Mayberry Lenoir Mirror Company PO Box 1650 Lenoir, North Carolina 28645 Dear Mr. Mayberry: MCDENR Department of Environment and Division of Water Quality Coleen H. Sullins Director May 14, 2009 Natural Resources Subject: Draft NPDES Stormwater Permit Permit No. NCS000061 Lenoir Mirror Co. — Caldwell Site Caldwell County Dee Freeman Secretary Enclosed with this letter is a copy of the draft stormwater permit for your facility. Please review the draft very carefully to ensure thorough understanding of the conditions and requirements it contains.. The draft permit contains the following -significant changes from this facility's current permit:. Analytical monitoring changes: 1. Analytical monitoring parameters from the previous permit have been maintained in this permit. 2. pH has been added to the analytical monitoring requirements. 3. All analytical monitoring has been set to semi-annually during a representative storm event as defined in Part II Section B. The.permittee must also document the total precipitation for each event. If no discharge occurs during the sampling period, the permittee must submit a monitoring report indicating "No Flow" within 30 days of the end of the six-month sampling period. Additionally, samples must be taken a minimum of 60 days apart, as specified in Table 2. 4. Benchmarks for analytical monitoring have been added to this draft permit. Exceedances of benchmark values require the permittee to increase monitoring, increase management actions, increase record keeping, and/or install stormwater Best Management Practices (BMPs) in a tiered program. If the sampling results are above a benchmark value, or outside of the benchmark range, for any parameter at any outfall then the facility shall follow the Tier 1 guidelines which require a facility inspection within two weeks and implementation of a mitigation plan within two months. If during the term of this permit, the sampling results are above the benchmark values, or outside of the benchmark range, for any specific parameter at a specific discharge outfall two times in a row (consecutive), then the facility shall follow the Tier 2 guidelines which require a repetition of the steps listed for Tier 1 and also immediately institute monthly monitoring for all parameters at every outfall where a sampling result exceeded the benchmark value for two consecutive samples. 5. You are required to collect all of the analytical and qualitative monitoring samples during representative storm events as defined in Part II Section B. Qualitative monitoring is required regardless of representative outfall status. 6. You are responsible for all monitoring until the renewal permit is issued. See Footnote 1 of Tables 1, 4, and 5. 7. The flow reporting requirement has been removed per DWQ revised strategy. (The total rainfall parameter is in this permit, however.) 8. Vehicle maintenance monitoring has been revised to semi-annually in order to coincide with analytical and qualitative monitoring. This requirement appears in all Individual Stormwater permits, however it only applies to facilities that do vehicle maintenance. If the facility begins vehicle maintenance during the permitted timeframe then the requirements shall apply. Other permit changes: 1. Additional guidance is provided about the Site Plan requirements. The site map must now identify if the receiving stream is impaired and if it has a TMDL established. It must also describe potential Wetlands and Stormwater Branch One' 1617 Mail Service Center, Ralegh, North Carolina 27699-1617 NorthCarolina Location: 512 N. Although site has issues, Region recommends renewing permit. The issues can be dealt with from a regional perspective, addition permit conditions are not waranteed at this time. Issues: Monitoring frequency needs to meet permit requirement. Vehicle maintenance area stormdrain needs to be further observed and evaluated and may likely need pillow installed for oil absorption. Stream samples need to be taken for metals at outfall 1 manhole. Contacted Rob McDaniel with Hazardous Waste Section to inform him of concerns regarding stream flow under old cullet landfill. .."There appears to be a stream/spring buried under the cullet landfills that is flowing through the outfall 1 manhole. To determine baseline for water quality and stormwater events, this stream flow need to be evaluated for metals. Also to determine if the old cullet landfill, which has been remediated per Haz Waste, and the newly discovered old cullet landfill, which is under Agreement of Consent with Haz Waste is contaminating waters of the State. If samples come back with elevated numbers then further evaluation will be needed including, but not limited to, finding where this outfall/stream daylights and performing further monitoring at discharge point and receiving stream, which should be UT to Gunpowder Crk. See historic folder -Caldwell County files -Lenoir Mirror Discharge folder. —Tracing stormwater/stream conveyance below outfall/manhole 1 was attempted unsuccessfully. Other historic industrial inputs are possible, ie old Singer site. However Singer site is vacant currently. At pretreatment wastewater facility the transfer of solids (sludge) is conducted via tractor to dump truck. The liquids from this transfer are reaching stormwater conveyance. This is considered a wastewater and needs to be remedied immediately. Discussion of a berm installation so water would have to flow back into treatment system was mentioned. Cleaning of the pavement would be needed if this type of system is used to avoid stormwater overtopping berm and carrying residual to stormwater conveyance. During the inspection a berm was mentioned to resolve this discharge to the stormwater system. If a berm is installed please include housekeeping measures that will be put into practice and included in the Stormwater Pollution Prevention Plan. "These housekeeping items will need to address how residuals on pavement will be kept from reaching the stormwater system if the berm is overtopped during a storm event or if incidental spillage occurs. Issues: Monitoring frequency needs to meet permit requirement. Vehicle maintenance area stormdrain needs to be further observed and evaluated and may likely need pillow installed for oil absorption. Stream samples need to be taken for metals at outfall 1 manhole. Contacted Rob McDaniel with Hazardous Waste Section to inform him of concerns regarding stream flow under old cutlet landfill, —There appears to be a stream/spring buried under the cutlet landfills that is flowing through the outfall 1 manhole. To determine baseline for water quality and stormwater events, this stream flow need to be evaluated for metals. Also to determine if the old cutlet landfill, which has been remediated per Haz Waste, and the newly discovered old cutlet landfill, which is under Agreement of Consent with Haz Waste is contaminating waters of the State. If samples come back with elevated numbers then further evaluation will be needed including, but not limited to, finding where this outfall/stream daylights and performing further monitoring at discharge point and receiving stream, which should be LT to Gunpowder Crk. See historic folder -Caldwell County files -Lenoir Mirror Discharge folder, "'Tracing stormwater/stream conveyance below outfall/manhole 1 was attempted unsuccessfully. Other historic industrial inputs are possible, ie old Singer site. However Singer site is vacant currently. ' At pretreatment wastewater facility the transfer of solids (sludge) is conducted via tractor to dump truck. The liquids from this transfer are reaching stormwater conveyance. This is considered a wastewater and needs to be remedied immediately, Discussion of a berm installation so water would have to flow back into treatment system was mentioned. Cleaning of the pavement would be needed if this type of system is used to avoid stormwater overtopping berm and carrying residual to stormwater conveyance. I spoke to our environmental consultant concerning your additional questions. Mr. David R. Mursch, PE can be reached at the section below if you need any information or work they have done for us that they may have on a disk. NET (National Environmental Technologies) now no longer in business, has done extensive work for us for a number of years concerning our original RCRA part (B) Post Closure Permit Application, EPA ID #NCD 003156213 dated December 1997, and a Baseline Risk Assessment Report, NET Project #092013 also dated December 1997. After about a nine year wait, we were contacted by Mr. Robert McDaniel at the NCDENR and was interested in entering into an AOC order rather than the complexities of the 1997 Part (B) Pen -nit Application. We agreed. f y - 9Sri aa7471 CtIle We contacted Mr, David R. Mursch, along with Unifour Engineering, to conduct a comprehensive Supplemental Site Assessment Report. ']'he results and report was completed September 2006 and was submitted to Mr. Robert McDaniel, NCDENR on October 16, 2006. Since that time we have been working on the AOC draft which is still pending reviews by their attorneys. Now, getting back to your seven questions. I will do my best to answer these without going too long in the wording. If you need any clarifications or more information, I can always copy and sent you the above referenced reports or locate a diskette and send this to you providing Unifour Engineering, has it all saved. Answer to Questions: Start..... 1. Approximately 22 acres on one site. 2. Lcnoir Mirror Company is a mirror manufacturing and glass fabricating company. The (SIC) code for LMC is 3231, "Industrial Mirrors" and "Fabricated Clear Glass". LMC has been operating at this location since 1948. LMC's manufacturing process consists of mirror plating and cutting, grinding, and polishing of both clear and mirrored glass. Clear glass manufacturing. operations generate grinding and polishing wastewater that is treated on -site, and clear glass waste cutlet that is recycled by the stock glass suppliers. M irror manufacturing operations generate grinding and polishing wastewater, process coating wastewater, paint process line cleaning waste (solvent recovery still bottom sludge), and mirror waste cutlet. Currently, the waste mirror cutlet is picked up by rceycters and/or permitted to the Caldwell County, NC landfill as a special non -hazardous waste subject to RCRA, TCLP testing annually. The waste paint still bottoms are permitted under a "Small Quantity Generator" permit. The waste paint is picked up by common carrier and sent to Giant Resource Recovery, Sumter, SC. The mirror production process includes cleaning, rinsing, coating, drying, and polishing of the stock glass. Clear glass stock is manually loaded onto the mirror coating line. The clear glass is mechanically brazed "wet deposition process" on one side to provide a bonding surface for the mirror coating, cleaned, and rinsed to protect the metal coating, a layer of paint is applied to the surface and cured in a bake oven. The mirrored glass is then cut -to -size, polished, cleaned, fabricated and shipped to the customer. Mirror cutlet is produced when either breakage, rejects or trimming glass occurs. 3. The only hazardous waste handled is the waste paint still bottoms which are stored in 55 gallon drums, stored inside a semi -trailer container parked adjacent to the paint loading dock behind the lower plant one building. We send this to Giant Resource Recovery, Sumter, SC. LMC sends 3 to 4 drums about three times per year. The paint we use on the mirrors contain low level lead at 2-4 % by weight and must pass a TCLP test for lead and RCRA metals. 4. Until about 1959-1960, LMC, like most other mirror manufacturers, stripped the backing off of the mirror Gullet and recycled the clear glass. However, about that time, PPG Glass Industries introduced a mirror paint that had superior protection qualities, but was not amenable to stripping. As a result, LMC began storing mirror cutlet on -site. This created a large on -site waste pile approximately 20+ thousand cubic yards. The PPG Industries mirror paint and other comparable mirror paints at that time contained lead. LMC used various lead containing mirror paints until November 1990. Between 1990 and 1996, an unleaded paint was used in all process. Following six years of unleaded paint use, LMC began using a low lead paint at 2% by weight due to poor quality of the unleaded paints and customer returns when the unleaded paints were flaking off or going bad due to black spots and edges. The low lead paint returned the mirrors back to good quality with no more black spots and edges. LMC has been using low lead paint since 1996. In 1994 the large on -site cutlet pile was excavated, stabilized with cement, and landfilled in -place as a base for a new capped parking lot -behind the plant one building at the lower end. A series of monitoring wells were installed for lead testing. 5. The visual monitoring occurred more than once but I did not find every sheet I was logging in. A betterjob at record keeping will be implemented. 6. None. 7. We routinely analyze for total lead and.TDS by methods EPA 200.7 and SM. 19-2540C. However, we did analyze for other parameters in 2005 at the request of NCDENR, including volatile organic compounds (VOCs) in the wells down gradient of the USTs behind the old 1948 building. This was done as part of the current semi-annual testing conducted in the fall of 2005 or early 2006. 1 would need to look up the Page 12 of 13 NCS000061 report to be correct on the date. We also analyzed one groundwater sample from the new M W-17 at the two USTs behind the 1948 main building for semi -volatile organic compounds by EPA method 625, VOCs by EPA method 602, and for VPH and EPH by MADEP methods in conjunction with, as reported in the LSA that LMC submitted in September 2007, End..... Answer to Questions: Start...., Approximately 22 acres on one site 2. Lenoir Mirror Company is a mirror manufacturing and glass fabricating company. The (SIC) code for LMC is 3231. "Industrial Mirrors" and "Fabricated Clear Glass". LtNIC has been operating at this location since 1949, LMC',; manufacturing process consists of mirror plating and cutting, grinding, and polishing of both clear and mirrored glass. Clear glass manufacturing operations gcncrato grinding and polishing Wastewater that is treated on -site, and clear glass waste culler that is recycled by the stock glass suppliers. Mirror manufacturing operations generate grinding and polishing wastewater, process coating Wastewater, paint process line cleaning waste (so]vcm recovery still bottom sludge), and mirror waste cutlet. Currently, the waste mirror Gullet is picked up by recyclers and/or permitted to the Caldwell County, INC landfill as a special non -hazardous waste subject to RCRA. TCLP testing annually. The waste paint still bottonns are pernnitted under a "Small Quantity Generator" permit. The waste paint is picked up by common carrier and sent to Giant Resource Recoven,. Sumter, SC. The mirror production process includes cleaning, rinsing. coating. drying. and polishing of the stock glass. Clear glass stock is manually loaded onto the mirror coating line. The clear glass is mechanically brazed "wet deposition process" on one side to provide a hording surface for the mirror coating, cleaned, and rinsed to protect the nncial coating, a layer ot'paint is applied to the surtacc and cured in a bake oven. The mirrored glass is then cul-to-size. polished. cleaned, fabricaled and shipped to the customer. Mirror Gullet is produced when either breakage. rejects or trimmin4, glass occurs. 3. The only hazardous Waste handled is the waste paint still bottoms which are stored in 55 gallon drums, stored inside a semi -trailer container parked adjacent to the paint loading dock behind the lower plant one building. We send this to Giant Resource Recovery. Sumter. SC. LMC sends 3 to 4 drums about three tinnes per year. The paint We use on the mirrors contain low level lead at 2-4 by weight and must pass a TCLP test for lead and RCRA metals. 4. Until about 1959-1960, LMC. like most other mirror manufacturers, stripped the backing off of the mirror cullct and recycled the clear glass. I-lowever, about that time, 11110 Glass Industries introduced a mirror paint that had superior protection qualities, but Was not amenable to stripping. As a result, LMC began storing mirror Gullet on -site. This created a large oa-site Waste pile approximately 20+ thousand cubic yards. The PPG industries nnirror paint and other comparable mirror paints at that time contained lead. LMC used various lead containing mirror paints until November 1990. Between 1990 and 1996. an unleaded paint was used in all process. Fohowing six years of unleaded paint use. LMC began using a low lead paint at 2% by weight due to poor quality of the unleaded paints and customer returns when the unleaded paints were flaking, off or going bad due to black sports and edges. The low lead paint returned the mirrors buck to good quality With no more black spots and edges. LMC has been using low lead paint since 1996. In 1994 the large ou-site cullct pile was cxcavatcd. stabilized With cement, and landf illed in -place as a base for a new capped parking lot behind the plant one building at the lower end. A series of monitoring Wells Were installed for lead testing. 5. The visual monitoring occurred more than once but I did not find every sheet i was logging in. A better job at record keeping will be Implemented. 6, None. 7. We routinely analyze for total lead and TDS by methods EPA 200.7 and SM 19-2540C. However, we did analyze I'or other parameters in 2005 m the request of NCDF.NR, including volatile organic compounds (VOCs) in the wells down gradient ofthe USTs behind the old 1948 building. This was done as part of the current semi-annual testing conducted in the fall of 2005 or early 2006. This Plan shall be considered public information in accordance with Part 1II, Standard Conditions, Section E, Paragraph 3 of this individual permit. The Plan shall include, at a minimum, the following items: 1. Site Plan. The site plan shall provide a description of the physical facility and the potential pollutant sources which may be expected to contribute to contamination of stormwater discharges. The site plan shall contain the following: (a) A general location map (USGS quadrangle map or appropriately drafted equivalent map), showing the facility's location in relation to transportation routes and surface waters, the name of the receiving water(s) to which the stormwater outfall(s) discharges, or if the discharge is to a municipal separate storm sewer system, the name of the municipality and the ultimate receiving waters; and accurate latitude and longitude of the point(s) of discharge. (b) A narrative description of storage practices, loading and unloading activities, outdoor process areas, dust or particulate generating or control processes, and waste disposal practices. (c) A site map drawn to scale with the distance legend indicating location of industrial activities (including.storage of materials, disposal areas, process areas and loading and unloading areas), drainage structures, drainage areas for each outfall and activities occurring in the drainage area, building locations, existing BMPs and impervious surfaces, and the percentage of each drainage area that is impervious. For each outfall, a narrative description of the potential pollutants which could be expected to be present in the stormwater discharge. (d) A list of significant spills or leaks of pollutants that have occurred at the facility during the 3 previous years and any corrective actions taken to mitigate spill impacts. (e) Certification that the stormwater outfalls have been evaluated for the presence of non-stormwater discharges. The certification statement will be signed in accordance with the requirements found in Part III, Standard Conditions, Section B, Paragraph 3. 2. Stormwater Management Plan. The stormwater management plan shall contain a narrative description of the materials management practices employed which control or minimize the exposure of significant materials to stormwater, including structural and nonstructural measures. The stormwater management plan, at a minimum, shall incorporate the following: Part II Page 1 of 6 Permit No. NCS000061 (a) Feasibility Study. A review of the technical and economic feasibility of changing the methods of operations and/or storage practices to eliminate or reduce exposure of materials and processes to stormwater. Wherever practical, the permittee shall prevent exposure of all storage areas, material handling operations, and manufacturing or fueling operations. In areas where elimination of exposure is not practical, the stormwater management plan shall document the feasibility of diverting the stormwater runoff away from areas of potential contamination. (b) Secondary Containment Schedule. A schedule to provide secondary containment for -bulk storage of liquid materials, storage of Section 313 of Title III of the Superfund Amendments and Reauthorization Act (SARA) water priority chemicals, or storage of hazardous substances to prevent leaks and spills from contaminating stormwater runoff. If the secondary containment devices are connected directly to stormwater conveyance systems, the connection shall be controlled by manually activated valves or other similar devices [which shall be secured with a locking mechanism] and any stormwater that accumulates in the containment area shall be at a minimum visually observed for color, foam, outfall staining, visible sheens and dry weather flow, prior to release of the accumulated stormwater. Accumulated stormwater shall be released if found to be uncontaminated by the material stored within the containment area. Records documenting the individual making the observation, the description of the accumulated stormwater and the date and time of the release shall be kept for a . period of five years. (c) BMP Summary. A narrative description shall be provided of Best Management Practices (BMPs) to be considered such as, but not limited to, oil and grease separation, debris control, vegetative filter strips, infiltration and stormwater detention or retention, where necessary. The need for structural BMPs shall be based on the assessment of potential of sources to contribute significant quantities of pollutants to stormwater discharges and data collected through monitoring of stormwater discharges. 3. Spill Prevention and Response Plan. The Spill Prevention and Response Plan (SPRP) shall incorporate an assessment of potential pollutant sources based on a materials inventory of the facility. Facility personnel (or team) responsible for implementing the SPRP shall be identified. A responsible person shall be on -site at all times during facility operations that have the potential to contaminate stormwater runoff through spills or exposure of materials associated with the facility operations. The SPRP must be site stormwater specific. Therefore, a SPCC plan may be a component of the SPRP, but may not be sufficient to completely address the stormwater aspects of the SPRP. The common elements of the SPCC with the SPRP may be incorporated by reference into the SPRP. 4. Preventative Maintenance and Good Housekeeping Program. A preventative maintenance program shall be developed. The program shall document schedules of inspections and maintenance activities of stormwater control systems, plant equipment and systems. Inspection of material handling areas and regular cleaning schedules of these areas shall be incorporated into the program. Part 11 Page 2 of 6 Permit No. NCS000061 Employee Training. Training schcdules shall be developed and training provided at a minimum on an annual basis on proper spill response and cleanup procedures and preventative maintenance activities for all personnel involved in any of the facility's operations that have the potential to contaminate stormwater runoff. Facility personnel (or team) responsible for implementing the training shall be identified. 6. Responsible Party. The'Stormwater Pollution Prevention Plan shall identify a specific position(s) responsible for the overall coordination, development, implementation, and revision to the Plan. Responsibilities for all components of the Plan shall be documented and position assignments provided. 7. Plan Amendment. The permittee shall amend the Plan whenever there is a change in design, construction, operation, or maintenance which has a significant effect on the potential for the discharge of pollutants to surface waters. The Stormwater Pollution Prevention Plan shall be reviewed and updated on an annual basis. The Director may notify the permittee when the Plan does not meet one or more of the minimum requirements of the permit. Within 30 days of such notice, the permittee shall submit a time schedule to the Director for modifying the Plan to meet minimum requirements. The permittee shall provide certification in writing (in accordance with Part III, Standard Conditions, Section B, Paragraph 3) to the Director that the changes have been made. Facility Inspection Program. Facilities are required to inspect all stormwater systems on at least a semiannual schedule, once in the fall (September -November) and once in the spring (April - June). The inspection and any subsequent maintenance activities performed shall be documented, recording date and time of inspection, individual(s) making the inspection and a narrative description of the facility's stormwater control systems, plant equipment and systems. Records of these inspections shall be incorporated into the Stormwater Pollution Prevention Plan. Stormwater discharge characteristic monitoring as required in Part II of this permit shall be performed in addition to facility inspections. 9. Implementation. The permittee shall document all monitoring, measurements, inspections and maintenance activities and training provided to employees, including the log of the sampling data and of activities taken to implement BMPs associated with the industrial activities, including vehicle maintenance activities. Such documentation shall be kept on -site for a period of five years and made available to the Director or his authorized representative immediately upon request.
