated within a one -mile radius of
the project area, the NCNHP recommends contacting the US Fish and Wildlife Service (USFWS) for
guidance. Contact information for USFWS offices in North Carolina is found here:
Please note that natural heritage element data are maintained for the purposes of conservation
planning, project review, and scientific research, and are not intended for use as the primary criteria
for regulatory decisions. Information provided by the NCNHP database may not be published
without prior written notification to the NCNHP, and the NCNHP must be credited as an information
source in these publications. Maps of NCNHP data may not be redistributed without permission.
The NC Natural Heritage Program may follow this letter with additional correspondence if a
Dedicated Nature Preserve, Registered Heritage Area, Clean Water Management Trust Fund
easement, or Federally -listed species are documented near the project area.
